Repealing
Resolution No. 030870, passed August 28, 2003, and enacting in lieu thereof a
new resolution to correct a clerical error in Resolution No. 030870 that
declares it necessary to establish the grade on Brooklyn Avenue from the north
line of 83rd Street Terrace (on the west side) to the south line of 82nd Street
Terrace; Maddi, from Brooklyn Avenue west 105.0 feet; 83rd Street Terrace
from Brooklyn Avenue east 127.50 feet and 83rd Street, from the west line of
Brooklyn, west 90.88 feet, all in Kansas City, Jackson County, Missouri.
WHEREAS, on August 29, 2003, the City Council
passed Resolution No. 030870 to establish the grade on Brooklyn Avenue from
the North line of 83rd Street Terrace (on the west side) to the south line of
82nd Street Terrace, Maddi, from Brooklyn Avenue, west 105.0 feet; 83rd Street
Terrace, from Brooklyn Avenue, east 127.50 feet and 83rd Street, from the west
line of Brooklyn, west 90.88 feet, all in Kansas City, Jackson County,
Missouri; and
WHEREAS,
Resolution No. 030870 contained a clerical error in that it stated the grade
point on 83rd Street Terrace 25 feet east of the centerline of Brooklyn Avenue
is 888.74; and
WHEREAS,
the grade point on 83rd Street Terrace 25 feet east of the centerline of
Brooklyn Avenue is 888.74 is actually 885.74 and not 888.74; NOW, THEREFORE,
BE IT RESOLVED BY THE COUNCIL
OF KANSAS CITY:
Section
1. That Resolution No. 030870 is hereby repealed to correct a clerical error
and Resolution No. 040132 is hereby enacted in lieu thereof to correct the
clerical error as provided in Section 2.

2. That the Council finds and declares it to be necessary to establish the
grade on Brooklyn Avenue from the north line of 83rd Street Terrace (on the
west side) to the south line of 82nd Street Terrace, in Kansas City, Jackson
County, Missouri, in accordance with the provisions of Section 224, Article VII
of the Charter of Kansas City, and as shown on the plans on file in the office
of the Director of Public Works, locating and defining the adjacent grade
points on said street, on the baseline of the roadway (which is situated 25
feet east of the west right-of-way line), which shall be connected by straight
grades (tangents) or vertical curves between such grade points, the elevations
of which are herein given below in feet and are North American Vertical Datum
1988, to-wit:
All grade points are on the centerline of Brooklyn
Avenue (which is situated 25 feet east of the west right-of-way line), as found
on plan File No. 2002-092 in the office of the Director of Public Works.
