Approving an amendment to a previously approved development plan in District GP-3 on about 32 acres generally located at the southwest corner of Tiffany Springs Road and proposed N. Ambassador Drive for a 180,000 square foot commercial development. (6029-GP-23)

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

  Section A. That an amendment to a previously approved development plan in District GP-3 (Regional Business) on about 32 acres generally located at the southwest corner of Tiffany Springs Road and proposed N. Ambassador Drive, and more specifically described as follows:

A tract of land in the Southwest Quarter of Section 6, Township 51 North, Range 33 West, Kansas City, Platte County, Missouri, being described as follows: Commencing at the southeast corner of the Southwest Quarter of said Section 6; thence North 00 degrees 23 minutes 18 seconds East, along the East line of said Southwest Quarter, 1451.02 feet; thence North 88 degrees 31 minutes 49 seconds West, 100.52 feet to the true point of beginning of the tract to be herein described; thence southerly along a curve to the right, having an initial tangent bearing of South 01 degrees 28 minutes 11 seconds West, a radius of 36.00 feet, a central angle of 90 degrees 00 minutes 59 seconds, an arc distance of 56.56 feet; thence North 88 degrees 30 minutes 50 seconds West, 170.59 feet; thence northerly, along a curve to the right, tangent to the last described course, having a radius of 454.00 feet, a central angle of 32 degrees 37 minutes 08 seconds, an arc distance of 258.47 feet; thence North 55 degrees 53 minutes 42 seconds West, 1234.06 feet; thence northerly, along a curve to the right, tangent with the last described course, having a radius of 454.00 feet, a central angle of 55 degrees 58 minutes 29 seconds, an arc distance of 443.53 feet; thence northerly, along a curve to the right, having a common tangent with the last described course, a radius of 36.00 feet, a central angle of 90 degrees 58 minutes 34 seconds, an arc distance of 57.16 feet, to a point on the south right-of-way line of Northwest Tiffany Springs Road, said point being 54.00 feet, South of the north line of said Southwest Quarter; thence South 88 degrees 56 minutes 40 seconds East, parallel with and 54.00 feet south of said north line, 135.72 feet; thence North 88 degrees 55 minutes 54 seconds East, along said south right-of-way line, 161.89 feet to a point 48.00 feet south of said north line; thence South 88 degrees 56 minutes 40 seconds East, along said south line, 951.57 feet to a point 48.00 feet south of said north line; thence South 85 degrees 07 minutes 48 seconds East along said north line, 180.40 feet to a point 60.00 feet south of said north line; thence South 88 degrees 56 minutes 40 seconds East, along said south line; 205.36 feet to a point 60.00 feet south of said north line; thence South 43 degrees 44 minutes 58 seconds East, along said south line 42.89 feet to a point on the west right-of-way line of North Ambassador Drive, said point being 79.00 feet west of the east line of said Southwest Quarter; thence South 00 degrees 23 minutes 18 seconds West, along said west line, 581.19 feet; thence South 01 degrees 28 minutes 11 seconds West, along said west right-of-way line, 129.59 feet to a point 81.45 feet west of said east line; thence South 05 degrees 26 minutes 27 seconds West, along said west right-of-way line, 173.27 feet to a point 96.71 feet West of said west line; thence South 01 degrees 28 minutes 11 seconds West, along said west line, 201.50 feet to the true point of beginning. Containing 31.30 acres, more or less.

is hereby approved, subject to the following conditions:

1. That the developer cause the area to be platted and processed in accordance with Chapter 66, Code of Ordinances of the City of Kansas City, Missouri, commonly known as the Subdivision Regulations.

 

2. That the developer submit an update to the previously accepted macro storm drainage study for the overall development to address the development amendments along with a detailed micro study for review and acceptance prior to clearance of the final plat and make necessary improvements as required by Development Services.

 

3. That the developer dedicate additional right of way for N. Ambassador Drive as required by Development Services so as to provide the right of way as shown on the approved development plan.

 

4. That the developer obtain the grading consents, and all grading, temporary construction and drainage/sewer easements from the abutting property owner prior to submitting any public improvements.

 

5. That the developer subordinate to the City all private interest in the area of any right-of-way dedication, as required by Development Services, and that the developer be responsible for all costs associated with subordination activities now and in the future.

 

6. That the developer submit plans for grading, siltation, and erosion control to Development Services for approval and permitting prior to beginning any construction activities.

 

7. That the developer secure a site disturbance permit from Development Services prior to beginning any construction, grading, clearing, or grubbing activities, if the disturbed area equals one acre or more, prior to recording the plat.

 

8. That the developer secure permits to extend sanitary sewers to ensure individual service is provided to all proposed lots and determine adequacy as required by Development Services, prior to recording the plat.

 

9. That the developer secure permits to provide a storm water conveyance system to serve all proposed lots within the development and determine adequacy as required by Development Services, prior to recording the plat.

 

10. That the developer extend water mains as required by the Water Services Department.

 

11. That the developer grant a Surface Drainage Easement to the City as required by Development Services, on the final plat.

 

12. That the developer grant a BMP Easement to the City, as required by Development Services, on the final plat.

 

13. That the developer grant cross access and public access easements, as required by Development Services, on the final plat.

 

14. That the developer enter into a covenant agreement for the maintenance of any stormwater detention area tracts as required by Development Services, prior to recording the plat.

 

15. That the developer grant a Noise and Aviation Easement to the City as required by Development Services.

 

16. That the developer construct no structure which exceeds the KCIA height zoning restrictions.

 

17. That the developer submit a landscape and architectural final plan to the City Plan Commission for approval which includes detailed information on landscaping, lighting, architectural features and design as per the approved design guidelines.

 

18. That the developer construct a southbound approach of the east drive (east signal) at N. Skyview Avenue intersection with two outbound lanes and two inbound lanes separated by a raised median of minimum 6 foot width and provide a minimum of 245 feet, as measured back of curb to back of curb, throat length with no driveway connections as required by the Public Works Department.

 

19. That the developer construct a southbound approach of the west drive at N. Skyview Avenue intersection with two outbound lanes and one inbound lane separated by a raised median of minimum 6 foot width and provide a minimum of 250 feet throat length with no driveway connections as required by the Public Works Department.

 

20. That the developer enter into a cooperative agreement to pay 25 percent of the cost of installation of a traffic signal at the intersection of N. Skyview Avenue with N. Tiffany Springs Road as required by the Public Works Department.

 

21. That the developer construct a southbound right turn lane with 200 feet storage with appropriate tapers along N. Ambassador Drive at Driveway A as shown on the development plan, as required by Development Services.

 

22. That the developer construct a southbound right turn lane with 200 feet storage with appropriate tapers along N. Ambassador Drive at Driveway B as shown on the development plan, as required by Development Services.

 

23. That the developer apply to the Board of Zoning Adjustment for any and all necessary variances required by this plan.

A copy of said amendment is on file in the office of the City Clerk with this ordinance and is made a part hereof.

Section B. That the Council finds and declares that before taking any action on the proposed amendment hereinabove, all public notices and hearings required by the Zoning Ordinance have been given and had.
