COMMITTEE SUBSTITUTE FOR RESOLUTION NO. 130841

Directing the City Attorney to file appropriate documents to modify the boundaries of the Park Plaza Transportation Development District ("District") to add the additional area owned and to be owned by the City for the relocation of N.W. Prairie View Road north from its current point terminating on the north side of the District for the relocation of said road and to add the second phase of the N.W. Prairie View Road Project as a transportation project of the District.

WHEREAS, it is in the best interests of the City to relocate N.W. Prairie View Road north of Missouri Route 45 Highway from its current location adjacent to Interstate I-29 to a new point approximately 750 feet west to align with existing North Chatham Road; and

WHEREAS, in order to fund the necessary improvements in addition to funding provided by the City, a transportation development district was formed which is known as the Park Plaza Transportation Development District. Said District implemented a one percent sales and use tax within the District boundaries in order to provide a portion of the necessary funding of the relocation of N.W. Prairie View Road; and

WHEREAS, the first phase of this roadway relocation was constructed and completed so that it currently ends approximately 650 feet north of Missouri Highway 45 (N.W. 64th Street); and

WHEREAS, the City has previously acquired some of the property located north of the current termination of said road (and is working to acquire the remaining property needed) in order to construct the second phase of the N.W. Prairie View Road improvements; and

WHEREAS, the second phase of the N.W. Prairie View Road Improvement Project will be funded through a combination of City funds and bonds issued that are secured by the District's sales and use tax; and

WHEREAS, following completion of the construction of the extension of N.W. Prairie View Road approximately 1,200 feet north, the old N.W. Prairie View Road will be removed from the point that it meets the relocated street south to the point that it meets Missouri Highway 45 (N.W. 64th Street) and the Missouri Highways and Transportation Commission will dispose of this right of way in accordance with its procedures; and

WHEREAS, completion of the Second Phase of the N.W. Prairie View Road Project will greatly improve the safety and functioning of the current operations of the N.W. Prairie View Road/Interstate 29/Missouri Highway 45 corridor; and  

WHEREAS, it is anticipated that the Second Phase of the N.W. Prairie View Road Project will be constructed and managed by the City through a Cooperative Agreement with the District; and

WHEREAS, in order to implement the Second Phase of the N.W. Prairie View Road Project, the Court order forming the District needs to be modified to add the additional area for the northward relocation of N.W. Prairie View Road to the District's boundaries and to add the Second Phase of the N.W. Prairie View Road Project as a transportation project of the District NOW, THEREFORE,

BE IT RESOLVED BY THE COUNCIL OF KANSAS CITY:

Section 1. The Council hereby consents to the above described actions and directs the City Attorney to file all appropriate documents, including without limitation a Joint Motion to Modify Judgment or other appropriate pleading as determined by the City Attorney, which pleading requests that the circuit court modify its July 17, 2009 Judgment to add the additional area for the Second Phase of the N.W. Prairie View Road Project to the District's boundaries and to add the Second Phase of the N.W. Prairie View Road Project as a transportation project of the District.
