ORDINANCE NO. 090794

 

Declaring an area of about 30 parcels generally bounded by 24th Terrace on the north, 25th Street on the south, Walrond Avenue on the east and Bellefontaine Avenue on the west, as a blighted and insanitary area in need of redevelopment and rehabilitation pursuant to the Missouri Land Clearance for Redevelopment Authority law and approving the Habitat for Humanity Scattered Site Urban Renewal Plan. (390-S-267 a-e)

 

WHEREAS, the area bounded 24th Terrace on the north, 25th Street on the south, Walrond Avenue on the east and Bellefontaine Avenue on the west (1456 and 1457 E. 66th Terrace; 2500 and 2529 Drury Avenue; 4623, 4627 and 4655 E. 37th Terrace; 2945 and 6633 Flora Avenue; 3320 and 3322 Tracy Avenue; and 2940 Woodland Avenue), is (1) blighted by reason of the predominance of defective or inadequate street layout, insanitary or unsafe conditions, deterioration of site improvements, improper subdivision or obsolete platting, or the existence of conditions which endanger life or property by fire and other causes, or any combination of such factors, retards the provision of housing accommodations or constitutes an economic or social liability or a menace to the public health, safety, morals, or welfare in its present condition or (2) insanitary by reason of a predominance of buildings and improvements which, by reason of dilapidation, deterioration, age or obsolescence, inadequate provision for ventilation, light, air sanitation or open spaces, high density of population and overcrowding of buildings, overcrowding of land, or the existence of conditions which endanger life or property by fire and other causes, or any combination of such factors, is conducive to ill health, transmission of disease, infant mortality, juvenile delinquency and crime or constitutes an economic or social liability and is detrimental to the public health, safety, morals, or welfare; and

 

WHEREAS, on July 29, 2009, the Land Clearance for Redevelopment Authority of Kansas City, Missouri, adopted a resolution recommending that the area be declared blighted or insanitary and recommending approval of the Habitat for Humanity Scattered Site Urban Renewal Plan (Urban Renewal Plan) for the area; and

 

WHEREAS, on August 18, 2009, the City Plan Commission reviewed this matter and recommended (1) approval of the designation of the area as blighted or insanitary area and (2) approval of the Urban Renewal Plan; NOW, THEREFORE,

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. That the Council finds that the proposed urban renewal area identified as the Habitat for Humanity Scattered Site Urban Renewal Area generally bounded by 24th Terrace on the north, 25th Street on the south, Walrond Avenue on the east and Bellefontaine Avenue on the west (1456 and 1457 E. 66th Terrace; 2500 and 2529 Drury Avenue; 4623, 4627 and 4655 E. 37th Terrace; 2945 and 6633 Flora Avenue; 3320 and 3322 Tracy Avenue; and 2940 Woodland Avenue), legally described as follows:

 

1.            1456 East 66th Terrace: Lot 6, Broadmoor, Kansas City, Jackson County, Missouri.

 

2.            1457 East 66th Terrace: West 45 feet of east 55 feet of Lot 9, Paseo Highlands, Kansas City, Jackson County, Missouri.

 

3.            2437 Bellefontaine: Lafayette Place, all of Lot 1 and west 1/2 of vacant alley east and adjacent and north 73.4 feet of Lot 7 and east 1/2 of vacant alley west and adjacent and 5 feet strip east and adjacent said north 73.4 feet of Lot 7, Block 8, Kansas City, Jackson County, Missouri.

 

4.            2439 Bellefontaine: Vacant lot Lafayette Place, all of Lot 2 except east 1 foot lying between westerly prolongation of north and south line of north 40 feet of south 200 feet of Lot 7, Block 8 also west 1/2 vacant alley lying east of and adjacent, Kansas City, Jackson County, Missouri.

 

5.            2441 Bellefontaine: Lafayette Place, west 100 feet of Lot 3, Block 8, Kansas City, Jackson County, Missouri.

 

6.            Lafayette Place, part of Lot 3, Block 8 daf west 24 feet of east 25 feet of north 19.4 feet and east 25 feet of south 30.6 feet and west 1/2 vacant alley east and adjacent said 30.6 feet, Kansas City, Jackson County, Missouri.

 

7.            2448 Walrond: Lafayette Place, part of Lots 2, 3 and 7, north 40 feet of south 200 feet of Lot 7 and west 5 feet vacant Walrond Avenue lying east of and adjacent and all vacant alley lying west of and adjacent also east 1 foot of Lots 2 and 3 lying between westerly prolongation of north and south lines said north 40 feet of south 200 feet, Kansas City, Jackson County, Missouri.

 

8.            2450 Walrond: North 40 feet of south 160 feet of Lot 7, Block 8 also east 1/2 vacant alley west of and adjacent also 5 feet vacant Walrond Avenue adjacent Lafayette Place, Kansas City, Jackson County, Missouri.

 

9.            2454 Walrond: Vacant lot Lafayette Place, north 40 feet of south 120 feet of Lot 7, Block 8 also east 1/2 vacant alley west of and adjacent also 5 feet vacant Walrond Avenue adjacent, Kansas City, Jackson County, Missouri.

 

10.        2455 Bellefontaine: Vacant lot Lafayette Place, Lot 4, Block 8, also north 25 feet of Lot 5, Block 8, also west 1/2 vacant alley lying easterly and adjacent said lots, Kansas City, Jackson County, Missouri.

 

11.        North 40 feet of south 80 feet of Lot 7 also east 1/2 vacant alley west of and adjacent, also 5 feet vacant Walrond Avenue adjacent Lafayette Place, Kansas City, Jackson County, Missouri.

 

12.        2457 Bellefontaine: South 25 feet of Lot5, Block 8, also west 1/2 vacant alley east of and adjacent Lafayette Place, Kansas City, Jackson County, Missouri.

 

13.        2459 Bellefontaine: Vacant lot Lafayette Place, Lot 6, Block 8, also west 1/2 vacant alley east of and adjacent, Kansas City, Jackson County, Missouri.

is a blighted or insanitary area in need of redevelopment or in need of rehabilitation and is appropriate for an urban renewal project by the Land Clearance for Redevelopment Authority of Kansas City, Missouri, pursuant to Chapter 99, RSMo.

 

Section 2. That the Council finds that the Urban Renewal Plan is feasible and in conformity with the general plan for the development of the community as a whole.

 

Section 3. That the Habitat for Human Scattered Site Urban Renewal Plan, a copy of which is on file in the office of the City Clerk with this ordinance and is hereby approved.
