ORDINANCE NO. 971629
Approving a Community Unit Project on an
approximately 5.61 acre tract of land generally located west of N. Broadway
Avenue, on both sides of N.W. 71st Terrace. (12057-CUP-1)
BE IT ORDAINED BY THE COUNCIL OF
KANSAS CITY:
Section A. That a Community Unit
Project on an approximately 5.61 acre tract of land generally located west of
N. Broadway Avenue, on both sides of N.W. 71st Terrace, and more specifically
described as follows:
A tract of land in the
Northeast Quarter of Section 22, Township 51, Range 33, in the City of Kansas
City, Clay County, Missouri, being bounded and described as follows:
Commencing at the northeast corner of said Northeast Quarter; thence South
004'50" West, along the east line of said Northeast Quarter, 329.63 feet;
thence North 8955'10" West, 180.00 feet to the true point of beginning of
the tract to be herein described, said point being also a point on the
Gladstone-Kansas City city limit line; thence South 004'50" West, along
said Gladstone-Kansas City city limit line, 329.96 feet to a point on the north
line of Hamilton Heights West, a subdivision in the City of Kansas City, Clay
County, Missouri; thence North 8947'10" West, along said north line,
740.00 feet to the easterly right of way line of U.S. Highway 169, as now
established; thence North 004'50" East along said easterly right of way
line, 329.77 feet to a point on the south line of North Park Place, a
subdivision in the City of Kansas City, Clay County, Missouri; thence South
8948'01" East (P - South 8921'23" East) along said south line and
its easterly prolongation 740.00 feet to the true point of beginning.
Containing 5.61 acres, more or less.
is hereby approved, subject to the following
conditions:
1. That
the developer cause the area to be platted and processed in accordance with
Chapter 66, Code of Ordinances of the City of Kansas City, Missouri, as
amended, commonly known as the Subdivision Regulations.
2. That
the developer submit a storm drainage study to the City Engineers Office for
approval and that the developer make any improvements as required by the City
Engineers Office.
3. That
the developer submit plans for grading and siltation and erosion control to the
City Engineer's Office for approval prior to beginning any construction
activities.
4. That
the developer secure a land disturbance permit from the Missouri Department of
Natural Resources.
5. That
the developer construct N.W. 71st Terrace to residential street standards as
required by the Department of Public Works.
6. That
the developer construct N. Pennsylvania Avenue to residential street standards
as required by the Department of Public Works.
7. That
the developer extend sanitary sewers as required by the Department of Public
Works.
8. That
the developer relocate and extend water main as required by the Water Services
Department.
9. That
the developer construct all-weather roads and provide for fire protection as
required by the Fire Department prior to construction beyond footings and
foundations.
10. That
the developer submit a street tree planting plan as part of the final plat and
secure the approval of the City Forester for street trees planted on right of
way in front of residential lots, with a copy to be submitted to the Department
of City Development. The plan shall include size, type, species and placement
of trees.
11. That
the developer submit a street name sign plan to the Street Naming Committee for
approval prior to submittal of the first final plat.
12. That
the developer contribution $5,987.21 in lieu of parkland dedication for 31
duplex units in satisfaction of Section 66-128 of the Subdivision Regulations.
13. That
the developer receive the approval of the Department of City Development for a
certificate of survey prior to the sale of individual lots or units.
14. That
the developer petition for the vacation of N.W. 71st Terrace as required by the
Department of Public Works.
15. That
the developer submit covenants, conditions and restrictions to the Law
Department for approval.
A copy of said Community Unit Project plan is on
file in the office of the City Clerk under Document No. 971629, which is
attached hereto and made a part hereof.
Section B. That the Council finds
and declares that before taking any action on the proposed Community Unit
Project hereinabove, all public notices and hearings required by the Zoning
Ordinance have been given and had.
