COMMITTEE SUBSTITUTE FOR ORDINANCE NO. 961648

 

Amending Chapter 80, Code of Ordinances of the City of Kansas City, Missouri, 1996, commonly known as the Zoning Ordinance, by adding a new section to be known as Section 80-11A0015, rezoning an area of approximately 1.5 acres generally located south of 46th Street between Summit Street on the east and Madison Avenue on the west from District R-5 (High Apartment) to District URD (Urban Redevelopment District), and approving a development plan for the same. (9075-URD-11)

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That Chapter 80, Code of Ordinances of the City of Kansas City, Missouri, 1996, commonly known as the Zoning Ordinance, is hereby amended by enacting a new section to be known as Section 80-11A0015, rezoning an area of approximately 1.5 acres generally located south of 46th Street between Summit Street on the east and Madison Avenue on the west from District R-5 (High Apartment) to District URD (Urban Redevelopment District), said section to read as follows:

 

Section 80-11A0015. That an area legally described as:

 

Phase I: Known as Tract 3 on the site plan, generally 4602 Summit and 4620 Summit, together with the west half of the vacated alley. Containing 44,706.50 square feet or 1.0265 acres, more or less.

 

4602 Summit: Lots 47 and 48, and north 8 1/3 feet of Lot 46, and East 1/2 of vacated alley lying west of and adjoining said property, Block 16, "Bunker Hill", a subdivision in Kansas City, Jackson County, Missouri.

 

4620 Summit: Lots 37 through 45, both inclusive, and the south 16 2/3 feet of Lot 46, together with the East 1/2 of the vacated alley lying west of and adjoining said premises, Block 16, "Bunker Hill", a subdivision in Kansas City, Jackson County, Missouri.

 

Vacated Alley: All of the West 1/2 of vacated alley lying east of and adjacent to the following described property: All of Lots 1 through 10, both inclusive, and all of the north 20 feet of the West 1/2 of vacated alley lying east of and adjacent to Lot 11, Block 16, "Bunker Hill", a subdivision in Kansas City, Jackson County, Missouri.

 

Phase II: Known as Tract 1 on the site plan, generally 4627 Madison and 4631 Madison.

 

All of the south 5 feet of Lot 11; all of Lots 12 through 17, both inclusive; all of Lots 32 through 36, both inclusive, except the east 128.68 feet thereof, together with the West 1/2 of the vacated alley lying east of and adjoining said part of Lot 11 and Lot 12 and all of the vacated alley lying between the north line of said Lot 13 and said Lot 36 and the south line of said Lots 17 and 32, Block 16, "Bunker Hill", a subdivision in Kansas City, Jackson County, Missouri, containing 23,065 square feet or 0.530 of an acre, more or less.

 

is hereby rezoned from District R-5 (High Apartment) to District URD (Urban Redevelopment District), all as shown outlined on a map marked Section 80-11A0015, which is attached hereto and made a part hereof, and which is hereby adopted as a part of an amendment to the zoning maps constituting a part of said chapter and as an amendment to Section 80-11 thereof.

 

Section B. That a development plan for the area legally described above is hereby approved, subject to the following conditions:

 

1. That the developer cause the area to be platted and processed in accordance with Chapter 66, Code of Ordinances of the City of Kansas City, Missouri, as amended,

commonly known as the Subdivision Regulations.

 

2. That the developer submit a storm drainage study to the City Engineer's Office for approval and that the developer make any improvements as required by the City

Engineer's Office.

 

3. That the developer submit plans for grading and siltation and erosion control to the City Engineer's Office for approval prior to beginning any construction activities.

 

4. That the developer provide for fire protection as required by the Fire Department.

 

5. That the developer install, loop, remove and/or relocate water mains as required by the Water Services Department.

 

6. That the developer contribute to the Plaza Environs Corridor Study Improvement Fund based on a rate of $325.00 per hotel room.

 

7. That the developer submit a site plan to the Director of the Department of City Development for approval prior to the approval of a building permit. The site plan

shall include: development plan information; property uses; setback distances; lighting;

landscaping; signage and architectural characteristics.

 

A copy of said development plan is on file in the office of the City Clerk under Document No. 961648, which is attached hereto and made a part hereof.

 

Section C. That the Council finds and declares that before taking any action on the proposed amendment hereinabove, all public notices and hearings required by the Zoning Ordinance have been given and had.
