ORDINANCE NO. 040235

 

Approving a Community Unit Project on an approximately 34 acre tract of land generally located on the south side of N.E. 72nd Street, approximately 800 feet west of N. Brighton Avenue. (12520-CUP-6)

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That a Community Unit Project on an approximately 34 acre tract of land generally located on the south side of N.E. 72nd Street, approximately 800 feet west of N. Brighton Avenue, and more specifically described as follows:

 

All that part of the Northwest Quarter of the Northwest Quarter of Section 20, Township 51, Range 32, in Kansas City, Clay County, Missouri, described as follows: Commencing at the northwest corner of said Section 20; thence South 89E10'38" East, along the north line of the Northwest Quarter of said Section 20, a distance of 361.50 feet to the point of beginning; thence continuing South 89E10'38" East, along said north line, a distance of 950.13 feet to the northeast corner of said Quarter Quarter Section; thence South 00E27'11" West, a distance of 1308.24 feet to the southeast corner of said Quarter Quarter Section; thence North 89E18'22" West, a distance of 1306.76 feet to the southwest corner of said Quarter Quarter Section; thence North 00E14'27" East, along the west line of the Northwest Quarter of said Section 20, a distance of 708.74 feet; thence South 89E10'38" East, a distance of 361.50 feet; thence North 00E14'27" East, a distance of 602.49 feet to the point of beginning. Containing 34.31 acres, more or less, subject to that part, if any, in N.E. 72nd Street.

 

is hereby approved, subject to the following conditions:

 

1. That the developer install street trees as required in the Woodbrooke Villas and Woodbrooke Estates areas on the north side of N.E. 72nd Street prior to submittal of the final plat.

 

2. That the developer cause the area to be platted and processed in accordance with Chapter 66, Code of Ordinances of the City of Kansas City, Missouri, as amended, commonly known as the Subdivision Regulations.

 

3. That the developer submit an overall storm drainage study to the City Engineers Office for approval regarding both proposed developments at the time the first final plat is submitted, with detailed storm drainage studies to be submitted for each phase of development at the time of final platting, and that the developer make any improvements as required by the City Engineers Office.

 

4. That the developer submit plans for grading and siltation and erosion control to the


City Engineers Office for approval prior to beginning any construction activities.

 

5. That the developer secure a land disturbance permit from the Department of Public Works prior to beginning any construction, grading, clearing or grubbing activities, if the disturbed area exceeds one acre.

 

6. That the developer secure a land disturbance permit from the Missouri Department of Natural Resources.

 

7. That the 3:1 lot depth to width ratio for Lots 33 through 36, 45, 46 and 58 through 66, as shown on the preliminary community unit project, be waived.

 

8. That the developer submit a street name signage plan to the Street Naming Committee for approval.

 

9. That the developer obtain the grading consents, and all grading, temporary construction and drainage easements from the abutting property owner prior to submitting any public improvements.

 

10. That the developer dedicate additional right-of way for N.E. 72nd Street as required by the Department of Public Works so as to provide a minimum of 50 feet of right-of-way as measured from the centerline of N.E. 72nd Street.

 

11. That the developer provide adequate sight distance for N.E. 72nd Street at the proposed public street entrances as required by the Department of Public Works.

 

12. That any relocated streetlights be integrated into the existing street lighting system as required y the Department of Public Works.

 

13. That the developer construct all internal streets to residential street standards with a total right-of-way of 50 feet as required by the Department of Public Works, including construction of curbs, gutters and sidewalks, and installation of street lights.

 

14. That the developer contribute $28,392.25 in lieu of parkland dedication for 100 single-family lots in satisfaction of Section 66-128 of the Subdivision Regulations.

 

15. That the developer extend and/or enlarge water mains and provide easements as required by the Water Services Department.

 

16. That the developer install hard surface roads and provide for fire protection as required by the Fire Department prior to construction beyond foundations.

 

17. That the developer construct sanitary and/or storm sewers and determine adequacy as required by the City Engineers Office.

 

18. That the developer submit covenants, conditions and restrictions to the Law Department prior to the approval of any final plat.

 

19. That the developer submit a street tree planting plan as part of the final plat with a copy to be submitted to the Department of City Development, secure the approval of the City Forester for street trees planted on right-of-way in front of residential lots, and plant the street trees in conformance with the plan approved by the City Forester. The Plan shall include size, type, species and placement of trees.

 

20. That the developer submit a final plan for the proposed storm water management tract to the City Plan Commission for approval, including plans for landscaping, grading and storm drainage capacity.

 

A copy of said Community Unit Project plan is on file in the office of the City Clerk under Document No. 040236, which is attached hereto and made a part hereof.

 

Section B. That the Council finds and declares that before taking any action on the proposed Community Unit Project hereinabove, all public notices and hearings required by the Zoning Ordinance have been given and had.
