ORDINANCE NO. 030333

 

Amending Chapter 80, Code of Ordinances, by adding a new section to be known as Section 80-11A0476, rezoning an area of approximately 2.8 acres generally located on the west side of Baltimore Street between 14th Street and a point approximately 75 feet north of 13th Street from Districts URD (Urban Redevelopment District) and C-4 (Central Business District) to District URD (Urban Redevelopment District), approving a development plan for the same. BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That Chapter 80, Code of Ordinances of the City of Kansas City, Missouri, commonly known as the Zoning Ordinance, is hereby amended by enacting a new section to be known as Section 80-11A0476, rezoning an area of approximately 2.8 acres generally located on the west side of Baltimore Street between 14th Street and a point approximately 75 feet north of 13th Street from Districts URD (Urban Redevelopment District) and C-4 (Central Business District) to District URD (Urban Redevelopment District), said section to read as follows:

 

Section 80-11A0476. That an area legally described as:

 

All of Lots 1 through 4, Block 7, Reids Addition, an addition in Kansas City, Jackson County, Missouri; Lots 5 through 12, Block 7, Reids Addition, an addition in Kansas City, Jackson County, Missouri; Lots 1 through 4, Block F, Second Resurvey of Reids Addition, an addition in Kansas City, Jackson County, Missouri; Lots 5 through 12, Block F, Second Resurvey of Reids Addition, an addition in Kansas City, Jackson County, Missouri; Lots 25 through 29, Block 7, Reids Addition, an addition in Kansas City, Jackson County, Missouri; all of the south 23 feet of Lot 15 and all of Lots 16 and 17, Block 2, Reids Addition, and addition in Kansas City, Jackson County, Missouri; and including all north-south and east-west dedicated alleys lying west of Baltimore Street and east of Wyandotte Street.

 

is hereby rezoned from Districts URD (Urban Redevelopment District) and C-4 (Central Business District) to District URD (Urban Redevelopment District), all as shown outlined on a map marked Section 80-11A0476, which is attached hereto and made a part hereof, and which is hereby adopted as a part of an amendment to the zoning maps constituting a part of said chapter and as an amendment to Section 80-11 thereof.

 

Section B. That a development plan for the area legally described above is hereby approved, subject to the following conditions:

 

1. That the developer cause the area to be platted and processed in accordance with Chapter 66, Code of Ordinances of Kansas City, Missouri, as amended, commonly known as the Subdivision Regulations.

 


2. That the developer submit a macro storm drainage study to the City Engineers Office for approval for the entire development when the first plat is submitted, and that the developer make any improvements as required by the City Engineers Office.

 

3. That the developer submit plans for grading and siltation and erosion control to the City Engineers Office for approval prior to the commencement of any construction activities.

 

4. That the developer secure a land disturbance permit from the Department of Public Works prior to beginning any construction, grading, clearing or grubbing activities, if the disturbed area exceeds one acre, including providing security equal to the estimated cost to install and maintain the approved erosion and sediment control measures for the duration of the site disturbance permit.

 

5. That the developer extend sanitary and/or storm sewers and determine their adequacy as required by the Department of Public Works

 

6. That the developer make improvements as required by the approved traffic study prior to recording of the first final plat.

 

7. That the developer extend and relocate water mains as required by the Water Services Department.

 

8. That the developer upgrade the existing signal system, replacing controllers and interconnecting signals, within the development plan as required by the Department of Public Works.

 

9. That the developer construct/reconstruct all sidewalks and curbs and repair catch basins along all development street frontages as required by the Department of Public Works.

 

10. That the developer contribute $26,377.04 in lieu of parkland dedication for 193 multifamily units (193 x 2.0 x .006 x $11,389.05) in satisfaction of Section 66-128 of the Subdivision Regulations.

 

11. That the developer provide for fire protection as required by the Fire Department prior to construction beyond foundations.

 

12. That the developer receive approval of a Code Modification Request for the parking dimensions as shown on the development plan.

 

13. That the developer comply with the Kansas City Downtown Airport Height Zoning restrictions and that these restrictions be included on the final plats.

 

14. That, prior to the approval of each site plan by the Director of the Department of City Development, the developer submit schematic drawings, with a driveway analysis to be conducted, to the Director of the Department of Public Works for approval and that the developer make any improvements as required by the approved recommendations.

 

15. That the developer submit a streetscape improvement plan to the Department of Public Works for approval and that the developer implement streetscape improvements as required by the Department of Public Works.

 

16. That the developer petition for the vacation of the north-south and east-west alleys as shown on the development plan.

 

17. That certificates of occupancy for a minimum of 88 residential units on the Power & Light Building block be issued prior to certificates of occupancy for the Power & Light Centre and Power & Light Centre Garage as shown on the development plan.

 

18. That the developer submit a site plan for each phase to the Director of the Department of City Development for approval prior to issuance of building permits. The site plans shall include development plan information, property uses, setback distances, lighting, landscaping, signage (including elevations), and architectural characteristics, including adequate screening and avoidance of horizontal banding on parking structures.

 

A copy of said development plan is on file in the office of the City Clerk under Document No. 0303__, which is attached hereto and made a part hereof.

 

Section C. That the Council finds and declares that before taking any action on the proposed amendment hereinabove, all public notices and hearings required by the Zoning Ordinance have been given and had.
