ORDINANCE NO. 940652

 

Accepting various easements and deeds in Jackson, Clay and Platte Counties, releasing various easements in Jackson, Clay and Platte Counties and directing the City Clerk to record the acceptance.

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. That various easements and deeds in Kansas City, Jackson County, executed by the following persons and which appear of record as the instrument numbers and respective books and pages as follows:

Section 5. That the legal descriptions for such properties listed in Sections 1 through 4 are set forth in Exhibit "A", which is attached hereto and incorporated herein by reference.

 

Section 6. All that part of the platted utility easement located on the west 4 feet of Lot 4 and the east 4 feet of Lot 5 in Block 7, Stratford Gardens, a subdivision in the City of Kansas City, Jackson County, Missouri, be and the same is hereby released to its present owners, their heirs and assigns, and the Director of Public Works, if so requested, is authorized to execute a quit- claim deed to the present owners, their successors or assigns, as further evidence thereof.

 

Section 7. To vacate all that part of a drainage easement dedicated by the plat of Wexford Place - First Plat across Lot 4, said subdivision lying north of a line drawn from the southwest corner of Lot 6, Block 5, Picture Hills - First Plat to the most northerly corner of Lot 5, said Wexford Place - First Plat, all in Kansas City, Platte County, Missouri, be and the same is hereby released to its present owners, their heirs and assigns, and the Director of Public Works, of so requested, is authorized to execute a quit-claim deed to the present owners, their successors or assigns, as further evidence thereof.

 

Section 8. All that part of a 5 foot utility easement dedicated by the plat of Otis Kirby Subdivision, a subdivision in Kansas City, Jackson County, Missouri, lying adjacent to a portion of the north and west lines of Lot 2, said Otis Kirby Subdivision, and being described as follows: Commencing at the most westerly corner of said Lot 2, thence easterly along said north line a distance of 5 feet to the point of beginning, thence continuing easterly along said north line a distance of 52 feet, thence northerly along said west line a distance of 38 feet to the point of termination, be and the same is hereby released to its present owners, their heirs and assigns and the Director of Public Works, if so requested, is authorized to execute a quit-claim deed to the present owners, their successors or assigns, as further evidence thereof.

 

Section 9. All that part of the platted drainage easement located in Lot 8, Winchester Woods, a subdivision in Kansas City, Clay County, Missouri, being more particularly described as follows: Beginning at a point on the west line of said Lot 8, said point being north 00 38'01" east, a distance of 11.74 feet from the southwest corner of said Lot 8; thence north 67 29'36" east, a distance of 103.31 feet; thence north 00 38'01" east, a distance of 3.26 feet; thence south 67 29'36" west, a distance of 103.31 feet to a point on the west line of said Lot 8, thence south 00 38'01" west along the west line of said Lot 8, a distance of 3.26 feet to the point of beginning, be and the same is hereby released to its present owners, their heirs and assigns, and the Director of Public Works, if so requested, is authorized to execute a quit-claim deed to the present owners, their successors or assigns, as further evidence thereof.

 

Section 10. All that part of the platted storm sewer easement located on the north 3 feet of the 20 foot storm sewer easement in Lot 114, Pine Lake - Third Plat, a subdivision of land in the City of Kansas City, Clay County, Missouri, be and the same is hereby released to its present owners, their heirs and assigns, and the Director of Public Works, if so requested, is authorized to execute a quit-claim deed to the present owners, their successors or assigns, as further evidence thereof.

 

Section 11. That the storm drainage easement recorded in the office of the Recorder of Deeds for Clay County, Missouri, at Liberty, as Document No. M4358 in book 2314 at page 545, and previously accepted by Kansas City Ordinance No. 940190, passed March 10, 1994, be and the same is hereby released to its present owners, their heirs and assigns, and the Director of Public Works, if so requested, is authorized to execute a quit-claim deed to the present owners, their successors or assigns, as further evidence thereof.

 

Section 12. That the standard sewer easement recorded in the office of the Recorder of Deeds for Clay County, Missouri, at Liberty, as Document No. M2655 in book 2310 at page 614, and previously accepted by Kansas City Ordinance No. 940190, passed March 10, 1994, be and the same is hereby released to its present owners, their heirs and assigns, and the Director of Public Works, if so requested, is authorized to execute a quit-claim deed to the present owners, their successors or assigns, as further evidence thereof.

 

Section 13. That the temporary easement recorded in the office of the Recorder of Deeds for Clay County, Missouri, at Liberty, as Document No. M2652, in book 2310 at page 605, and previously accepted by Kansas City Ordinance No. 940190, passed March 10, 1994, be and the same is hereby released to its present owners, their heirs and assigns, and the Director of Public Works, if so requested, is authorized to execute a quit-claim deed to the present owners, their successors or assigns, as further evidence thereof.

 

Section 14. That the temporary easement recorded in the office of the Recorder of Deeds for Clay County, Missouri, at Liberty, as Document No. M2654, in book 2310 at page 611, and previously accepted by Kansas City Ordinance No. 940190, passed March 10, 1994, be and the same is hereby released to its present owners, their heirs and assigns, and the Director of Public Works, if so requested, is authorized to execute a quit-claim deed to the present owners, their successors or assigns, as further evidence thereof.

 

Section 15. That the standard sewer easement recorded in the office of the Recorder of Deeds for Clay County, Missouri, at Liberty, as Document No. M2653, in book 2310 at page 608, and previously accepted by Kansas City Ordinance No. 940190, passed March 10, 1994, be and the same is hereby released to its present owners, their heirs and assigns, and the Director of Public Works, if so requested, is authorized to execute a quit-claim deed to the present owners, their successors or assigns, as further evidence thereof.

 

Section 16. That upon the effective date of this ordinance, the City Clerk is hereby directed to cause this ordinance to be recorded in the office of the Recorder of Deeds for Jackson County, Missouri, and Kansas City and Independence, for Clay County, Missouri, at Liberty, and for Platte County, Missouri, at Platte City, respectively.
