ORDINANCE NO. 050353

 

Approving the preliminary plat of Drakes Crossing on a 28.33 acre tract of land generally located in the southwest quadrant of N.W. 64th Street and Waukomis Drive. (SD 1150A)

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That the preliminary plat of Drakes Crossing on a 28.33 acre tract of land generally located in the southwest quadrant of N.W. 64th Street and Waukomis Drive, and more specifically described as follows:

 

A tract of land in the Northwest Quarter of Section 28, Township 51 North, Range 33 West of the 5th Principal Meridian all in the City of Kansas City, Platte County, Missouri and being more particularly described as follows: Commencing at an Iron Bar found at the Northeast corner of said Northwest Quarter; thence North 8846'37" West, along the North line of said Northwest Quarter, a distance of 703.00 feet to the POINT OF BEGINNING, said point being on the West line (extended) of tract recorded in Book 920 at Page 851 in the office of the Recorder of Deeds, Platte County, Missouri; thence South 0013'36" West, along said West line (extended), a distance of 396.00 feet to the Southwest corner of said tract; thence South 8846'37" East, along the South line of said tract, a distance of 703.00 feet to the Southeast corner of said tract and East line of said Northwest Quarter; thence South 0013'36" West, along said East line, a distance of 761.37 feet to the North line of the South 88.74 acres of said Northwest Quarter, as described in document recorded in Book 181 at Page 350 in the Office of said Recorder of Deeds, said line also being the North line of Karen Estates (extended); thence North 8929'55" West, along said North line, a distance of 1075.47 feet to Northeast corner of Lot 15 of said Karen Estates; thence South 1118'24" West, along the East line of said Lot 15, a distance of 160.56 feet to the Southeast corner of said Lot 15, said point being on the Northerly right of way of Karen Road as now exists; thence Northerly and Westerly along a non-tangent curve to the left, said curve having an Initial Tangent Bearing of N7839'15"W, Radius of 150.00 feet, Included Angle of 1056'38" and Arc Length of 28.65 feet to a point of tangency; thence North 8935'53" West, along said Northerly right of way, a distance of 61.02 feet to the Southwest corner of said Lot 15; thence North 0021'16" East, along the West line of said Lot 15, a distance of 155.14 feet to the Northwest corner of said Lot 15 and North line of said South 88.74 acres; thence North 8929'55" West, along said North line a distance of 92.62 feet to the West line of the East one-half of said Northwest Quarter; thence North 0019'32" East, along said West line, a distance of 798.91 feet to the South line (extended) of tract recorded in Book 711 at Page 528 in the office of said Recorder of Deeds; thence North 8852'26" West, along said South line (extended) a distance of 11.30 feet to the Southeast corner of said tract; thence North 0019'32" East, along the East line of said tract, a distance of 374.66 feet to the North line of said Northwest Quarter, said point being 11.30 feet West of the Northeast corner of the Northwest Quarter of said Northwest Quarter, as established by the final plat of Sherwood Forest, a subdivision of land being partially vacated by Ordinance of Kansas City, Missouri No. 50884 and filed for record in Book 575 at Page 526, in the Office of said Recorder of Deeds; thence South 8846'37" East, along the North line of said Northwest Quarter, a distance of 594.55 feet to the POINT OF BEGINNING and containing 1,194,808.58 Square Feet or 28.33 acres, more or less.

 

is hereby approved, subject to the following conditions:

 

1. That the developer cause the area to be platted and processed in accordance with Chapter 66, Code of Ordinances of Kansas City, Missouri, commonly known as the Subdivision Regulations.

 

2. That the developer submit a macro/micro storm drainage study to the City Engineers Office for approval for the entire development, and that the developer make any improvements as required by the City Engineers Office.

 

3. That the developer submit plans for grading and siltation and erosion control to the City Engineers Office for approval prior to the commencement of any construction activities.

 

4. That the developer provide a storm water conveyance system to serve all proposed lots within the development and determine adequacy as required by the Department of Public Works.

 

5. That the developer secure a site disturbance permit from the Department of Public Works prior to beginning any construction, grading, clearing, or grubbing activities, if the disturbed area exceeds one acre.

 

6. That the developer contribute $13,932.31in lieu of parkland dedication for 63 units (63 units 3.7 .006 $9,961.61 (year 2005) = $13,932.31) in satisfaction of Section 66-128 of the Subdivision Regulations.

 

7. That the developer install hard surface roads and provide for fire protection as required by the Fire Department prior to construction beyond foundations.

 

8. That the developer extend water mains as required by the Water Services Department.

 

9. That the developer extend sanitary sewers to ensure individual service is provided to all proposed lots and determine adequacy as required by the Department of Public Works.

 

10. That the developer secure approval of the Street Naming Committee for all street names prior to submittal of the first final plat, and include a copy of the approved plan as part of any final plat application to the City Development Department.

 

11. That the developer submit a street tree planting plan as part of the final plat, secure the approval of the City Forester for street trees planted on right-of-way in front of residential lots (with a copy to be submitted to the City Development Department staff), and agree to plant in conformance with the plan approved by the City Forester. The plan shall include size, type, species, and placement of trees.

 

12. That the developer dedicate additional right of way for a collector street as required by the Department of Public Works so as to provide a minimum of 30 feet of right of way as measured from the centerline of N.W. 64th Street.

 

13. That the developer improve the southern one-half of N.W. 64th Street to collector street standards as required by the Department of Public Works, including curbs, gutters, storm sewers, sidewalks, streetlights, existing roadway section transitions to meet vertical and horizontal alignment standards, and relocation of utilities.

 

14. That adequate sight distance be provided for street connections to N.W. 64th Street and N.W. Karen Road as required by the Department of Public Works.

 

15. That the developer design and construct all interior streets to City standards as required by the Department of Public Works, including curb, gutter, storm sewers, streetlights, and sidewalks.

 

16. That the developer obtain the grading consents, and all grading, temporary construction and drainage/sewer easements from the abutting property owner prior to submitting any public improvements.

 

17. That the developer shall subordinate to the City all private interest in the area of any right-of-way dedication as required by the Department of Public Works and that the developer shall be responsible for all costs associated with subordination activities.

 

18. That temporary off-site cul-de-sacs be constructed as required by the Department of Public Works.

 

19. That the developer secure permits to construct or reconstruct existing sidewalks, curb, gutter, storm sewers, and streetlights as necessary along all development street frontages, as required by the Department of Public Works, prior to recording the plat.

 

20. That any relocated streetlights be integrated into existing street light system as required by the City Engineers Office.

 

21. That access restrictions be provided to prohibit access to N.W. 64th Street from Tract A and Lots 62 and that the restriction be placed on the final plat.

 

22.  That the developer submit covenants, conditions and restrictions to the Law Department for approval for the maintenance of private open space and tracts, including limitation of the height of any landscaping in tracts within right of way and enter into a covenant agreement for the maintenance of any stormwater detention area tracts.

 

A copy of the preliminary plat is on file in the office of the City Clerk with this ordinance, which is attached hereto and made a part hereof.

 

Section B. That the Council finds and declares that before taking any action on the proposed preliminary plat hereinabove, all public notices and hearings required by the Subdivision Regulations have been given and had.
