WHEREAS, the primary election will be held throughout the City on August 4, 1998; and

 

WHEREAS, the provisions of RSMo Sections 644.032 - 644.033 allow the Council to impose a sales tax in an amount not to exceed one-half of one percent (1/2%) for the purpose of providing funding for local parks; NOW THEREFORE

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. That an election is hereby called for submitting to the voters of Kansas City the question of authorizing the Council to impose, pursuant to RSMo Sections 644.032-644.033, a sales tax of one-half of one percent (1/2%) on all retail sales made within the City which are subject to taxation under the provisions of RSMo Sections 144.010-144.525, for the purpose of providing funding for local parks. Such question shall be submitted to the voters at the primary election to be held on August 4, 1998.

 

Section 2. That upon passage of this ordinance the City Clerk shall immediately deliver certified copies of this ordinance and notice of election to the Board of Election Commissioners of Kansas City, Missouri, to the Board of Election Commissioners of Clay County, Missouri, to the Board of Election Commissioners of Platte County, Missouri, and to the Clerk of the County Commission of Cass County, Missouri, which shall be the authority of said respective election authorities of the City to submit the question to the voters of Kansas City as herein provided and to give public notice thereof as provided by law.

 

Section 3. The notice of election shall read as follows:

CITY OF KANSAS CITY, MISSOURI

 

Notice is hereby given that the City of Kansas City has called an election to be held in said City on Tuesday, August 4, 1998, between the hours of 6:00 a.m. and 7:00 p.m., D.S.T., at which election all qualified voters residing within the City of Kansas City, Missouri will be given the opportunity to vote.

 

The official ballot will be in substantially the following form:

Shall the municipality of Kansas City impose a sales tax of one-half of one percent (1/2%) for a period of eighteen (18) months beginning April 1, 1999 and ending September 30, 2000, for the purpose of providing funding for local parks for the municipality?

 

The sales tax shall be used for the sole purpose of funding restoration

of the Liberty Memorial, expansion of the Liberty Memorial

museum and its educational exhibits and an endowment for future

maintenance of the Memorial and the Memorial museum.

Section 4. If a majority of the qualified voters voting at said election shall vote in favor of the approval of the question, Article VII, entitled Sales Tax, of Chapter 68 of the Code of Ordinances, entitled Taxation, shall be amended by adding one new Section 68-473, to become effective immediately upon certification of the election results by the election authorities, said section to read as follows:

 

DIVISION 3. LOCAL PARKS

 

Section 68-473. Local parks sales tax.

 

(a) Imposition of tax. Pursuant to the authority granted by and subject to the provisions of RSMo Sections 644.032 - 644.033, a tax of the City for local park purposes is hereby imposed upon all sellers for the privilege of engaging in the business of selling tangible personal property or rendering taxable services at retail to the extent and in the manner provided in Sections 144.010-144.510, RSMo, and the rules and regulations of the director of revenue issued pursuant thereto. The rate of the tax shall be one-half of one percent (1/2%) on the receipts from the sale at retail of all tangible personal property or taxable services at retail within Kansas City, Missouri, if such property and such services are subject to taxation by the State of Missouri under the provisions of RSMo Sections 144.010- 144.510.

 

(b) Effective date. The tax imposed by this section shall become effective April 1, 1999, for a period of eighteen (18) months and shall apply to all sales made on or after April 1, 1999, through September 30, 2000, and shall be collected and enforced as provided in RSMo Sections 644.032- 644.033.

 

Section 5. Within ten (10) days after the approval of the question by the qualified voters of Kansas City, Missouri, as certified by the election authorities, the City Clerk shall forward to the Director of Revenue of the State of Missouri, by United States registered or certified mail, a certified copy of this ordinance together with certification of the election returns and accompanied by a map of the City clearly showing boundaries thereof.

 

Section 6. This ordinance, providing for the submission of a question authorizing a City sales tax to the people of Kansas City, Missouri, is hereby recognized to be an emergency measure within the meaning of Section 15, Article II, of the Charter of said City, and as such shall become effective immediately upon its passage.
