ORDINANCE NO. 090812

 

Authorizing acceptance of a $2,371,367.00 grant from the U.S. Department of Housing and Urban Development through the Community Development Block Grant Program as established in the American Recovery and Reinvestment Act of 2009; appropriating funds and estimating revenues in the amount of $2,371,367.00 to the ARRA Stimulus Fund grant account; authorizing execution of contracts with various nonprofit organizations for project implementation; and designating requisitioning authorities.

 

WHEREAS, the American Recovery and Reinvestment Act of 2009 (ARRA), passed by Congress and signed by the President on February 17, 2009, established the Community Development Block Grant Recovery Fund; and

 

WHEREAS, ARRA established the Community Development Block Grant Recovery Program (CDBG-R), Federal Register FR-5309-N-01, to stimulate the economy through measures that modernize the Nations infrastructure, improve energy efficiency, and expand educational opportunities and access to health care; and

 

WHEREAS, Committee Substitute for Resolution No. 090436 amended the 2008 Consolidated One Year Action Plan to include the CDBG-R funding and said amended plan was submitted to the U.S. Department of Housing and Urban Development (HUD) on June 5, 2009, and was subsequently approved on July 29, 2009; and

 

WHEREAS, in order to implement this Substantial Amendment to the 2008 One Year Action Plan, contracts with various nonprofit organizations are required; NOW, THEREFORE,

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. That the Mayor, on behalf of the City of Kansas City, Missouri, is authorized to accept a grant from the U.S. Department of Housing and Urban Development in the amount of $2,371,367.00 pursuant to the Community Development Block Grant Recovery Program of the American Recovery and Reinvestment Act of 2009 to provide CDBG-eligible activities. A copy of the Grant Agreement is on file in the office of the Director of the Housing and Community Development Department and is incorporated herein by reference.

 

Section 2. That $2,371,367.00 is estimated in the ARRA Stimulus Fund grant to the following account:

 

10-2530-550001-479979 Grant Revenue $2,371,367.00

 

Section 3. That $2,371,367.00 is appropriated from the Unappropriated Fund Balance of the ARRA Stimulus Fund to the following accounts in the ARRA Stimulus Fund:

 

10-2530-555300-A CDBG Administration $ 187,137.00

10-2530-105300-B Economic Development 50,000.00


10-2530-555310-B Economic Development 386,781.00

10-2530-555317-B Housing Development 1,747,449.00

TOTAL $2,371,367.00

 

Section 4. That the Director of Housing and Community Development is authorized to enter into a contract and expend up to $386,781.00, including contingencies, from funds appropriated to Account No. 10-2530-555310-G55CDBGST to satisfy the cost of the following special economic development contract:

 

Black Economic Union (Historic Lincoln Bldg.) $ 386,781.00

 

Section 5. That the Director of Housing and Community Development is authorized to enter into contracts and expend up to $1,747,449.00, including contingencies, from funds appropriated to Account No. 10-2530-555317-G55CDBGST to satisfy the cost of the following housing development contracts:

 

Harvest Community Development Group (Destiny Towers) $ 997,449.00

Palestine Village CDC (Palestine Commons) 750,000.00

TOTAL $1,747,449.00

 

Section 6. That the Director of Housing and Community Development is designated as requisitioning authority for Account Nos. 10-2530-555300, 10-2530-555310, and 10-2530-555317.

 

Section 7. That the City Manager is designated as requisitioning authority for Account No. 10-2530-105300.

 

 

I hereby certify that there is a balance, otherwise unencumbered, to the credit of the appropriation to which the foregoing expenditure is to be charged, and a cash balance, otherwise unencumbered, in the treasury, to the credit of the fund from which payment is to be made, each sufficient to meet the obligation hereby incurred.
