ORDINANCE NO. 010079

 

Amending Chapter 80, Code of Ordinances, by adding a new section to be known as Section 80-11A0340, rezoning an area of approximately 3.43 acres generally located on the west side of Holmes Road, approximately 400 feet south of Blue Ridge Boulevard, from District R-1a (One-Family Dwellings) to District C-2-p (Local Retail Business - Limited District), and approving a preliminary plan for the same. BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That Chapter 80, Code of Ordinances of the City of Kansas City, Missouri, 1996, commonly known as the Zoning Ordinance, is hereby amended by enacting a new section to be known as Section 80-11A0340, rezoning an area of approximately 3.43 acres generally located on the west side of Holmes Road, approximately 400 feet south of Blue Ridge Boulevard, from District R-1a (One-Family Dwellings) to District C-2-p (Local Retail Business - Limited District), said section to read as follows:

 

Section 80-11A0340. That an area legally described as:

 

A tract of land lying in the Northeast Quarter of Section 20, Township 47 North, Range 33 West, and also being part of Lot 2 and Lot 3, Commissioners Plat, a subdivision in the City of Kansas City, Jackson County, Missouri, according to the recorded plat thereof, and also being part of Lot 6, Martin City Estates, a subdivision in the City of Kansas City, Jackson County, Missouri, according to the recorded plat thereof, said tract being more particularly described as follows: Beginning at the southwest corner of said Lot 1, Schuster Square; thence South 85E42'13" East along the south line of said Lot 1, Schuster Square, a distance of 440.94 feet to the southeast corner of said Lot 1, Schuster Square; thence continuing South 85E42'13" East, a distance of 10.00 feet to the west right of way line of Holmes Road; thence South 3E17'12" West along the right of way line for Holmes Road, a distance of 244.00 feet; thence North 85E42'13" West and parallel with the south line of said Lot 1, Schuster Square, a distance of 619.03 feet; thence North 3E17'08" East, a distance of 181.20 feet to the south line of said Lot 6, Martin City Estates, said point being 35.91 feet east of the southwest corner of said Lot 6, Martin City Estates, as measured along said south line; thence continuing North 03E17'8" East, a distance of 16.37 feet; thence North 69E37'03" East, a distance of 183.50 feet to the west line of said Lot 1, Schuster Square; thence South 03E16'25" West along said west line a distance of 30.20 feet to the point of beginning and containing 149,656 square feet or 3.4356 acres more or less.

 

is hereby rezoned from District R-1a (One-Family Dwellings) to District C-2-p (Local Retail Business - Limited District), all as shown outlined on a map marked Section 80-11A0340, which is attached hereto and made a part hereof, and which is hereby adopted as a part of an amendment to the zoning maps constituting a part of said chapter and as an amendment to Section 80-11 thereof.


Section B. That a preliminary plan for the area legally described above is hereby approved, subject to the following conditions:

 

1. That the developer cause the area to be platted and processed in accordance with Chapter 66, Code of Ordinances of the City of Kansas City, Missouri, as amended, commonly known as the Subdivision Regulations.

 

2. That the developer submit a storm drainage study for the entire development to the City Engineers Office for approval and that the developer make any necessary improvements as required by the City Engineers Office.

 

3. That the developer submit plans for grading and siltation and erosion control to the City Engineers Office for approval prior to beginning any construction activities.

 

4. That the developer secure a land disturbance permit from the Department of Public Works prior to beginning any construction, grading, clearing or grubbing activities, if the disturbed area exceeds one acre.

 

5. That the developer secure a land disturbance permit from the Missouri Department of Natural Resources.

 

6. That the developer provide for fire protection as required by the Fire Department.

 

7. That the developer extend sanitary sewers as required by the Department of Public Works.

 

8. That the developer enter into an agreement with the City as required by the Department of Public Works whereby the developer agrees to contribute money for off-site transportation improvements in the Martin City Study Area at the rate of $0.25 per gross square foot of floor area for a total amount of $3,282.00 to be paid at the time of platting.

 

9. That the developer dedicate additional right of way for Holmes Road as required by the Department of Public Works as to provide a total of 50 feet of right of way as measured from the centerline of Holmes Road.

 

10. That the developer enter into an agreement with the City as required by the Department of Public Works whereby the developer agrees to contribute $134.00 per frontage foot for a total of $32,696.00 along Holmes Road at the time of platting.

 

11. That the developer extend water mains as required by the Water Services Department.

 

12. That the developer show the limits of the floodplain on the final plat as required by the Department of Public Works.

 

13. That the developer obtain a floodplain certificate from the Department of Codes Administration prior to beginning any construction activities within the floodplain.

 

14. That the developer coordinate with the City Engineers Office for the future construction of Holmes Road and provide grading easements at the time of final plat if approved construction plans are available.

 

15. That the developer submit a final plan to the City Plan Commission for approval, including plans for building elevations and materials, landscaping, grading and signage plans.

 

A copy of said preliminary plan is on file in the office of the City Clerk under Document No. 010079, which is attached hereto and made a part hereof.

 

Section C. That the Council finds and declares that before taking any action on the proposed amendment hereinabove, all public notices and hearings required by the Zoning Ordinance have been given and had.
