COMMITTEE SUBSTITUTE FOR ORDINANCE NO. 041275

 

Rezoning an area of approximately 129 acres generally bounded by Interstate 670 on the north, 21st Street on the south, Interstate 35 on the east and Beardsley Road and West Pennway on the west, from Districts R2-b, R-4, C-1 and M-1 to Districts R-1b and R-2b.

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That Chapter 80, Code of Ordinances of the City of Kansas City, Missouri, commonly known as the Zoning Ordinance, is hereby amended by enacting a new section to be known as Section 80-11A0590, rezoning an area of approximately 129 acres generally bounded by Interstate 670 on the north, 21st Street on the south, Interstate 35 on the east and Beardsley Road and West Pennway on the west, from Districts R-2b (Two Family Dwellings), R-4 (Low Apartments), C-1 (Neighborhood Retail Business and M-1 (Light Industry) to Districts R-1b (One-Family Dwellings) and R-2b (Two-Family Dwellings), said section to read as follows:

 

Section 80-11A0590. That an area legally described as:

 

A tract of land described as follows: Beginning at the intersection of the east line of Beardsley Road and the north line of 17th Street, then east along the north line of 17th Street to the north-south alley next west of Madison Avenue, then north along said north-south alley to the south line of 16th Street, then west along the south line of 16th Street to the west line of Jarboe Street, then north along the west line of Jarboe Street to the south line of Interstate 670, then west along the south line of Interstate 670 to the east line of Beardsley Road, then south along the east line of Beardsley Road to the point of beginning, except for Lot Split - Tracts A and B of Lots 3 thru 7, inclusive, of Resurvey of Paynes Addition, a subdivision in Kansas City, Jackson County, Missouri, Section 6, Township 49 North, according to the recorded plat thereof,

 

is hereby rezoned from R-4 (Low Apartments), C-1 (Neighborhood Retail Business) and M-1 (Light Industry) to District R-2b (Two-Family Dwellings),

 

and

 

That an area legally described as:

 

Lot 1, Block 7, Resurvey of Paynes Addition; Lots 16 through 19, Block 2, Mulkeys Addition except that portion in right of way; Lot 112, Prospect Place; Lots 63, 64 and 67 Prospect Place, also known as Tracts A and B, Certificate of Survey S-08, Page 91, except that portion in right of way; Lot 32 ,Block 2, Mulkeys Addition except that portion in right of way; Lots 62, 65 and 66, Prospect Place except that portion in right of way; Lots 19 through 23, Prospect Place except that portion in right of way; a portion of the SW of the SE Section 6-49-33, Kansas City, Jackson County, Missouri beginning on the west line of Madison Avenue 164 feet north of the north line of 17th Street, then west 132 feet, then south 59 feet then east 132 feet then north 59 feet to the point of beginning; a portion of the SW of the SE Section 6-49-33, Kansas City, Jackson County, Missouri beginning on the west line of Madison Avenue 164 feet north of the north line of 17th Street, then north along said west line 75 feet then west 132 feet then south 75 feet then east 132 feet to the point of beginning; Lots 78, 81, 83, 85, 86, 89, 90, 94, 95, 98, 99, 102 and 103, Prospect Place; Lots 35 through 61, Prospect Place; a portion of the SW of the SE Section 6-49-33, Kansas City, Jackson County, Missouri beginning at the southwest corner of Lot 61 Prospect Place then south along the east line of Madison Avenue 99.9 feet then east 125 feet then north 99.9 feet to the southeast corner of said lot then west 125 feet to the point of beginning; the west 126.5 feet of Lots 45 through 66, and Lot 67 except that portion in alley, Block 4, King & Boutons Addition,

is hereby rezoned from District R-4 (Low Apartments) to District R-1b (One-Family Dwellings),

 

all in Sections 6 and 7, Range 33 West, Township 49 North, Kansas City, Jackson County, Missouri

 

is hereby rezoned from Districts R-2b (Two Family Dwellings), R-4 (Low Apartments), C-1 (Neighborhood Retail Business and M-1 (Light Industry) to Districts R-1b (One-Family Dwellings) and R-2b (Two-Family Dwellings), all as shown outlined on a map marked Section 80-11A0590, which is attached hereto and made a part hereof, and which is hereby adopted as a part of an amendment to the zoning maps constituting a part of said chapter and as an amendment to Section 80-11 thereof.

 

Section B. That the Council finds and declares that before taking any action on the proposed amendment hereinabove, all public notices and hearings required by the Zoning Ordinance have been given and had.
