ORDINANCE NO. 991066
Approving the preliminary plat of Highland Oaks
on approximately an 8.3 acre tract of land generally located at N.W. 76th
Street, approximately 600 feet west of N. Mace Road. (SD 0771A)
BE IT ORDAINED BY THE COUNCIL OF
KANSAS CITY:
Section A. That the preliminary
plat of Highland Oaks on approximately an 8.3 acre tract of land generally
located at N.W. 76th Street, approximately 600 feet west of N. Mace Road, and
more specifically described as follows:
A tract of land in the
Northeast Quarter of Section 14, Township 51, Range 34, in Platte County,
Missouri, being a part of Tract 1, Replat of Bridle Parc Estates II, a
subdivision in Platte County, Missouri, described as follows: Commencing at the
southwest corner of said Tract 1; then South 8900'49" East on the south
line of said tract, 700 feet for a true point of beginning; then North
024'37" East, 210 feet; then North 2932'35" West, 120.20 feet; then
North 024'37" East, 344.39 feet; then North 8852'58" West, 143.17
feet; then North 009'39" East, 340.44 feet; then South 8855'12"
East, 471.50 feet; then South 009'58" West, 997.96 feet to a point on the
south line of said tract; then North 8900'49" West on the said south line
271.08 feet to the point of beginning. This tract contains 8.3 acres more or
less.
is hereby approved, subject to the following
conditions:
1. That
the developer cause the area to be platted and processed in accordance with Chapter
66, Code of Ordinances of the City of Kansas City, Missouri, as amended,
commonly known as the Subdivision Regulations.
2. That
the developer submit a storm drainage study to the City Engineers Office for
approval and that the developer construct any necessary improvements as
required by the City Engineers Office.
3. That
the developer submit plans for grading and siltation and erosion control to the
City Engineer's Office for approval prior to beginning any construction
activities.
4. That
the developer secure a land disturbance permit from the Missouri Department of
Natural Resources.
5. That
the developer construct hard surface all-weather roads and provide for fire
protection as required by the Fire Department prior to construction beyond
footings and foundations.
6. That
the developer secure a floodplain certificate from the Department of Codes
Administration prior to beginning any construction activities within the
floodplain.
7. That
the developer show the limits of the floodplain on the final plat as required
by the Department of Public Works.
8. That
the developer extend water mains as required by the Water Services Department.
9. That
the developer extend sanitary sewers as required by the Department of Public
Works.
10. That
the developer submit a street name signage plan for the entire area for
approval by the Street Naming Committee prior to submittal of the first final
plat.
11. That
the developer submit a street tree planting plan as part of the final plat and
secure the approval of the City Forester for street trees planted on right of
way in front of residential lots, with a copy to be submitted to the Department
of City Development. The plan shall include size, type, species and placement
of trees.
12. That
the developer construct a temporary cul-de-sac as required by the Department of
Public Works.
13. That
the developer contribute $10,396.44 in lieu of parkland dedication for 26
single-family lots (26 lots x 3.7 x 0.006 x $18,011.85 = $10,396.44) in
satisfaction of Section 66-128 of the Subdivision Regulations.
14. That
the developer submit covenants, conditions and restrictions to the Law
Department for approval.
15. That
a variance of the maximum allowable lot width to depth ratio of 1:3 for the
single-family lots identified on the preliminary plat as Lots 89, 90, 91 and 92
is hereby granted.
16. That
the developer comply with the Kansas City International Airport Height zoning
restrictions and that no structure be constructed which exceeds those
restrictions.
17. That
the developer secure a land disturbance permit from the Department of Public
Works prior to beginning any construction, grading, clearing or grubbing
activities if the disturbed area exceeds one acre.
A copy of the preliminary plat is on file in the
office of the City Clerk under Document No. 991065, which is attached hereto
and made a part hereof.
Section B. That the Council finds
and declares that before taking any action on the proposed preliminary plat
hereinabove, all public notices and hearings required by the Subdivision
Regulations have been given and had.
