ORDINANCE NO. 061133

 

Rezoning an area of approximately 1.97 acres generally located at the southwest corner of N.E. 88th Street and N. Oak Trafficway from District R-1a to District R-4-O. (11894-P-2).

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. That Chapter 80, Code of Ordinances of the City of Kansas City, Missouri, commonly known as the Zoning Ordinance, is hereby amended by enacting a new section to be known as Section 80-11A0702 rezoning an area of approximately 1.97 acres generally located at the southwest corner of N.E. 88th Street and N. Oak Trafficway from District R-1a (One-Family Dwellings) to District R-4-O (Low Apartments, Administrative Office), said section to read as follows:

 

Section 80-11A0702. That an area legally described as:

 

All that part of Lots 1, 2 and 3, GASHLAND HEIGHTS RESURVEY, a subdivision of land in Kansas City, Clay County, Missouri being described as follows:

 

Commencing at the Northwest corner of the East half of said Lot 1; thence along the West line of the East half of said Lot 1, South 00 degrees 40 minutes 34 seconds West, a distance of 5.00 feet to a point 5 feet southerly of the North line of said Lot 1, also being the Southerly Right-of-Way line of Northeast 88th Street, and being the Point of Beginning of the Tract of land herein to be described; thence along a line lying 5 feet southerly and parallel to the North line of said Lot 1, also being said Southerly Right-of-Way line, North 89 degrees 54 minutes 01 seconds East, a distance of 144.66 feet; thence continuing along said Southerly Right-of-Way, Southeasterly along a curve to the right, being tangent to the last described course, having a radius of 25.00 feet, an arc distance of 39.63 feet to a point on the Westerly Right-of-Way line of North Oak Trafficway, also being a point 20 feet Westerly of the East line of said Lot 1; thence along said Westerly Right-of-Way line, also being 20 Westerly of and parallel to the East line of Lots 1 and 2, South 00 degrees 40 minutes 34 seconds West, a distance of 369.68 feet to a point on the South line of said Lot 2, also being a point on the North line of said Lot 3; thence continuing along said Westerly Right-of-Way line, also being the South line of said Lot 2, and being the North line of said Lot 3, North 89 degrees 54 minutes 01 seconds East, a distance of 20.00 feet to the Southeast corner of said Lot 2, also being the Northeast corner of said Lot 3; thence continuing along said Westerly Right-of-Way line, also being the East line of said Lot 3, South 00 degrees 40 minutes 34 seconds West, a distance of 100.01 feet to the Southeast corner of said Lot 3; thence along the South line of said Lot 3, South 89 degrees 54 minutes 01 seconds West, a distance of 190.00 feet to the Southwest corner of the East half of said Lot 3; thence along the West line of the East half of said Lots 3, 2 and 1, North 00 degrees 40 minutes 34 seconds East, a distance of 495.05 feet to the Point of Beginning. Said tract contains 1.97 Acres, more or less.

 

is hereby rezoned from R-1a (One-Family Dwellings) to District R-4-O (Low Apartments, Administrative Office), all as shown outlined on a map marked Section 80-11A0702, which is attached hereto and made a part hereof, and which is hereby adopted as a part of an amendment to the zoning maps constituting a part of said chapter and as an amendment to Section 80-11 thereof.

 

Section B. That the Council finds and declares that before taking any action on the proposed amendment hereinabove, all public notices and hearings required by the Zoning Ordinance have been given and had.
