ORDINANCE NO. 930446

 

Amending Chapter 34 of the Code of General Ordinances of Kansas City, Missouri entitled "Traffic Code" by repealing Section 34.15 thereof entitled "Authority to close streets, regulate parking for construction or other special operations; fees" and enacting in lieu thereof a new section of like number and similar subject.

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That Chapter 34 of the Code of General Ordinances of Kansas City, Missouri, entitled "Traffic Code" is hereby amended by repealing Section 34.15 entitled "Authority to close streets, regulate parking for construction or other special operations; fees" and enacting in lieu thereof a new section of like number entitled "Authority to close streets, sidewalks and other right of way, regulate parking for construction or other special operations; fees" to read as follows:

 

Sec. 34.15. Authority to close streets, sidewalks and other right of way, regulate parking for construction or

other special operations; fees.

 

(a) The Director shall have authority to close or issue a permit to close any street, sidewalk, right of way or part thereof when in his opinion the closing is necessary for construction operations, or for the protection of public health or safety, or other special condition. No street, sidewalk or other right of way shall be closed to traffic for any purpose without first obtaining a permit from the Director. Upon granting a permit the Director shall collect from the applicant and deposit in the City Treasury a service fee in the amount of $25.00, except when the closure is for the protection of public health or safety.

 

(b) The Director shall have authority to establish emergency parking restrictions or prohibitions upon any street or part thereof upon the request of any responsible applicant when in the opinion of the Director the parking restrictions are necessary for construction or other special conditions. The applicant shall notify the Public Works Department immediately when construction is complete or when any special conditions cease to exist.

 

(c) The Director may install or allow responsible applicants to install signs giving notice of the approved emergency parking restrictions or prohibitions permitted under subsection (b) of this section. The applicant shall immediately notify the Public Works Department when the signs are installed and shall immediately remove the signs when construction is complete or the special conditions end.

 

Section B. All provisions of Chapter 34 not repealed and reenacted above shall remain effective.
