ORDINANCE NO. 001061
Approving
the preliminary plat of Brighton Estates on approximately a 4.32 acre tract of
land generally located south of 27th Street, east of Raytown Road and west of
Brighton Avenue. (SD 0912)
BE
IT ORDAINED BY THE COUNCIL OF KANSAS CITY:
Section
A. That the preliminary plat of Brighton Estates on approximately a 4.32 acre
tract of land generally located south of 27th Street, east of Raytown Road and
west of Brighton Avenue, and more specifically described as follows:
A tract of land in the Northwest Quarter of
Section 14, Township 49, Range 33, Jackson County in Kansas City, Missouri, being
more particularly described as follows: Commencing at the northeast corner of
the Northwest Quarter of said Section 14, Township 49, Range 33; thence South
89E59'10" West on the
north line of said Quarter Section a distance of 133.53 feet; thence South 00E02'03" East, a distance of 30.00
feet to a point on the south right of way line of 27th Street, said point also
being the point of beginning of the tract of land to be described; thence
continuing South 00E02'03" East, a
distance of 120.00 feet; thence North 89E57'57"
East, a distance of 80.00 feet to a point on the west right of way line of
Brighton Avenue; thence South 00E02'03"
East on said west right of way line, a distance of 120.00 feet; thence South 89E57'57" West, a distance of 120.00
feet; thence South 00E02'03" East, a
distance of 200.00 feet; thence North 89E57'57"
East, a distance of 120.00 feet to a point on the west right of way line of
said Brighton Avenue; thence South 00E02'03"
East on said west right of way line, a distance of 120.00 feet; thence South 89E57'57" West, a distance of 120.00
feet; thence South 00E02'03" East, a
distance of 91.12 feet; thence South 47E14'40"
East, a distance of 42.52 feet; thence North 89E57'57" East, a distance of 88.80 feet to a
point on the west right of way line of said Brighton Avenue; thence South 00E02'03" East on said west right of
way line, a distance of 82.20 feet; thence South 42E45'20" West continuing on said right
of way line, a distance of 120.00 feet to a point on the east right of way line
of Raytown Road; thence North 47E14'40"
West on said east right of way line, a distance of 191.72 feet; thence North 25E52'08" West continuing on said east
right of way line, a distance of 407.31 feet; thence North 64E07'52" East, a distance of 121.89
feet; thence North 00E02'03" West, a
distance of 300.30 feet to a point on the south right of way line of said 27th
Street; thence North 89E57'57" East on said
south right of way line, a distance of 210.00 feet to the point of beginning.
The subject property contains 188,046 square feet or 4.32 acres, more or less,
subject to easements, restrictions and reservations now of record.

hereby approved, subject to the following conditions:
1. That
the developer cause the area to be platted and processed in accordance with
Chapter 66, Code of Ordinances of Kansas City, Missouri, as amended, commonly
known as the Subdivision Regulations.
2. That
the developer submit a storm drainage study to the City Engineers Office for approval
and that the developer make any necessary improvements as required by the City
Engineer's Office.
3. That
the developer submit plans for grading and siltation and erosion control to the
City Engineers Office for approval prior to beginning any construction
activities.
4. That
the developer secure a land disturbance permit from the Department of Public
Works prior to beginning any construction, grading, clearing or grubbing
activities, if the disturbed area exceeds one acre.
5. That
the developer provide for fire protection as required by the Fire Department
prior to construction beyond foundations.
6. That
the developer reconstruct the sidewalks on the south side of 27th Street, on
the west side of Brighton Avenue, and on the east side of Raytown Road as
required by the Department of Public Works.
7. That
the developer petition for the vacation of Poplar Avenue as required by the
Department of Public Works.
8. That
the developer submit covenants, conditions and restrictions to the Law Department
for approval for the maintenance of private open spaces and any detention areas
within the final plat.
9. That
the developer submit a street tree planting plan as part of the final plat,
with a copy to be submitted to the Department of City Development, secure the
approval of the City Forester for street trees planted on right of way in front
of residential lots, and plant the street trees in conformance with the plan
approved by the City Forester. The plan shall include size, type, species and placement
of trees.
10. That
the developer provide cross-access easements for each final plat as required by
the Department of Public Works.
A
copy of the preliminary plat is on file in the office of the City Clerk under
Document No. 001061, which is attached hereto and made a part hereof.
Section
B. That the Council finds and declares that before taking any action on the
proposed preliminary plat hereinabove, all public notices and hearings required
by the Subdivision Regulations have been given and had.
