Approving
a Community Unit Project on an approximately 38.15 acre tract of land generally
located on the west side of the 9200 block of Noland Road, approximately 2000
feet north of Bannister Road. (12390-CUP-2)
BE
IT ORDAINED BY THE COUNCIL OF KANSAS CITY:
Section
A. That a Community Unit Project on an approximately 38.15 acre tract of land
generally located on the west side of the 9200 block of Noland Road,
approximately 2000 feet north of Bannister Road, and more specifically
described as follows:
All that part of the Northeast Quarter of
Section 27 and all that part of the Northwest Quarter of Section 26, all in
Township 48 North, Range 32 West, Kansas City, Jackson County, Missouri,
described as follows: Commencing at the common section corner at Sections 22,
23, 26 and 27, Township 48 North, Range 32 West; thence South 02E27'41" west along the east line of
the Northeast Quarter of Section 27, a distance of 1138.85 feet; thence South
87E32'19" East, a
distance of 34.34 feet to the point of beginning; thence South 73E49'51" East, a distance of 244.07
feet; thence North 75E08'26" East, a
distance of 163.89 feet; thence North 31E31'26"
East, a distance of 173.49 feet; thence North 66E39'16" East, a distance of 40.00 feet to
the point of curve of a non-tangent curve to the right having a central angle
of 26E55'06" and a radius
of 2814.79 feet, the radius point bears South 66E39'16" West; thence southerly and to the
right along the arc of that curve a distance of 1322.42 feet to the point of
tangent; thence South 03E34'22" West, a
distance of 150.47 feet to a point on the south line of Lot 37, Unity Ridge and
Gardens a subdivision in Kansas City, Jackson County, Missouri, according to
the recorded plat thereof; thence South 86E43'46"
West along the south line of said Lot 37, Unity Ridge and Gardens, a distance
of 754.58 feet; thence North 20E54'11"
West, a distance of 266.63 feet; thence North 39E48'58" West, a distance of 304.89 feet;

the point of beginning. Said tract of land contains 38.15 acres more or less.
is
hereby approved, subject to the following conditions:
1. That
the developer cause the area to be platted and processed in accordance with
Chapter 66, Code of Ordinances of the City of Kansas City, Missouri, as
amended, commonly known as the Subdivision Regulations.
2. That
the developer submit a storm drainage study for the entire development to the
City Engineers Office for approval when the first final plat is submitted and
that the developer construct any improvements as required by the City Engineers
Office.
3. That
the developer submit plans for grading and siltation and erosion control to the
City Engineer's Office for approval prior to beginning any construction
activities.
4. That
the developer secure a land disturbance permit from the Department of Public
Works prior to beginning any construction, grading, clearing or grubbing
activities, if the disturbed area exceeds one acre.
5. That
the developer secure a land disturbance permit from the Missouri Department of
Natural Resources.
6. That
the developer dedicate additional right of way for Noland Road as required by
the Department of Public Works so as to provide a total of 50 feet of right of
way as measured from the centerline of Noland Road.
7. That
the developer construct a sidewalk and install street lights on the west side
of Noland Road as required by the Department of Public Works.
8. That
a waiver to the provisions of Section 66-83(f) is hereby granted so as to
permit construction of sidewalks on only one side of the internal streets as
indicated on the Community Unit Project plan. The sidewalks shall be
constructed in accordance with the requirements of the Department of Public
Works.
9. That
the developer submit covenants, conditions and restrictions with the final plat
to the Law Department for approval for the maintenance of the private open
space and all common areas.
10. That
the developer install hard surface roads and provide for fire protection as
required by the Fire Department prior to construction beyond foundations.
11. That
the developer extend water mains as required by the Water Services Department.
12. That
the developer submit a street tree planting plan as part of the final plat,
secure the approval of the City Forester for street trees planted on right of
way in front of residential lots, with a copy to be submitted to the Department
of City Development,
and plant the street trees in conformance with
the plan approved by the City Forester. The plan shall include size, type,
species and placement of trees.
13. That
the developer submit a street name signage plan to the Street Naming Committee
for approval.
14. That
the developer extend sanitary sewers as required by the Department of Public
Works.
15. That
the developer receive the approval of the Board of Zoning Adjustment for any
proposed subdivision identification signs prior to the issuance of a sign
permit.
16. That
the developer submit a final plan to the City Plan Commission for all private
open space areas for approval, including plans for pedestrian pathways,
landscaping, grading, screening, berming, fencing and private park development.
A
copy of said Community Unit Project plan is on file in the office of the City
Clerk under Document No. 000812, which is attached hereto and made a part
hereof.
Section
B. That the Council finds and declares that before taking any action on the
proposed Community Unit Project hereinabove, all public notices and hearings
required by the Zoning Ordinance have been given and had.
