ORDINANCE NO. 001610

 

Approving the preliminary plat of Waldberg Estates on approximately a 1.28 acre tract of land generally located at the southeast corner of East 109th Street and Holmes Road. (SD 0939)

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That the preliminary plat of Waldberg Estates on approximately a 1.28 acre tract of land generally located at the southeast corner of East 109th Street and Holmes Road, and more specifically described as follows:

 

All that part of the Southeast Quarter of the Northeast Quarter of Section 5, Township 47, Range 33, in the City of Kansas City, Jackson County, Missouri, being more particularly described as follows: Commencing at the northwest corner of the Southeast Quarter of the Northeast Quarter of said Section 5; thence South 86E15'54" East, along the north line of the Southeast Quarter of the Northeast Quarter of said Section 5, a distance of 60.20 feet; thence South 3E44'06" West, a distance of 25.00 feet to a point being on the easterly right of way line of Holmes Road, as now established and the southerly right of way line of 109th Street, as now established, said point also being the point of beginning; thence South 86E15'54" East, along said southerly right of way line of 109th Street, a distance of 232.00 feet; thence South 3E16'07" West, a distance of 268.29 feet; thence North 76E07'55" West, a distance of 98.50 feet; thence North 59E44'06" West, a distance of 146.09 feet to a point on said easterly right of way line of said Holmes Road, as now established; thence along said easterly right of way line of Holmes Road for the next three courses; thence North 3E16'07" East, a distance of 29.02 feet; thence North 86E15'54" West, a distance of 15.01 feet; thence North 3E16'07" East, a distance of 146.68 feet; thence North 48E30'07" East, a distance of 14.09 feet to the point of beginning, containing 1.282 acres, more or less. Except for that part previously dedicated for street purposes.

 

is hereby approved, subject to the following conditions:

 

1. That the developer cause the area to be platted and processed in accordance with Chapter 66, Code of Ordinances of Kansas City, Missouri, as amended, commonly known as the Subdivision Regulations.

 

2. That the developer submit a storm drainage study for the entire development to the City Engineers Office and that the developer make any necessary improvements as required by the City Engineer's Office.

 

3. That the developer submit plans for grading and siltation and erosion control to the City Engineers Office for approval prior to beginning any construction activities.

 


4. That the developer secure a land disturbance permit from the Department of Public Works prior to beginning any construction, grading, clearing or grubbing activities, if the disturbed area exceeds one acre.

 

5. That the developer dedicate additional right of way for Holmes Road as required by the Department of Public Works so as to provide a total of 50 feet of right of way as measured from the centerline of Holmes Road.

 

6. That the developer dedicate additional right of way for East 109th Street as required by the Department of Public Works so as to provide a total of 25 feet of right of way as measured from the centerline of East 109th Street.

 

7. That the developer construct the south half of East 109th Street to residential street standards as required by the Department of Public Works, including construction of curbs, gutters and sidewalks and installation of streetlights.

 

8. That the developer contribute $853.24 in lieu of parkland dedication for 3 single family lots (3 x 0.006 x $12,811.37) in satisfaction of Section 66-128 of the Subdivision Regulations.

 

9. That the developer enter into an agreement with the City as required by the Department of Public Works whereby the developer agrees to contribute $1,350.00 to the I-435/103rd Street Corridor Improvement Fund based on the rate of $450.00 per unit.

 

10. That a variance to the 3:1 lot depth to width ratio required by Section 66-124(c)(2) for Lots 2 and 3 as shown on the preliminary plat is hereby granted.

11. That the developer submit a street tree planting plan as part of the final plat with a copy to be submitted to the Department of City Development, secure the approval of the City Forester for street trees planted on right of way in front of residential lots, and plant the street trees in conformance with the plan approved by the City Forester. The plan shall include size, type, species and placement of trees.

 

A copy of the preliminary plat is on file in the office of the City Clerk under Document No. 001610, which is attached hereto and made a part hereof.

 

Section B. That the Council finds and declares that before taking any action on the proposed preliminary plat hereinabove, all public notices and hearings required by the Subdivision Regulations have been given and had.
