ORDINANCE
NO. 180269
Authorizing sale of 0.499 acre
tract generally located at E. 23rd and Locust to Children’s Mercy Hospital, for
the consideration of $316,000.00, which tract was removed from the City’s park
system pursuant to a special election held on November 7, 2017; and directing
the City Clerk to record this Ordinance with the Office of the Recorder of
Deeds of Jackson County, Missouri.
WHEREAS, as evidenced by Resolution No. 30877, the
Board of Parks and Recreation Commissioners determined that a 0.499 acre tract
generally located at E. 23rd Street and Locust, was no longer necessary or
appropriate for park, parkway, or boulevard use, and that such property could
be removed from the park system by a vote of the people; and
WHEREAS,
on August 10, 2017, the City Council passed Ordinance No. 170563 which
authorized an election to be held to approve the removal of such 0.499 acre
tract by a vote of the people, and such election was held November 7, 2017, the
outcome of which supported the removal of the tract from the park system; and
WHEREAS, such
favorable vote allowed the City to dispose of the property as surplus property;
and
WHEREAS, the
City solicited bids for the purchase of the surplus property, disclosed the
zoning classification of the area as being R-0.5 and that the proposed use of
any bidder would be a factor to be considered in the decision of which bid to
select; and
WHEREAS, the
City received one bid for the surplus property from Children’s Mercy Hospital
equal to the advertised minimum bid of $316,000.00, and the stated proposed use
is for a new research tower; and
WHEREAS, the
0.499 acre tract is within the Greater Downtown Area Plan, and such Plan was
adopted by the City Council by Committee Substitute for Ordinance No. 100049
passed March 11, 2010, as a guide for future development and public investment,
and such Plan designates a recommended land use for this tract as Downtown
Core, which is primarily intended to promote high-intensity office and
employment growth, and the new research tower fits well within the recommended
Downtown Core land use; NOW, THEREFORE,
BE IT
ORDAINED BY THE COUNCIL OF KANSAS CITY:
Section 1. That the Director of the Parks
and Recreation Department is authorized: a) to execute a Special Warranty Deed
conveying the below described City owned parcel to Children’s Mercy Hospital
with the final legal description being determined by survey, if any, if
different than that set out below, in consideration for the payment of $316,000.00,
b) to execute any and all other real estate and closing documents necessary,
and c) to take such further actions as are required to carry out the intent of
this ordinance to convey the 0.499 acre tract to Children’s Mercy Hospital for
the intended use for the construction of a research tower as a part of the
overall plan for such medical campus. Such 0.499 acre tract, in the vicinity
of E. 23rd Street and Locust, Kansas City, Jackson County, Missouri, is more
specifically described as:
That part of the East
1/2 of Section 8, Township 49 North, Range 33 West in Kansas City, Jackson County,
Missouri being more particularly described as follows: Beginning at the
intersection of the north line of 23rd street as established by Ordinance No.
21826, dated January 13, 1903 and the east line of Kansas City park property as
established by Ordinance No. 9536, dated August 9, 1911 as part of Gillham Road;
thence South 3 degrees 38 minutes 29 seconds West along said east line, a
distance of 75.10 feet to a point on the west line of Lot 1, Children’s Mercy Hospital,
a subdivision in said city, county, and state; thence South 2 degrees 30
minutes 53 seconds West continuing along said east line and along the west line
of said Lot 1, a distance of 326.01 feet; thence North 87 degrees 29 minutes 07
seconds West, a distance of 46.21 feet; thence along a curve to the left having
an initial tangent bearing of North 6 degrees 13 minutes 19 seconds East, a
radius of 838.00 feet, a central angle of 1 degree 46 minutes 40 seconds and an
arc distance of 26.00 feet; thence North 4 degrees 26 minutes 39 seconds East,
a distance of 75.79 feet; thence along a curve to the left tangent to the last
described course, having a radius of 938.00 feet, a central angle of 1 degree 00
minutes 15 seconds and an arc distance of 16.44 feet; thence North 86 degrees 33
minutes 36 seconds West, a distance of 10.00 feet; thence along a curve to the
left having an initial tangent bearing of North 3 degrees 26 minutes 24 seconds
East, a radius of 928.00 feet, a central angle of 5 degrees 40 minutes 49
seconds and an arc distance of 92.00 feet; thence North 2 degrees 14 minutes 24
seconds West, a distance of 67.41 feet; thence along a curve to the left
tangent to the last described course, having a radius of 1028.00 feet, a
central angle of 1 degree 29 minutes 11 seconds and an arc length of 26.67
feet; thence North 86 degrees 16 minutes 25 seconds East, a distance of 7.00
feet; thence along a curve to the left having an initial tangent bearing of North
3 degrees 43 minutes 35 seconds West, a radius of 1035.00 feet, a central angle
of 5 degrees 25 minutes 30 seconds and an arc distance of 98.00 feet; thence South
87 degrees 11 minutes 11 seconds East, a distance of 72.95 feet to the point of
beginning, containing 21,754 square feet or 0.499 acres, more or less
Section 2. That the City Clerk is directed to
record with the Jackson County, Missouri Recorder of Deeds a certified copy of
this ordinance.
