RESOLUTION NO. 050526
Approving an amendment to the Gashland Area Plan for an approximately 40 acre tract of land generally located south of N.W. 88th Street and east of N. Platte Purchase Road, by changing the recommended land use from office/commercial to medium density residential. (215-S-12)
WHEREAS, on February 11, 1977, the City Council, through the adoption of Resolution No. 47383, adopted the Gashland Area Plan being the Plan for development and redevelopment of that area bounded by 96th Street on the north, the city limits of Gladstone on the south except at the extreme eastern limits which extend south to Pleasant Valley Road, N. Brighton Avenue on the east and the Clay-Platte County line on the west; and
WHEREAS, the Gashland Area Plan was amended through the adoption of Resolution No. 971066 on October 9, 1997; was amended through the adoption of Resolution No. 980922 on September 24, 1998; was amended through the adoption of Resolution No. 991459 on March 23, 2000; was amended through the adoption of Resolution No. 010516 on April 26, 2001; was amended through the adoption of Resolution No. 011046 on August 23, 2001; and was amended through the adoption of Resolution No. 030859 on August 21, 2003; and was further amended through the adoption of Resolution No. 031394 on April 1, 2004; and
WHEREAS, after further review, it has been deemed appropriate to amend the Gashland Area Plan for an approximately 40 acre tract of land generally located south of N.W. 88th Street and east of N. Platte Purchase Road, by changing the recommended land use from office/commercial to medium density residential.; and
WHEREAS, public notice of a hearing before the City Plan Commission was published on March 21, 2005; and
WHEREAS, the City Plan Commission considered such amendment to the Proposed Land Use Plan and Map on April 5, 2005; and
WHEREAS, after all interested persons were given an opportunity to present testimony, the City Plan Commission did on April 5, 2005, recommend approval of the proposed amendment to the Gashland Area Plan; NOW, THEREFORE,
BE IT RESOLVED BY THE COUNCIL OF KANSAS CITY:
Section A. That the Gashland Area Plan is hereby amended by amending the Proposed Land Use Plan and Map for an approximately 40 acre tract of land generally located south of N.W. 88th Street and east of N. Platte Purchase Road, by changing the recommended land use from office/commercial to medium density residential. A copy of the amendment to the Gashland Area Plan is attached hereto as Exhibit "A" and incorporated herein by reference.
Section B. That the amendment to the Gashland Area Plan and this amendment is consistent and complies with the FOCUS Kansas City Plan, adopted on October 30, 1997, by Committee Substitute for Resolution No. 971268, and is adopted as a supplement to the FOCUS Kansas City Plan.
Section C. That the Council finds and declares that before taking any action on the proposed amendment hereinabove, all public notices and hearings required by law have been given and had.
