COMMITTEE SUBSTITUTE FOR ORDINANCE NO. 200725

 

Reappropriating $627,623.00 from the Jackson County COVID19 Fund into the designated accounts; authorizing an agreement with Kansas City Public Schools to offer virtual learning sites at community centers; authorizing an agreement with the Crossroads Charter School to offer virtual learning sites at community centers; authorizing a contract with the Boys and Girls Clubs of Greater Kansas City to provide virtual education services; authorizing a contract with Campfire Heartland to provide virtual education services; directing the expenditure of funds by December 30, 2020; authorizing the reimbursement of Kansas City Board of Elections expenditures made necessary by COVID-19; and recognizing this ordinance as having an accelerated effective date.

WHEREAS, on March 12, 2020, Mayor Quinton Lucas issued a State of Emergency allowing the City of Kansas City to take measures to reduce the possibility of exposure to COVID-19 and promote the health and safety of Kansas City residents; and

 

WHEREAS, the Coronavirus Aid, Relief, and Economic Security Act (the “CARES Act”), which was signed into law by the President of the United States on March 27, 2020, provides for a Coronavirus Relief Fund that appropriates $150 billion to states and certain units of local government for reimbursement of certain COVID-19 related expenditures; and

 

WHEREAS, the City of Kansas City wishes to protect public life, health, safety, and property by limiting the development, contraction, and spread of COVID-19 and aims to contribute to an equitable city where all residents, regardless of race, class, gender or sexual orientation are connected to the City’s resources; and

 

WHEREAS, Jackson County Ordinance #5372 was passed by the Jackson County Legislature on June 29, 2020, appropriating $16,082,946.00 from the undesignated fund balance of the Jackson County 2020 CARES Act Fund to provide funds to Kansas City, Missouri to meet unanticipated costs necessary in connection to COVID-19 and authorizing the Jackson County Executive to execute Intergovernmental Agreements with the City of Kansas City, Missouri, at a cost to the County not to exceed $16,082,946.00; and

 

WHEREAS, the City of Kansas City wishes to ensure the efficient disbursement of CARES Act funds for eligible purposes to have the greatest impact on the safety and economic well-being of Kansas City residents; and

 

WHEREAS, in response to the current state of emergency due to the COVID pandemic and the local school district’s planning to keep students safe there is a community need to provide virtual learning sites. The COVID pandemic presents challenges for families that need to continue to work and need affordable options with the school year starting. Providing youth programming and community support services is at the core of KC Parks’ mission. KC Parks is compelled to respond to ensure affordable options are available for all families and youth, especially those most vulnerable, through these virtual learning sites in partnership with Boys and Girls Clubs of Greater Kansas City and Campfire Heartland; and

 

WHEREAS, the Board of Parks and Recreation Commissioners approved Cooperative Agreements with Kansas City Missouri Public Schools, Boys & Girls Clubs of Greater Kansas City, and Campfire Heartland for virtual learning sites pursuant to respective Resolution No. 31475-31479 effective August 25, 2020; NOW, THEREFORE,

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. That the sum of $627,623.00 is hereby reduced from the following account in the Jackson County COVID19 Fund:

 

21-2584-125003-621100-G12C19CRF-C Reserve for Unanticipated

Costs $627,623.00

 

Section 2. That the sum of $627,623.00 is hereby appropriated from the Unappropriated Fund Balance of the Jackson County COVID19 Fund to the following account:

 

21-2584-705500-619080-G70C19CRF-B CARES Act Funding $485,000.00

21-2584-705500-621100-G70C19CRF-C CARES Act Funding 6,000.00

21-2584-105500-619080-G10C19CRF-B CARES Act Funding 136,623.00

TOTAL $627,623.00

 

Section 3. That the Director of Parks and Recreation is hereby designated requisitioning authority for Account No. 21-2584-705500.

 

Section 4. That the Director of Parks and Recreation is authorized to execute an agreement with the Kansas City Public Schools to provide virtual learning sites at the City’s community centers.

 

Section 5. That the Director of Parks and Recreation is authorized to execute an agreement with the Crossroads Charter School to provide virtual learning sites at the City’s community centers.

 

Section 6. That the Director of Parks and Recreation is authorized to execute a contract with the Boys and Girls Clubs of Greater Kansas City in the amount of $144,000.00 to provide virtual education services at community centers.

 

Section 7. That the Director of Parks and Recreation is authorized to execute a contract with Campfire Heartland in the amount of $336,000.00 to provide virtual education services at community centers.

 

Section 8. That the Director of Parks and Recreation shall expend all funds appropriated herein by December 30, 2020.

 

Section 9. That the City Manager is authorized to reimburse $136,623.00 paid for the Kansas City Board of Election’s expenses to establish additional absentee ballot locations that were made necessary by COVID-19 to accommodate the expected increase in absentee ballots cast and reduce voter overlap at locations.

 

Section 10. That this ordinance, appropriating money, is recognized as an ordinance with an accelerated effective date as provided by Section 503(a)(3)(C) of the City Charter and shall take effect in accordance with Section 503 of the City Charter.

I hereby certify that there is a balance, otherwise unencumbered, to the credit of the appropriation to which the foregoing expenditure is to be charged, and a cash balance, otherwise unencumbered, in the treasury, to the credit of the fund from which payment is to be made, each sufficient to meet the obligation hereby incurred.
