ORDINANCE NO. 980380
Submitting
to the qualified voters at a special municipal election called for August 4,
1998, an amendment to City Charter Section 6.4 to establish term limits of
three consecutive terms as council member or as mayor for persons first elected
on or after March 23, 1999, and retaining term limits of two consecutive terms
as council member or as mayor as established on November 6, 1990, for persons
currently serving as mayor or council member; directing the City Clerk to
notify the responsible election authorities of the election being called; and
recognizing this ordinance to be an emergency measure.
BE
IT ORDAINED BY THE COUNCIL OF KANSAS CITY:
Section
1. Amendments to the City
Charter. That a special election is called for August 4, 1998, to submit
to the qualified voters of the City the following proposed amendment to the
Charter of Kansas City: Section 6.4, to read as follows:
Sec.
6.4. Limitation on term of office for council members and mayor.
(a)
Current mayor and council members. A person elected as mayor or
council member on or after March 28, 1995, but before march 23, 1999, may not
be elected a member of the council if elected to the council in each of the
last two (2) regular municipal elections. No person may be elected mayor who
has been elected mayor in each of the last two (2) regular municipal elections.
(b)
Mayor and council members first elected on March 23, 1999. A
person elected on or after March 23, 1999, as mayor or council member who was
not serving at that time as mayor or council member as a result of election on
or after March 28, 1995, may not be elected a member of the council if elected
to the council in each of the last three (3) regular municipal elections. No
person may be elected mayor who has been elected mayor in each of the last
three (3) regular municipal elections.

2. Ballot Title. That the
ballot title for the proposition established by this ordinance shall be as
follows:

Section
3. Election Date. That an
election is called for August 4, 1998, for the purpose of submitting to the
voters of Kansas City the question of amending the City Charter to establish
term limits of three consecutive terms for persons not currently serving as mayor
or council member.
Section
4. Delivery of Ordinance by City
Clerk to Election Authorities. That the Clerk shall deliver certified
copies of this ordinance and notice of election to the Board of Election
Commissioners of Kansas City, Missouri, to the Board of Election Commissioners
of Clay County, to the Board of Election Commissioners of Platte County, and to
the County Clerk of Cass County, which shall be the authority of the respective
election authorities of the City to submit these amendments to the electors of
Kansas City as herein provided and to give public notice thereof as provided by
law on or before Tuesday, May 26, 1998.

5. Election Notice. That the
notice of election shall read as follows:

Notice is hereby given that the City of Kansas City
has called an election to be held in said City on Tuesday, August 4, 1998, at
which election all qualified voters residing within the City of Kansas City,

official ballot will be in substantially the following form:

Section
6. Emergency. That this
ordinance provides for the submission of a proposal to the people of Kansas
City, Missouri, and is hereby recognized to be an emergency measure within the
meaning of Section 15, Article II, of the Charter of Kansas City, and as such
shall become effective immediately upon its passage.
Section
7. Effective Date of Changes to
the Charter. If approved by the voters, the amendment to the Charter of
Kansas City, section 6.4, shall be effective immediately.
