Terminating and deleting a previously approved Chapter 80 development plans in Districts B3-2 (PD/C2) and R-2.5 (R2b) on approximately 24 acres, as approved by Committee Substitute for Ordinance No. 001697 on February 15, 2001 (now Ordinance No. 040043, passed February 26, 2004) and a plan on approximately 26 acres, as approved with Ordinance No. 040794 on August 5, 2004. BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. That two previously approved Chapter 80 preliminary development plans are hereby terminated and deleted in Districts B3-2 (PD/C2) and R-2.5 (R2b) on approximately 24 acres, as approved by Committee Substitute for Ordinance No. 001697 on February 15, 2001 (as amended by Ordinance No. 040043, passed February 26, 2004) and on approximately 26 acres, as approved with Ordinance No. 040794 on August 5, 2004. The plans to be deleted are legally described as follows:

 

Tract 1 Property Description (Apartment Plan): All that part of the Northeast Quarter of Section 25, Township 52, Range 33, Kansas City, Clay County, Missouri, being described as follows: Commencing at the Southwest corner of said Northeast Quarter; thence North 0 degrees 35 minutes 00 seconds East, along the West line of said Northeast Quarter, 1347.82 feet; thence South 89 degrees 25 minutes 00 seconds East, 25.00 feet to a point on the East right-of-way line of N Woodland Avenue, as now established, said point being the Point of Beginning of the tract to be herein described; thence North 0 degrees 35 minutes 00 seconds East, along said East right-of-way line, 876.35 feet; thence South 89 degrees 14 minutes 03 seconds East, 314.64 feet; thence South 64 degrees 49 minutes 02 seconds East, 721.61 feet; thence South 26 degrees 36 minutes 25 seconds East, 1070.84 feet; thence South 34 degrees 12 minutes 55 seconds West, 272.37 feet; thence North 26°36'25” West, 30.61 feet; thence South 34 degrees 14 minutes 19 seconds West, 74.95 feet; thence Northwesterly, along a curve to the right, having an initial tangent bearing of North 55 degrees 40 minutes 15 seconds West, a radius of 300.00 feet, a central angle of 56 degrees 14 minutes 53 seconds, an arc distance of 294.51 feet; thence North 0 degrees 34 minutes 39 seconds East, 172.21 feet; thence North 89 degrees 25 minutes 21 seconds West, 319.66 feet; thence Westerly, along a curve to the right, tangent to the last described course, having a radius of 350.00 feet, a central angle of 34 degrees 24 minutes 42 seconds, an arc distance of 210.21 feet; thence North 55 degrees 00 minutes 39 seconds West, 171.98 feet; thence Westerly, along a curve to the left, tangent to the last described course, having a radius of 340.00 feet, a central angle of 34 degrees 24 minutes 21 seconds, an arc distance of 204.17 feet; thence North 89 degrees 25 minutes 00 seconds West, 268.86 feet to the point of beginning. Containing 25.49 acres, more or less.

 

Tract 2 Property Description (Commercial Plan): All that part of the Northeast Quarter of Section 25, Township 52, Range 33, Kansas City, Clay County, Missouri, being described as follows: Commencing at the Southwest corner of said Northeast Quarter; thence North 0 degrees 35 minutes 00 seconds East, along the East line of said Northeast Quarter, 395.96 feet; thence South 89 degrees 25 minutes 00 seconds East, 75.00 feet to a point on the East right-of-way line of Woodland Avenue, as established by Book 5980 at Page 34 in the Office of the Recorder of Deeds in Clay County, Missouri, said point being the Point of Beginning of the tract to be herein described; thence North 0 degrees 35 minutes 00 seconds East, along said East right-of-way line, 514.89 feet; thence North 89 degrees 59 minutes 58 seconds West, along said East line, 45.00 feet to a point 30.00 feet East of the West line of the Northeast Quarter of said Section 25, said point being on the East right-of-way of said North Woodland Avenue, as now exists; thence North 00 degrees 35 minutes 00 seconds East, along said East right-of-way line, 437.42 feet; thence South 89 degrees 25 minutes 00 seconds East, 268.86 feet; thence Southeasterly, along a curve to the right, tangent to the last described course, having a radius of 340.00 feet, a central angle of 34 degrees 24 minutes 21 seconds, an arc distance of 204.17 feet; thence South 55 degrees 00 minutes 39 seconds East, 171.98 feet; thence Easterly, along a curve to the left, tangent to the last described course, having a radius of 350.00 feet, a central angle of 34 degrees 24 minutes 42 seconds, an arc distance of 210.21 feet; thence South 89 degrees 25 minutes 21 seconds East, 319.66 feet; thence South 0 degrees 34 minutes 39 seconds West, 172.21 feet; thence Southerly, along a curve to the left, tangent to the last described course, having a radius of 300.00 feet, a central angle of 56 degrees 14 minutes 53 seconds, an arc distance of 294.51 feet; thence South 34 degrees 14 minutes 19 seconds West, 105.46 feet; thence Southwesterly, along a curve to the right, tangent to the last described course, having a radius of 300.00 feet, a central angle of 14 degrees 11 minutes 36 seconds, an arc distance of 74.32 feet; thence South 48 degrees 25 minutes 55 seconds West, 217.36 feet; thence Southwesterly, along a curve to the left, tangent to the last described course, having a radius of 300.00 feet, a central angle of 32 degrees 08 minutes 19 seconds, an arc distance of 168.28 feet; thence South 16 degrees 17 minutes 36 seconds West, 51.42 feet to a point on the Northerly right-of-way line of Shoal Creek Parkway, as established by said Book 5980 at Page 34; thence Westerly, along said Northerly right-of-way line, on a curve to the left, having an initial tangent bearing of North 72 degrees 44 minutes 53 seconds West, a radius of 2812.00 feet, a central angle of 16 degrees 19 minutes 23 seconds, an arc distance of 801.12 feet; thence Northwesterly, along a curve to the right, having a common tangent with the last described course, a radius of 50.00 feet, a central angle of 89 degrees 39 minutes 17 seconds, an arc distance of 78.24 feet to the point of beginning. Containing 23.05 acres, more or less.
