COMMITTEE SUBSTITUTE FOR ORDINANCE NO. 020099

 

Condemning and taking private property in fee simple for the elimination of blight in the Beacon Hill Redevelopment Project Area; providing for just compensation; and authorizing negotiations by the Director of City Development.

 

WHEREAS, the Council finds and determines it necessary to condemn and acquire fee simple title to the private property hereinafter described and generally located between Troost and Vine Streets and 22nd Street and 27th Street; NOW, THEREFORE,

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. That the following properties are hereby condemned and taken in fee simple for public use for the Beacon Hill Redevelopment Project:

 

Tract Nos. 180-122-2 & 180-122-3

 

TRACT I:

 

The west 45 feet of the south 17 feet of Lot 10 and the west 45 feet of Lot 11, Block 5, Porter Park, a subdivision in Kansas City, Jackson County, Missouri, according to the recorded plat thereof.

 

TRACT II:

 

The west 70 feet of the south 11 feet of Lot 9, and the west 70 feet of the north 33 feet of Lot 10, Block 5, Porter Park, a subdivision in Kansas City, Jackson County, Missouri, according to the recorded plat thereof, except the following described tract of land: The east 25 feet of the west 70 feet of the south 11 feet of Lot 9 and the east 25 feet of the west 70 feet of the north 33 feet of Lot 10, Block 5, Porter Park, a subdivision in Kansas City, Jackson County, Missouri, now known as the west 45 feet of Lot 11, Block 5, Porter Park, a subdivision in Kansas City, Jackson County, Missouri, a/k/a Tract A as shown on Certificate of Survey filed January 9, 1984 as Document No. K-594843 in Book S1 at page 209.

TRACT II:

 

Lots 27, 28 and 29, Block 3, Halls Hill, a subdivision in Kansas City, Jackson County, Missouri, according to the recorded plat thereof.

 

Tract No. 180-108

 

Lot 10, except the north 15 feet thereof and except that part in Paseo Boulevard, Block 3, Porter Park, a subdivision in Kansas City, Jackson County, Missouri, according to the recorded plat thereof.

 

Section 2. Just compensation for the property taken or damaged shall be assessed and paid according to law and the proceedings to determine compensation shall be prosecuted in one or more suits in the Circuit Court of Jackson County, Missouri, at Kansas City, pursuant to the provisions of Chapter 523 of the Revised Statutes of Missouri, 1994, as supplemented or amended by Sections 86.01 to 86.10 of the Rules of Civil Procedure. Payment of compensation shall be made by Kansas City in cash from funds appropriated for such purposes.

 

Section 3. Pending the acquisition of these lands by condemnation, the Director of City Development is authorized to negotiate for and to purchase them out of funds appropriated or to be appropriated and the City Attorney is authorized to withdraw said tracts that are acquired from the condemnation proceedings.
