ORDINANCE NO. 011121
Amending
Chapter 80, Code of Ordinances, by adding a new section to be known as Section 80-11A0376,
rezoning an area of approximately 42.3 acres generally located on the south
side of East 56th Street, approximately 500 feet west of Bennington Avenue
(6309 East 56th Street) from District R-2b (Two-Family Dwellings) to District
RA (Agricultural). (7389-P-3)
BE
IT ORDAINED BY THE COUNCIL OF KANSAS CITY:
Section
A. That Chapter 80, Code of Ordinances of the City of Kansas City, Missouri,
1996, commonly known as the Zoning Ordinance, is hereby amended by enacting a
new section to be known as Section 80-11A0376, rezoning an area of
approximately 42.3 acres generally located located on the south side of East
56th Street, approximately 500 feet west of Bennington Avenue (6309 East 56th
Street) from District R-2b (Two-Family Dwellings) to District RA
(Agricultural), said section to read as follows:
Section
80-11A0376. That an area legally described as:
All that part of the West Half of the Southwest
Quarter of Section 36, Township 49, Range 33, in Kansas City, Jackson County,
Missouri, (except that part lying west of the Kansas City Southern Railroad)
more particularly described as follows: Beginning at the northeast corner of
the Southwest Quarter of the Southwest Quarter of said Section, Township and
Range; thence south along the east line thereof, 130.03 feet; thence South 52E West, 110.55 feet; thence South 74E West, 219.45 feet; thence South 53E West, 207.90 feet; thence South 81E30' West, 174.90 feet; thence South 83E West, 174.90 feet; thence North 76E West, 158.40 feet; thence North 65E West, 115.50 feet; thence North 79E12'30" West, 255.68 feet to the west
line of the Southwest Quarter of said Section, Township and Range; thence north
along the west line of the Southwest Quarter of said Section, Township and
Range, 840.78 feet, more or less, to a point which is 975.17 feet south of the
northwest corner of the Southwest Quarter said Section, Township and Range;
thence east parallel with the north line of the Southwest Quarter of said
Section, Township and Range, 1029.60 feet; thence north parallel with the west
line of the Southwest Quarter of said Section, Township and Range, 834.61 feet
to a point in the centerline of the County Road; thence east along the
centerline of the County Road, 288.31 feet to the east line of the West Half of
the Southwest Quarter of said Section, Township and Range; thence south along
said east line to the place of beginning, subject to the right of way of the
County Road, Topping Avenue and the Kansas City Southern Railroad.
All that part of the Northeast Quarter of the
Southwest Quarter of Section 36, Township 49, Range 33, in Kansas City, Jackson
County, Missouri, more particularly described as follows: Beginning in the
south line of said Quarter Quarter Section at a point which is 230 feet west of
the southeast corner of said Quarter Quarter Section; thence north parallel
with the east line of said Quarter Quarter Section, a distance of 584.65 feet;
thence west parallel with the north line of Quarter Quarter
Section,
a distance of 208.71 feet; thence north parallel with the east line of said
Quarter Quarter Section, 208.71 feet to the centerline of the County Road;
thence westerly along the centerline of the County Road to a point which is
277.15 feet east of the west line of said Quarter Quarter Section; thence
northwesterly along the centerline of the County Road to a point in the west
line of said Quarter Quarter Section which is 340.56 feet south of the north
line of said Quarter Quarter Section; thence south along the west line of said
Quarter Quarter Section to the southwest corner thereof; thence east along the
south line of said Quarter Quarter Section to the point of beginning, subject
to the right of way of the County Road.
EXCEPT:
All that part of the Southwest Quarter of Section 36, Township 49, Range 33, in
Kansas City, Jackson County, Missouri, described as follows: Beginning at a
point which is 975.15 feet south of the northwest corner of the Southwest
Quarter of said Section, Township and Range; thence North 89E52'45" East and parallel to 56th Street, 339.68 feet; thence South
12E15'15" East, 764.88 feet; thence South 77E44'45" West, 50.00 feet; thence South 12E15'15" East, 7.04 feet; thence North 76E10'30" West, 102.61 feet; thence North 65E10'30" West, 115.50 feet; thence North 78E50'44" West, 254.38 feet; thence North 00E03'26" West, along west line of said Quarter Section, 642.02 feet
to the point of beginning.
is hereby rezoned from
District R-2b (Two-Family Dwellings) to District RA (Agricultural), all as shown
outlined on a map marked Section 80-11A0376, which is attached hereto and made
a part hereof, and which is hereby adopted as a part of an amendment to the
zoning maps constituting a part of said chapter and as an amendment to Section
80-11 thereof.
Section B. That
the Council finds and declares that before taking any action on the proposed
amendment hereinabove, all public notices and hearings required by the Zoning
Ordinance have been given and had.
