Amending a previously approved preliminary plan for
District CP on a 33.8 acre tract of land located at the northeast corner of NE
Barry Road and N Oak Trafficway by deleting therefrom approximately .23 acre
and approving an amended preliminary plan for the remainder. (6169-CP-10)
BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:
Section A. That an amendment to a previously
approved preliminary plan for District CP on a 33.8 acre tract of land located
at the northeast corner of NE Barry Road and N Oak Trafficway, more
specifically described as follows:
A tract of land in the West one-half of the
Northeast quarter of Section 11, Township 51, Range 33, Kansas City,
Clay County, Missouri, and all of OAK BARRY CENTER, a subdivision of
land in Kansas City, Clay County, Missouri, according to the recorded plat
thereof, said tract of land being bounded and described as follows:
Commencing at the Southwest corner of said Northeast quarter; thence North
040'43" East along the West line of said Northeast Quarter, 190.00
feet; thence South 8945'58" East, 50.00 feet to a point on the East
right of way line of N. Oak Street Trafficway, as now established,
said point also being a point on the West line of said OAK BARRY CENTER,
and said point being the True Point of Beginning of the tract of land to
be herein described; thence North 040'43" East along said East
right-of-way line, 319.52 feet; thence North 8945'58" West, 9.00
feet; thence North 040'43" East along said East right-of-way line,
504.44 feet; thence North 8945'58" West, 11.00 feet; thence North

line of said OAK BARRY CENTER, to a point on the North right-of-way line
of NE Barry Road, as now established; thence North 8945'58" West

west line of said Northeast Quarter, 190.00 feet; thence South
8945'58" East, along the south line of Lot 4, OAK BARRY CENTER, a
subdivision of land in Kansas City, Clay County, Missouri, according to
the recorded Plat thereof, 180.00 feet, to the True Point of Beginning of
the Tract to be herein described; thence continuing South 8945'58"
East, 67.53 feet; thence South 014"02" West, parallel with and
15.00 feet West of the East line of said Lot 4, 150.00 feet, to a point on
the south line of said Lot 4, said point being also on the north
right-of-way line of NE Barry Road, as now established; thence North
8945'58" West, along said south line, 68.70 feet, to the southwest
corner of said Lot 4; thence North 040'43" East, along the west line
of said Lot 4, 150.00 feet, to the True Point of Beginning. Containing
0.23 acres, more or less.
is hereby approved to delete .23 acre, more specifically
described as:
A tract of land in the Northeast Quarter of Section
11, Township 51, Range 33, Kansas City, Clay County, Missouri, being

Quarter of said Section 11; thence North 040'43" East, along the west
line of said Northeast Quarter, 190.00 feet; thence South 8945'58"
East, along the south line of Lot 4, OAK BARRY CENTER, a subdivision of
land in Kansas City, Clay County, Missouri, according to the recorded Plat
thereof, 180.00 feet, to the True Point of Beginning of the Tract to be
herein described; thence continuing South 8945'58" East, 67.53
feet; thence South 014"02" West, parallel with and 15.00 feet
West of the East line of said Lot 4, 150.00 feet, to a point on the
south line of said Lot 4, said point being also on the north right-of-way
line of NE Barry Road, as now established; thence North 8945'58"
West, along said south line, 68.70 feet, to the southwest corner of said
Lot 4; thence North 040'43" East, along the west line of said Lot 4,
150.00 feet, to the True Point of Beginning. Containing 0.23 acres, more
or less.
and that the amendment to the preliminary plan for the
revised boundary is hereby approved, subject to the following conditions:
1. That the developer submit a final plan
including the landscaping plan for review and approval by the City
Plan
Commission prior to the issuance of a building
permit.
2. That the developer place a fire hydrant at the
southwest corner of the site.
3. That the developer dedicate right-of-way on N
Oak to insure 50 feet from centerline.
4. That the developer dedicate right-of-way on
Barry Road to match the existing right-of-way adjacent to the east.
5. That the developer cause the area to be platted
and processed in accordance with Chapter 31, Code of General
Ordinances of Kansas City, Missouri, as
amended, commonly
known as the Subdivision Regulations and that
the
developer submit a storm drainage study at the
time of
the final plat.
6. That the developer construct sidewalks on N Oak
and Barry Road.
7. That the developer dedicate a cross access
easement with the property to the north.
A copy of said amended preliminary plan is on file
in the office of the City Clerk under Document No. 900223, which is attached
hereto and made a part hereof.
Section B. That the Council finds and declares that
before taking any action on the proposed amendment hereinabove, all public
notices and hearings required by the Zoning Ordinance have been given and had.
