ORDINANCE NO. 951507

 

Approving the Urban Renewal Plan for a 4.89 acre tract of land generally bounded by 47th Street on the north, Cleveland Avenue on the east, Brush Creek Parkway on the south and Benton Boulevard on the west, subject to certain findings and conditions and to be known as the Benton Manor Apartments Urban Renewal Area.

 

WHEREAS, the Council did on October 5, 1995, adopt Resolution No. 951352, declaring the area generally bounded by 47th Street on the north, Cleveland Avenue on the east, Brush Creek Parkway on the south and Benton Boulevard on the west as an area in need redevelopment and rehabilitation pursuant to the Missouri Land Clearance for Redevelopment Authority Law; and

 

WHEREAS, the Land Clearance for Redevelopment Authority of Kansas City, Missouri, did on September 27, 1995, adopt a resolution approving an urban renewal plan for said area as set forth and incorporated in the urban renewal plan for the Benton Manor Apartments Urban Renewal Area; and

 

WHEREAS, the City Plan Commission has reviewed and recommended approval of the urban renewal plan on October 17, 1995, and has found said plan to be in conformance with the master plan for the development of the community as a whole as evidenced by its resolution recommending the adoption of said plan, a copy of which is attached hereto and incorporated herein as Exhibit "A"; NOW, THEREFORE,

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. That the urban renewal plan for the Benton Manor Apartments Urban Renewal Area, more specifically described as follows:

 

All that part of the Northwest Quarter of the Southeast Quarter of Section 27 of the Township 49, Range 33, in Kansas City, Jackson County, Missouri, including all of Lots 1, 2, 3, 4, 5, 6, 7, 8, 9, 10 and 11, BENTON PARKWAY, a subdivision in said city, county and state, more particularly described as follows: Beginning at the southwest corner of said Lot 11, BENTON PARKWAY, being also the intersection of the easterly line of Benton Boulevard and the northerly line of Brush Creek Parkway, as said boulevard and parkway are now established; thence easterly along said northerly line of Brush Creek Parkway, 325.94 feet to its intersection with the west line of Cleveland Avenue, as now established; thence north along said west line, making a northwest angle of 79 03'18" with the last described course, a distance of 588.85 feet to its intersection with the south line of 47th Street, as now established; thence west along said south line, making a southwest angle of 89 59'00" with the last described course as a tangent, having a radius of 25 feet and a central angle of 134 52'30", a distance of 58.85 feet to a point on said easterly line of Benton Boulevard; thence southeasterly along said easterly line, tangent to the last described curve, 101.98 feet; thence continuing southeasterly along said easterly line, being a curve to the right, from the last described course as a tangent, having a radius of 650 feet and a central angle of 40 45'50", a distance of 462.42 feet to the point of beginning. Except all that part of the above described tract quit claimed to Kansas City for the right-of-way of 47th Street Terrace by deed recorded as Document No. B2S309 in Book B-4461 at page 26. Containing 213.029 square feet, more or less, or 4.890 acres, more or less.

 

is hereby approved. A copy of said urban renewal plan is on file in the office of the City Clerk under Document No. 951507, which is attached hereto and made a part hereof.

 

Section 2. That said urban renewal plan is hereby found to be feasible and in conformance with the master plan for the development of the community as a whole.
