ORDINANCE NO. 000892

Repealing certain sections of Committee Substitute for Ordinance No. 991416; estimating revenue in the amount of $300,000.00; appropriating the sum of $300,000.00 to various accounts within the Capital Improvements Fund; authorizing execution of a $250,000.00 Cooperative Agreement with the Land Clearance for Redevelopment Authority of Kansas City, Missouri, for the purpose of providing funds for public improvements and additional site remediation for the Hospital Hill Urban Renewal Plan; designating requisitioning authority; declaring the Citys intent to reimburse the Hospital Hill Environmental Cleanup Fund from local sales tax; and directing the City Clerk to file certain documents with the appropriate offices.

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

Section 1. That Sections 1, 2 and 4 of Committee Substitute for Ordinance No. 991416 passed November 9, 1999, are hereby repealed.

Section 2. That the revenue in the following account of the Capital Improvements Fund is hereby estimated in the following amount:

01-309-064-8520 Recovery of Prior Year Expenditures $300,000.00

Section 3. That the sum of $300,000.00 is hereby appropriated from the Unappropriated Fund Balance of the Capital Improvements Fund to the following account in the Capital Improvements Fund:

01-309-064-7112-T Longfellow Heights III $250,000.00

01-309-064-7204-T Hospital Hill Environmental Clean-Up 50,000.00

TOTAL $300,000.00

Section 4. That the City declares its intent to reimburse the Hospital Hill Environmental Cleanup Fund from local sales tax.

Section 5. That the Director of the Department of City Development is hereby authorized, on behalf of the City, to execute a Cooperative Agreement with the Land Clearance for Redevelopment Authority of Kansas City, Missouri, in an amount not to exceed $250,000.00, for the purpose of providing funds for public improvements and additional site remediation within the Longfellow Heights - Phase III Project of the Hospital Hill Urban Renewal Plan to be paid from funds herein appropriated to Account No. 01-309-064-7112-T, Longfellow Heights III ($250,000.00). A copy of the Cooperative Agreement, in substantial form, is attached hereto and is hereby approved.

Section 6. That the Director of the Department of City Development is hereby designated as requisitioning authority for Account No. 01-309-064-7112.

Section 7. That the City Clerk is hereby directed to file a copy of this ordinance, together with a copy of the Cooperative Agreement, with the Office of the Secretary of State of Missouri and with the Department of Records of Jackson County, Missouri.

I hereby certify that there is a balance, otherwise unencumbered, to the credit of the appropriation to which the foregoing expenditure is to be charged, and a cash balance, otherwise unencumbered, in the treasury, to the credit of the fund from which payment is to be made, each sufficient to meet the obligation hereby incurred.
