ORDINANCE NO. 921135

 

Approving an amendment to a previously approved development plan for District GP-5 (Medium Density Residential) on a 50 acre tract of land generally located west of N. Amity Road and south of Missouri Highway 152. (11066-GP-2)

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That an amendment to a previously approved development plan for District GP-5 (Medium Density Residential) on a 50 acre tract of land generally located west of N. Amity Road and south of Missouri Highway 152, and more specifically described as follows:

 

All that part of the North One-Half of the Northwest Quarter of Section 11, Township 51, Range 34, Kansas City, Platte County, Missouri, described as follows: Commencing at the northwest corner of the Northwest Quarter of said Section 11; thence South 002'35" West along the west line of the Northwest Quarter of said Section 11, a distance of 289.40 feet to a point on the southerly line of the right of way of Missouri State Highway No. 152, said point being the point of beginning of the tract of land herein to be described; thence South 8939'49" East along the said southerly right of way line, a distance of 1154.17 feet; thence South 7439'04" East along said southerly right of way line, a distance of 1061.64 feet; thence South 1520'56" West, a distance of 256.14 feet; thence South 2105'39" East, a distance of 90.00 feet; thence North 6854'21" East, a distance of 113.31 feet; thence easterly along a curve to the right, having the last described course as a tangent, having a radius of 415.84 feet an arc distance of 159.67 feet; thence South 8905'39" East, a distance of 150.89 feet to a point on the westerly line of the right of way of N. Amity Road; thence South 1153'48" East along said westerly right of way line, a distance of 0.55 feet, thence South 1516'22" East along said westerly right of way line, a distance of 61.93 feet; thence North 8905'39" West, a distance of 168.27 feet; thence South 035'17" East and parallel with the east line of the Northwest Quarter of said Section 11, a distance of 417.42 feet; thence South 8905'39" East, a distance of 208.71 feet; thence South 035'17" East, a distance of 40.00 feet to a point on the south line of the North One- Half of Northwest Quarter of said Section 11; thence North 8905'39" West along the south line of the North One-Half of the Northwest Quarter of said Section 11, a distance of 2617.99 feet to the southwest corner of the North One-Half of the Northwest Quarter of said Section 11; thence North 002'35" East along the west line of the Northwest Quarter of said Section 11, a distance of 1029.49 feet to the point of beginning. The above described tract of land contains 51.51 acres more or less.

 

is hereby approved, subject to the following conditions:

 

1. That the developer cause the area to be platted and processed in accordance with Chapter 31, Code of General

Ordinances of Kansas City, Missouri, as amended, commonly

known as the Subdivision Regulations.

 

2. That the developer submit a storm drainage study to the City Engineer's Office as required.

 

3. That the developer submit a landscaping plan for the detention tracts as part of the final plat.

 

4. That the developer submit plans for erosion and siltation control during construction.

 

5. That the developer pay money in lieu of parkland dedication in the amount of $10,738.03 for 106 single

family units.

 

6. That the developer dedicate right of way for the collector street coterminous with the north line of the

property south of the subject property subject to

acquisition of grading waivers.

 

7. That the developer dedicate an access easement to Tract "A" through the proposed commercial tract to the east.

 

8. That the developer extend water mains as required.

 

9. That the developer construct hard surface streets and provide for fire protection prior to construction beyond

foundations.

 

A copy of said amendment is on file in the office of the City Clerk under Document No. 921135, which is attached hereto and made a part hereof.

 

Section B. That the Council finds and declares that before taking any action on the proposed amendment hereinabove, all public notices and hearings required by the Zoning Ordinance have been given and had.
