SECOND COMMITTEE SUBSTITUTE FOR ORDINANCE NO. 090219

 

Amending Second Committee Substitute for Ordinance No. 090127, passed February 19, 2009, by repealing and reenacting Sections 1 and 3 thereof for the purpose of revising the list of projects to be considered for any future funding that might be available to the City through the American Recovery and Reinvestment Act of 2009 under the Surface Transportation Program, and establishing the Citys policy on reallocating funds for projects that receive federal funding.

 

WHEREAS, the City of Kansas City, Missouri is part of the Mid-America Regional Council (MARC) metropolitan planning organization; and  

 

WHEREAS, the American Recovery and Reinvestment funds related to the Surface Transportation Program will flow to MARC and be distributed through their existing process; and

 

WHEREAS, MARC has requested local governments and agencies submit potential projects in priority order to be considered for funding through the American Recovery and Reinvestment Act of 2009 (ARRA); and

 

WHEREAS, the City did so and MARC has identified the projects that will receive ARRA funding; and

 

WHEREAS, the City wishes to update its list for the purpose of adding certain curb and sidewalk projects that the City would like considered for any additional ARRA funding that may become available for allocation to projects within the City at a future date; and

WHEREAS, the Council wishes to establish a general policy for how funds that become available due to ARRA funding will be reallocated; NOW, THEREFORE,  

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That Second Committee Substitute for Ordinance No. 090127 is hereby amended by repealing Section 1 thereof, and enacting a new section of like designation and subject matter, to wit:

 

Section 1. That the City Manager is directed to submit the following surface transportation projects to MARC for consideration of American Recovery and Reinvestment Act of 2009 Surface Transportation Funds in this prioritized order:

Red Bridge Road Improvements, from Holmes to Blue River Road and Bridge Replacement over the Blue River

        Troost Bridge Replacement and Area Improvement over Brush Creek

Forrester Viaduct

N.E. 72nd and N. Brighton

Swope Park Flyover Bridge

Section B.  That Second Committee Substitute for Ordinance No. 090127 is hereby amended by repealing Section 3 thereof, and enacting a new section of like designation and subject matter, to wit:

 

Section 3. That if the use of funds made available under ARRA shall make existing or planned funds, including local, state or federal funds, no longer needed on a project, such unnecessary funds shall be returned to the originating City fund for reallocation to a similar category of project. Priority will be given to projects that can be underway within ninety (90) days.  

 

Section C. That the City Manager is hereby directed to advise the Council of any such funds that can be reallocated.
