Approving the preliminary plat of Hospital Hill Center on an approximately 2 acre tract of land in District R-0.5 (Residential Dash 0.5) generally located at the southwest corner of E. 23rd Street and Holmes Road creating three commercial lots. (SD 0172B)

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That the preliminary plat of Hospital Hill Center on an approximately 2 acre tract of land in District R-0.5 (Residential Dash 0.5) generally located at the southwest corner of E. 23rd Street and Holmes Road, and more specifically described as follows:

 

That part of Lot 1, Truman Medical Center, Block 1, and that part of the Northwest 1/4 of the Southeast 1/4 of Section 8, Township 49 North, Range 33 West, all in the City of Kansas City, Jackson County, Missouri, being more particularly described as follows: Beginning at the point of intersection of the south right of way line of 23rd street, as now established and the centerline of vacated Kenwood Avenue, as vacated by Ordinance No. 60410, passed December 18, 1986; thence South 2 degrees 23 minutes 36 seconds West, along said centerline, a distance of 84.18 feet; thence North 87 degrees 09 minutes 11 seconds West, a distance of 27.54 feet; thence South 59 degrees 38 minutes 00 seconds West, a distance of 75.28 feet; thence South 2 degrees 32 minutes 55 seconds West, a distance of 75.97 feet; thence South 52 degrees 44 minutes 43 seconds West, a distance of 15.31 feet; thence South 2 degrees 05 minutes 27 seconds West, a distance of 35.34 feet; thence South 47 degrees 42 minutes 19 seconds East, a distance of 15.47 feet; thence South 3 degrees 08 minutes 48 seconds West, a distance of 128.31 feet, to a point on the north right of way line of 24th street, as now established; thence South 87 degrees 12 minutes 10 seconds East, along said north right of way line, a distance of 226.51 feet, to a point on the west right of way line of Holmes Street, as now established; thence along a curve to the left, along said west right of way line, being tangent to the last described course, having a radius of 15.00 feet, a central angle of 90 degrees 20 minutes 59 seconds and an arc length of 23.65 feet; thence North 2 degrees 26 minutes 51 seconds East, along said west right of way line, a distance of 354.63 feet; thence along said west right of way line along a curve to the left, being tangent to the last described course, having a radius of 15.00 feet, a central angle of 89 degrees 38 minutes 32 seconds and an arc length of 23.47 feet, to a point on said south right of way line; thence North 87 degrees 11 minutes 41 seconds West, along said south right of way line, a distance of 134.59 feet, to the point of beginning. The above description contains 83,975 square feet or 1.928 acres, more or less.

 

is hereby approved, subject to the following conditions:

 

1.                  That the developer cause the area to be platted and processed in accordance with Chapter 88, Code of Ordinances of the City of Kansas City, Missouri, as amended, commonly known as the Development Regulations.

 

2.                  That the developer contact the Water Services Department to verify any need to relocate, abandon, extend or rehab the existing sanitary sewer main that runs under the building.

 

3.                  That the developer file a deed restriction that is approved by the City of Kansas City, Missouri, Building Official in form and content that satisfies the International Building Code prior to Mylar approval.

 

4.                  That the developer submit sufficient code analysis information to Development Services based upon "restrictive covenant" process underway to clarify compliance of existing buildings and structures within plan for redefining property lines. If applicable construction activities are deemed necessary, a detailed storm drainage analysis to confirm proposed engineering impact on drainage, will be. Drainage analysis will be in general compliance with adopted standards, and be submitted to Land Development Division, 5th Floor City Hall or with the building modification plans. Developer shall secure permits to construct any improvements as required by the Land Development Division prior to approval and issuance of any building or public permits to modify the site.

 

5.                  That the developer submit a letter to the Land Development Division from a licensed civil engineer, licensed architect, or licensed landscape architect, who is registered in the State of Missouri, identifying sidewalks, curbs, and gutters in disrepair as defined by Public Works Department in "OUT OF REPAIR CRITERIA FOR SIDEWALK, DRIVEWAY AND CURB Revised 4/8/09" and based upon compliance with Chapters 56 and 64, Code of Ordinances, for the sidewalks, curbs, and gutters along 23rd Street, Holmes Street, and 24th Street, where said letter shall identify the quantity and location of sidewalks, curbs, and gutters that need to be constructed, repaired, or reconstructed to remedy deficiencies and to remove existing approaches no longer needed by this project. The developer shall secure permits to repair or reconstruct the identified sidewalks, curbs, and gutters as necessary along all development street frontages as shown on the plan, as required by the Land Development Division and prior to issuance of any building certificate of occupancy permits including temporary certificate occupancy permits.

 

6.                  That the owner/developer secure a site disturbance permit from the Land Development Division prior to beginning any construction, grading, clearing, or grubbing activities, if the disturbed area equals one acre or more during the life of the construction activity.

 

7.                  That the owner/developer verify adequate capacity of the existing sewer system as required by the Land Development Division prior to issuance of a building permit to connect private system to the public sewer main (or structure) if applicable, and depending on adequacy of the receiving system, make other improvements as may be required. Also, if public sanitary sewer under existing buildings is required to be removed or abandoned (as recommended by Water Services Department), provide public sewer relocation and or abandonment plans to Land Development Division for SEFA review. Complete the Easement release or Partial release process related to the abandonment of any existing sanitary sewers. Release process is handled with SEIB review by LDD.

 

A copy of the preliminary plat is on file in the office of the City Clerk with this ordinance and is made a part hereof.
