ORDINANCE NO. 961592
Approving the preliminary plat of Pembrooke Estates on a
47.86 acre tract of land generally located on the west side of N. Indiana
Avenue, between N.E. 85th Terrace and N.E. 92nd Street. (SD 0763)
BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:
Section A. That the preliminary plat of Pembrooke
Estates on a 47.86 acre tract of land generally located on the west side of N.
Indiana Avenue, between N.E. 85th Terrace and N.E. 92nd Street, and more
specifically described as follows:
A tract of land in the Southwest Quarter of Section
6, Township 51, Range 32, Kansas City, Clay County, Missouri, being
described as follows: Commencing at the southeast corner of said Southwest
Quarter; thence South 89 25'46" West, along the south line of said
Southwest Quarter, 1024.90 feet to the true point of beginning of the
tract to be herein described; thence continuing South 89 25'46" West,
along said south line, 633.35 feet; thence North 0 21'28" West,
parallel with the east line of said Southwest Quarter, 738.50 feet; thence
South 89 25'46" West, parallel with said south line, 8.95 feet;
thence North 0 21'28" West, parallel with and 1667.20 feet west of
the east line of said Southwest Quarter, 966.05 feet; thence North 89
25'46" East, parallel with the south line of said Southwest Quarter,
1667.20 feet to a point on the east line of said Southwest Quarter; thence
South 0 21'28" East, along said east line, 966.05 feet; thence South
89 25'46" West, parallel with and 738.50 feet north of the south line
of said Southwest Quarter, 1024.90 feet; thence South 0 21'28" East,
parallel with and 1024.90 feet west of the east line of said Southeast Quarter,
738.50 feet to the true point of beginning. Containing 47.86 acres, more
or less.
is hereby approved, subject to the following conditions:
1. That the developer cause the area to be platted
and processed in accordance with Chapter 66, Code of Ordinances of
the City of Kansas City, Missouri, as amended,
commonly known as the Subdivision Regulations.
2. That the developer submit a storm drainage
study for the entire development to the City Engineer's Office for
approval when the first plat is submitted and that the
developer make any necessary improvements as
required by the City Engineer's
Office.
3. That the developer submit plans for grading and
siltation and erosion control to the City Engineer's Office for
approval prior to the commencement of any construction
activities.
4. That the developer secure the approval of the
Street Naming Committee for all street names.
5. That the developer install hard surface roads
and fire protection prior to construction beyond foundations.
6. That the developer provide for fire protection
as required by the Fire Department.
7. That the developer construct temporary
cul-de-sacs for each phase as required by the Department of Public
Works.
8. That the developer extend water mains as
required by the Water Services Department.
9. That the developer extend sanitary sewers as
required by the Department of Public Works.
10. That the developer dedicate right of way for N.
Indiana Avenue as required by the Department of Public Works so as to
provide 50 feet of right of way as measured
from the centerline of N. Indiana Avenue.
11. That the developer improve one-half of N.
Indiana Avenue to primary arterial street standards as required by
the Department of Public Works, including sidewalks and
streetlights.
12. That the developer contribute $26,229.57 in
lieu of parkland dedication for 141 single family lots in
satisfaction of Section 66-128 of the Subdivision Regulations.
13. That the developer secure a land disturbance
permit from the Missouri Department of Natural Resources.
14. That the developer receive the approval of the
Board of Zoning Adjustment for any signage.
15. That the developer submit a street tree
planting plan with the final plat to the City Forester for approval
with spacing, species and size of street trees to be approved by
the City Forester.
16. That the developer show the limits of the 100
year flood plain on the final plat as required by the City Engineer's
Office.
17. That the developer shall not develop Phase 6 as
shown on the preliminary plat until such time as the street through
Essex Ridge to the south is constructed.
A copy of said preliminary plat is on file in the office
of the City Clerk under Document No. 961592, which is attached hereto and made
a part hereof.
Section B. That the Council finds and declares that
before taking any action on the proposed preliminary plat hereinabove, all
public notices and hearings required by the Subdivision Regulations have been
given and had.
