ORDINANCE NO. 130872

 

Appropriating funds from the Unappropriated Fund Balance of the Capital Improvements Fund to rectify a funding imbalance associated with Ordinance No. 130770; and recognizing an emergency

 

WHEREAS, on May 23, 2013, the Planning, Zoning, and Economic Development Committee and the Transportation and Infrastructure Committee authorized funding of $1,790,000.00 for the contract with Berkebile, Nelson, Immenschuh, McDowell, Inc., for the Phase II – Streetcar/Light Rail Expansion Analysis project with up to $100,000.00 project management costs associated with the project; and

 

  WHEREAS, the City Council approved Ordinance No. 130424 on June 9, 2013, which approved the contract with Berkebile, Nelson, Immenschuh, McDowell, Inc., for the Phase II – Streetcar/Light Rail Expansion Analysis project with associated project management costs and allocated $1,890,000.00; and

 

WHEREAS; on October 10, 2013, the Transportation and Infrastructure Committee authorized funding of $586,500.00 to expand the contract with Berkebile, Nelson, Immenschuh, McDowell, Inc., to include the study of a 6.2 mile extension of the Country Club Right-of-Way to determine the corridors potential as a future extension of the Streetcar system; and

 

WHEREAS, the City Council approved Ordinance No. 130770 on October 11, 2013, which approved an amendment to the contract with Berkebile, Nelson, Immenschuh, McDowell, Inc., for the Phase II – Streetcar/Light Rail Expansion Analysis project with associated project management costs and allocated $586,500.00 bringing the total allocated amount to $2,476,500.00; and

 

WHEREAS; Ordinance No. 130770 erroneously did not appropriate sufficient funds for the contract amendment; and

 

WHEREAS; to rectify the discrepancy it is requested to appropriate funds from the Unappropriated Fund Balance of the Capital Improvements Funds in the amount of $391,000.00; and

 

WHEREAS; City Council wishes to advance funds; NOW, THEREFORE,

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

  Section 1. That the sum of $391,000.00 is appropriated from the Unappropriated Fund Balance of the Capital Improvements Fund to the following accounts:

 


14-3090-648404-A-64007325 Streetcar Study Phase II $ 66,000.00

14-3090-648504-A-64007325 Streetcar Study Phase II 90,000.00

14-3090-648604-B-64007325 Streetcar Study Phase II 235,000.00

TOTAL $391,000.00

 

Section 2. That this ordinance is recognized as an emergency measure within the provisions of Section 503 of the City Charter in that it appropriates money, and shall take effect in accordance with that section.

I hereby certify that there is a balance, otherwise unencumbered, to the credit of the appropriation to which the foregoing expenditure is to be charged, and a cash balance, otherwise unencumbered, in the treasury, to the credit of the fund from which payment is to be made, each sufficient to meet the obligation hereby incurred.
