Approving a Community Unit Project on approximately a
13.4 acre tract of land generally located at the northwest corner of N.E. 48th
Street and N. Randolph Road. (11796-CUP-1)
BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:
Section A. That a Community Unit Project on
approximately a 13.4 acre tract of land generally located at the northwest
corner of N.E. 48th Street and N. Randolph Road, and more specifically
described as follows:
A tract of land being all that part of the South 1/2
of the Southeast 1/4 of the Southeast 1/4 of Section 33, Township 51,
Range 32, Kansas City, Clay County, Missouri, being described as follows:
Commencing at the southwest corner of the Southeast 1/4 of said Section
33; thence South 89 24'02" East, along the south line of said
Southeast 1/4, 1303.87 feet to the southwest corner of the Southeast 1/4
of the Southeast 1/4 of said Section 33, said corner being also the southeast
corner of Greenwood, a subdivision in said Kansas City; thence North 00
51'11" East, along the west line of said Southeast 1/4, Southeast 1/4
and the east line of said Greenwood, 45.40 feet (Deed = 50.00 feet) to the
point of beginning of the tract to be described herein, said point being
on the northerly right of way line of 48th Street as now established;
thence North 00 51'11" East, continuing along said line, 612.31 feet
(Deed = 607.40 feet) to the northwest corner of the South 1/2, Southeast
1/4, Southeast 1/4, said Section 33; thence South 89 26'52" East,
along the north line of said South 1/2, 1123.64 feet (Deed = 1127.08 feet)
to the westerly right of way line of Interstate 435; thence South 34
48'11" West, along said line, 207.55 feet (Deed = 211.28 feet) to a
point 500.00 feet from Centerline Station 592+80; thence South 17
26'34" West, continuing along said line, 434.57 feet (Deed = 435.67 feet)
to a point 625.00 feet from Centerline Station 596+96.2; thence South 00
43'33" West, parallel with the centerline of said Interstate 435,
6.05 feet to the north right of way line of 48th Street; thence North 89
24'02" West, along said line, 65.00 feet; north of and parallel with
the south line of said Southeast 1/4, 225.08 feet (Deed = 225.00 feet);
thence South 00 35'58" West, continuing along said line, 12.82 feet (Deed
= 14.00 feet) to a point 40.00 feet from the centerline of said 48th
Street; thence westerly, continuing along said line, 40.00 feet from the
centerline thereof, on a curve to the right, having a radius of 3779.72
feet and an initial tangent bearing of North 85 24'27" West, an arc
distance of 57.74 feet; thence westerly, continuing along said line, on a
curve to the left, having a radius of 2904.79 feet and tangent to the last
described curve, an arc distance of 602.28 feet to the point of beginning.
is hereby approved, subject to the following conditions:
1. That the developer cause the area to be platted
and processed in accordance with Chapter 66, Code of Ordinances of
the City of Kansas City, Missouri, as amended,
commonly known as the Subdivision Regulations.
2. That the developer submit a storm drainage
study to the City Engineer's Office for approval and that the
developer make any improvements as required by the City
Engineer's Office.
3. That the developer submit plans for grading and
siltation and erosion control to the City Engineer's Office for
approval prior to beginning any construction activities.
4. That the developer secure a land disturbance
permit from the Missouri Department of Natural Resources.
5. That the developer improve one-half of Randolph
Road to collector street standards as required by the Department of
Public Works.
6. That the developer improve the north half of
N.E. 48th Street to secondary arterial street standards as required
by the Department of Public Works.
7. That the developer receive the approval of the
Board of Zoning Adjustment for any signage.
8. That the developer receive the approval of the
Missouri Highway and Transportation Department prior to working in
any State right of way.
9. That the developer extend water mains as
required by the Water Services Department.
10. That the developer provide for fire protection
as required by the Fire Department.
11. That the developer contribute $21,317.50 in
lieu of parkland dedication for 212 units in satisfaction of Section
66-128 of the Subdivision Regulations.
12. That the developer submit a street tree
planting plan as part of the final plat and secure the approval of
the City Forester for street trees planted on right of way.
13. That the developer submit a final plan to the
City Plan Commission for approval including plans for landscaping and
screening.
A copy of said Community Unit Project plan is on file in
the office of the City Clerk under Document No. 960797, which is attached
hereto and made a part hereof.
Section B. That the Council finds and declares that
before taking any action on the proposed Community Unit Project hereinabove,
all public notices and hearings required by the Zoning Ordinance have been
given and had.
