ORDINANCE NO. 061120

 

Approving the plat of The Plaza at Shoal Creek Second Plat, an addition in Kansas City, Clay County, Missouri; accepting and releasing various easements; authorizing the Director of City Development to execute and/or accept certain agreements; and authorizing the City Clerk to file this ordinance and attached documents.

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. That the plat of The Plaza at Shoal Creek Second Plat, a subdivision in Kansas City, Clay County, Missouri, a true and correct copy of which is attached hereto and incorporated herein by reference, is hereby approved, subject to the City's receipt and acceptance of all deeds of release and subordination agreements necessary to clear the title of any right of way, utility easements or other public property dedicated on the plat.

 

Section 2. That the plat granting and reserving unto Kansas City an easement and license or right to locate, construct, operate and maintain facilities including, but not limited to, water, gas, sewerage, telephone, cable TV, surface drainage, underground conduits, pad mounted transformers, service pedestals, any and all of them upon, over, under and along the strips of land outlined and designated on the plat by the words utility easement or U/E be and the same are hereby accepted and where other easements are outlined and designated on the plat for a particular purpose, be and the same are hereby accepted for the purpose as therein set out.

 

Section 3. That various easements in Kansas City, Clay County, executed by the following persons, and which appear of record as the instrument number, and respective book and page numbers are hereby accepted for the purposes stated thereof:

 

1. Temporary Easement by Zions Securities Corp - Instrument No. 2006039879 Bk. 5490 at Page 185.

 

2. Standard Sewer Easement by Zions Securities Corp - Instrument No. 2006039877 Bk. 5490 at Page 183.

 

3. Standard Sewer Easement by Zions Securities Corp - Instrument No. 2006039878 Bk. 5490 at Page 184.

 

4. Storm Drainage Easement by Zions Securities Corp - Instrument No. 2006039880 Bk. 5490 at Page 186.

 

5. Storm Drainage Easement by Zions Securities Corp - Instrument No. 2006039881 Bk. 5490 at Page 187.

 

6. Storm Drainage Easement by Zions Securities Corp - Instrument No. 2006039882 Bk. 5490 at Page 188.

 

7. Storm Drainage Easement by Zions Securities Corp - Instrument No. 2006039883 Bk. 5490 at Page 189.

 

Section 4. That all right, title and interest in the following recorded easements be and the same are hereby released to the respective owners, their successors or assigns, over that part of aforesaid easement under the following:

 

1.                  A tract of land situated in the Southwest Quarter of Section 11, Township 51 North, Range 32 West of the Fifth Principal Meridian, all in Kansas City, Clay County, Missouri, said tract of land being part of a Storm Water Drainage and Detention Easement recorded as instrument No. 2005005076, in Book 4897, at Page 148 being bounded and described as follows:

 

Commencing at the Northeast Corner of said Southwest Quarter; thence South 0026'41" West, along the East line of said Southwest Quarter, 1032.56 feet; thence North 8933'19" West, 658.13 feet to the True Point of Beginning of the tract of land to be herein described; thence South 5526'45" East, 64.87 feet; thence South 3540'21" West, 37.08 feet; thence South 8749'24" West, 53.34 feet; thence North 1719'02" East, 72.22 feet to the True Point of Beginning. Containing 3,018 square feet.

 

2. Partial Release of Grading Easement Recorded as Instrument No. R81903 in Book 4065 at Page 318 Property Description:

 

A tract of land situated in the Southwest Quarter of Section 11, Township 51 North, Range 32 West of the Fifth Principal Meridian, in Kansas City, Clay County, Missouri being bounded and described as follows: Beginning at the Northeast corner of Tract C (Detention Tract) THE VILLAGE FIRST PLAT, a subdivision of land in Kansas City, Clay County, Missouri, said corner also being on the Northwesterly right of way line of N. Flintlock Road, as now established; thence North 530408 West, along the North line of said Tract C, 10.94 feet; thence North 394558 East, 221.62 feet to a point on said Northwesterly right of way; thence South 365459 West, along said Northwesterly right of way line, 221.35 feet to the Point of Beginning. Containing 1,219 square feet more or less.

 

3. Partial Release of Permanent Slope Easement, Recorded as Instrument No. Q28571, in Book 3243, at Page 623, all that part of Lot 6 and 7 - THE PLAZA @ SHOAL CREEK, described as follows:

 

All that part of Lot 6 and 7, "THE PLAZA @ SHOAL CREEK", a subdivision of land in Kansas City, Clay County, Missouri, being bounded and described as follows: Commencing at the Northeast corner of the Southwest Quarter of Section 11, Township 51 North, Range 32 West of the Fifth Principal Meridian; thence South 027'34" West, along the East line of said Southwest Quarter, 187.24 feet; thence North 8932'26" West, 342.29 feet to the Point of Beginning of that tract of land to be described herein; thence South 7650'04" West, 79.94 feet; thence North 028'24" East, 20.09 feet; thence South 8836'48" East, 77.70 feet to the Point of Beginning.

 

4. Permanent Easement for Grading and Sloping, Document No. Q16066, Book 3202 at Page 107.

 

Section 5. That the Director of City Planning and Development is hereby authorized to execute Covenant to Maintain Storm Water Detention Facility Agreement, to be in a form substantially as that attached hereto as Exhibit A and incorporated herein by reference.

Section 6. That the Director of City Planning and Development is hereby authorized to execute and/or accept any agreements necessary to clear the title of any right of way, utility easements or other public property dedicated on the plat.

 

Section 7. That the City Clerk is hereby directed to file copies of this ordinance, together with the documents described herein and all other relevant documents, when the plat has been released for recording, together with the Covenant to Maintain Storm Water Detention Facility Agreement, in the Office of the Recorder of Deeds of Clay County, Missouri.

 


Section 8. That the Council finds that the City Plan Commission has duly endorsed its approval of this Ordinance hereon.
