Amending a previously approved development plan in
District GP-3 on a 3.92 acre tract of land located at the southeast corner of
N.W. Barry Road and N.W. Barrybrooke Drive. (6399-GP-12)
BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:
Section A. That a previously approved development
plan in District GP-3 on a 3.92 acre tract of land located at the southeast
corner of N.W. Barry Road and N.W. Barrybrooke Drive, and more specifically
described as follows:
All that part of Lots A and F, BARRYBROOKE VILLAGE
- FIRST PLAT, a subdivision of land in Kansas City, Platte County,
Missouri, according to the recorded plat thereof, being bounded and
described as follows: Commencing at the northeast corner of the Southwest
Quarter of Section 7, Township 51, Range 33, Kansas City, Platte
County, Missouri; thence South 035'05" West, along the east
line of said Southwest Quarter, 50.11 feet to the northeast corner of
Lot A, said BARRYBROOKE VILLAGE - FIRST PLAT, being also a point on the
south right-of-way line of N.W. Barry Road, as now established, said point
being the true point of beginning of the tract to be herein described;
thence South 035'50" West, along the east line of the Southwest
Quarter of said Section 7, being also the east line of the aforementioned
Lot A, 313.59 feet to the southeast corner of said Lot A; thence South
8314'23" West, along the south line of said Lot A, 111.05 feet;
thence South 6556'23" West, along said south line, 158.00 feet;
thence North 928'37" West, 50.00 feet to the southeast corner of the
aforementioned Lot F; thence North 8952'37" West, along the south
line of said Lot F, 117.00 feet; thence South 7559'26" West, along
the south line of said Lot F, 73.37 feet to a point on the easterly
right-of-way line of Barrybrooke Drive, as now established; thence
northwesterly, along said right-of- way line, on a curve to the left,
having a radius of 368.00 feet, an arc distance of 32.28 feet; thence
North 1902'06" West, along said right-of-way line, tangent to
the last described curve, 48.17 feet; thence northerly, along said
right-of-way line, on a curve to the right, tangent to the last described
course, having a radius of 425.00 feet, an arc distance of 148.35 feet;
thence North 057'54" East, along said right-of-way line, tangent to
the last described curve, 130.45 feet; thence northerly and easterly,
along said right-of-way line, on a curve to the right, tangent to the last
described course, having a radius of 15.00 feet, an arc distance of 23.56
feet to a point on the south right-of-way line of said N.W. Barry
Road; thence South 8902'06" East, along said right-of- way line,
235.00 feet to the true point of beginning. Containing 3.92 acres
(170,850 square feet), more or less. Subject to any and all easements and
restrictions of record.
is hereby approved, subject to the following conditions:
1. That the developer submit a landscaping plan
showing screening of all parking areas with elevation drawings of
fencing and/or walls and further that said
landscaping
plan provide the planting materials and
location within
parking islands, around proposed monument
signage, within
setback areas and around the perimeter of the
building.
2. That the developer cause the area to be platted
and processed in accordance with Chapter 31, Code of General
Ordinances of Kansas City, Missouri, as
amended, commonly
known as the Subdivision Regulations and that
the final
plat include appropriate airport height zone
language
limitations.
3. That the developer grant an aviation and noise
easement.
4. That the developer contribute to the
improvements to N.W. Barry Road in accordance with the existing
agreement.
5. That the developer obtain a cross access
easement to the property to the west.
6. That the developer extend water mains as
required by the Water Department.
7. That the developer submit a grading plan and
submit a siltation and erosion control plan to the City Engineer's
Office for permitting prior to any construction
activity.
8. That the developer submit a storm drainage
study to the City Engineer's Office and provide for implementation as
required.
8. That the developer secure the approval of the
Board of Zoning Adjustment for a variance to the size limitations
for flat walls signs.
A copy of said amended development plan is on file in the
office of the City Clerk under Document No. 940714, which is attached hereto
and made a part hereof.
Section B. That the Council finds and declares that
before taking any action on the proposed amendment hereinabove, all public
notices and hearings required by the Zoning Ordinance have been given and had.
