SECOND COMMITTEE SUBSTITUTE FOR ORDINANCE NO. 921071, AS AMENDED

 

Amending Chapter 65, Revised Ordinances of Kansas City, Missouri, 1956, commonly known as the Zoning Ordinance, by adding a new section to be known as Section 65.010A2452, rezoning an area of approximately 40.9 acres generally located at the northeast corner of 68th Street and Holmes Road from Districts R-5 (High Apartments) and PD/C-2, R-5 (Planned Development/Local Retail Business, High Apartments) to District PD/C-2, R-5 (Planned Development/Local Retail Business, High Apartments), and approving a development plan for the same. (8889-PD-9)

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That Chapter 65, Revised Ordinances of Kansas City, Missouri, 1956, commonly known as the Zoning Ordinance, is hereby amended by enacting a new section to be known as Section 65.010A2452, rezoning an area of approximately 40.9 acres generally located at the northeast corner of 68th Street and Holmes Road from Districts R-5 (High Apartments) and PD/C-2, R-5 (Planned Development/Local Retail Business, High Apartments) to District PD/C-2, R-5 (Planned Development/Local Retail Business, High Apartments), said section to read as follows:

 

Section 65.010A2452. That an area legally described as:

 

Tract "A" and Tract "B", Baptist Medical Center, Second Plat a subdivision in Kansas City, Jackson County, Missouri; also all of Lots 1 through 12, both inclusive, and all of Lots 28 through 44, both inclusive, HOLMES HILL, a subdivision in Kansas City, Jackson County, Missouri; together with all of vacated Charlotte Street lying east and adjacent to said Lots 35 through 44, both inclusive; also all of vacated 67th Street lying south of and adjacent to said Tract "B".

 

is hereby rezoned from Districts R-5 (High Apartments) and PD/C-2, R-5 (Planned Development/Local Retail Business, High Apartments) to District PD/C-2, R-5 (Planned Development/Local Retail Business, High Apartments), all as shown outlined on a map marked Section 65.010A2452, which is attached hereto and made a part hereof, and which is hereby adopted as a part of an amendment to the zoning maps constituting a part of said chapter and as an amendment to Section 65.010 thereof.

 

Section B. That a development plan for the area legally described above is hereby approved, subject to the following conditions:

 

1. That the developer obtain permits for all existing signs for which there are no records of sign approval.

 

2. That the developer cause the area to be platted and processed in accordance with Chapter 31, Code of General

Ordinances of Kansas City, Missouri, as amended, commonly

known as the Subdivision Regulations.

 

3. That the developer dedicate 30 feet of right of way from centerline of 68th Street at the time of platting and

also enter into a deferral agreement to improve the north

side of 68th Street to collector street standards.

 

4. That the developer submit a storm drainage study to the City Engineer's Office including provision for any needed

improvements.

 

5. That the developer submit a landscape plan to and receive the approval of the Director of City Development.

 

6. That the developer dedicate additional right of way to insure 52 feet from centerline for Holmes Road and

construct a southbound left-turn lane on Holmes Road at

the new entrance into the parking lot; final construction

plans subject to approval of the Board of Parks and

Recreation.

 

7. That the developer enter into an agreement with the City for the installation of traffic signals at developer's

expense on Holmes Road at the parking lot entrance at a

time acceptable to City and developer.

 

A copy of said amendment to the development plan is on file in the office of the City Clerk under Document No. 921071, which is attached hereto and made a part hereof.

 

Section C. That the Council finds and declares that before taking any action on the proposed amendment hereinabove, all public notices and hearings required by the Zoning Ordinance have been given and had.
