COMMITTEE SUBSTITUTE FOR ORDINANCE NO. 060909

Approving an amendment to a previously approved preliminary plan in District CP-3 (Regional Planned Business Center) on approximately 16.73 acres, generally located north of N.W. 68th Street between Highway 169 on the west and Broadway on the east, for the purpose of deleting approximately 10.93 acres from said preliminary plan. (7576-CP-3) 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

Section A. That an amendment to a previously approved preliminary plan in District CP-3 (Regional Planned Business Center) on approximately 16.73 acres, generally located north of N.W. 68th Street between Highway 169 on the west and Broadway on the east, and more specifically described as follows:

TRACT 1: A tract of land lying in the Northeast Quarter of Section 22, Township 51 North, Range 33 West, in Kansas City, Clay County, Missouri, said tract being more particularly described as follows: Commencing at the Southeast corner of said Northeast Quarter; thence North 894341 West along the South line of said Northeast Quarter a distance of 593.7 feet to the Southeast corner of Arrowhead Station, a subdivision in Kansas City, Missouri, according to the recorded plat thereof; thence North 003019 East along the East line of said Arrowhead Station and parallel with the East line of said Northeast Quarter a distance of 30.00 feet to the North right-of-way line of Northwest 68th Street, said point being the Point of Beginning; thence Continuing North 003019 East along the East line of said Arrowhead Station a distance of 220.00 feet to the Northeast corner of said Arrowhead Station; thence North 894341 West along the North line of said Arrowhead Station parallel with the South line of said Northeast Quarter a distance of 297.05 feet to the Northwest corner of said Arrowhead Station, said point being on the East right-of-way line of U.S. Highway No. 169; thence North 072454 West along said East right-of-way line a distance of 730.87 feet to the Southwest corner of Lot 24, Hamilton Heights West, a subdivision in Kansas City, Missouri according to the recorded plat thereof; thence South 892240 East along the South line of said Hamilton Heights West a distance of 410.58 feet to the Southeast corner of Lot 25, in said Hamilton Heights West, said point being on the West line of North Broadway Center, a subdivision in Kansas City, Missouri according to the recorded plat thereof; thence South 003019 West along the West line of said North Broadway Center parallel with the East line of said Northeast Quarter a distance of 44.47 feet to the Southwest corner of said North Broadway Center; thence North 865719 East along the South line of said North Broadway Center a distance of 236.34 feet; thence South 003019 West parallel with the East line of said Northeast Quarter a distance of 897.89 feet to the North right-of-way line of Northwest 68th Street; thence along said right-of way line along a curve to the right having a radius of 420.89 feet and an initial tangent bearing of South 755602 West (a chord bearing of South 830611 West and a length of 105.05 feet) a distance of 105.32 feet; thence North 894341 West along said North right-of-way line parallel with the South line of said Northeast Quarter a distance of 144.54 feet to the Point of Beginning and containing 476,047 square feet or 10.9285 acres, more or less.

 

TRACT 2: A tract of land lying in the Northeast Quarter of Section 22, Township 51 North, Range 33 West, being partially in Kansas City, Missouri and partially in the City of Gladstone, Clay County, Missouri, said tract be more particularly described as follows: Commencing at the Southeast corner of said Northeast Quarter; thence North 003019 East along the East line of said Northeast Quarter a distance of 570.00 feet; thence North 892941 West a distance of 30.00 feet to the West right-of-way line of North Broadway, said point being the Point of Beginning; thence continuing North 892941 West a distance of 315.00 feet; thence North 003019 East parallel with the East line of said Northeast Quarter a distance of 369.60 feet to the South line of North Broadway Center, a subdivision partially in Kansas City Missouri and City of Gladstone, Missouri, according to the recorded plat thereof; thence North 865719 East along the South line of said Broadway Center, a distance of 315.60 feet to the West right-of-way line of North Broadway; thence South 003019 West along said West right-of-way line parallel with the East line of said Northeast Quarter a distance of 389.14 feet to the Point of Beginning and containing 119,450 square feet or 2.7433 acres, more or less.

 

TRACT 3: A tract of land lying in the Northeast Quarter of Section 22, Township 51 North, Range 33 West, being partially in Kansas City, Missouri and City of Gladstone, Clay County, Missouri, said tract being more particularly described as follows: Commencing at the Southeast corner of said Northeast Quarter; thence North 003019 East along the East line of said Northeast Quarter a distance of 570.00 feet; thence North 892941 West a distance of 30.00 feet to the West right-of-way line of North Broadway, said point being the Point of Beginning; thence South 003019 West along said right-of-way line parallel with the East line of said Northeast Quarter a distance of 120.95 feet; thence along said West right-of-way line along a curve to the right, having a radius of 420.89 feet (a chord bearing of South 381311 West and a length of 514.93 feet) a distance of 554.09 feet; thence North 003019 East parallel with the East line of said Northeast Quarter a distance of 528.29 feet; thence South 892941 East a distance of 315.00 feet to the Point of Beginning and containing 133,135 square feet or 3.0564 acres, more or less.

is hereby approved, subject to the following conditions:

 

1.                  That the developer shall cause the area to be platted and processed in accordance with Chapter 66, Code of Ordinances of the City of Kansas City, Missouri, commonly known as the Subdivision Regulations.

 

2.                  That the developer submit a macro/micro storm drainage study to Development Services for review and acceptance for the entire development when the first plat is submitted, and that the developer construct any improvements as required by the City Development Department.

 

3.                  That the developer secure permits to reconstruct existing sidewalks, curbs, gutters, storm sewers, and streetlights as necessary along all development street frontages, or submit a letter from a Missouri Licensed Civil Engineer stating that the sidewalks, curbs, and gutters are in a good state of repair as required by the City Development Department, prior to recording the plat.

 

4.                  That the developer submit plans for grading, siltation, and erosion control to the City Development Department for approval and permitting prior to beginning any construction activities.

 

5.                  That the developer secure a land disturbance permit from Development Services prior to beginning any construction, grading, clearing, or grubbing activities, if the disturbed area exceeds one acre.

 

6.                  That the developer extend sanitary sewers to ensure individual service is provided to all proposed lots and determine adequacy as required by the City Development Department.

 

7.                  That the developer extend water mains as required by the Water Services Department.

 

8.                  That the developer provide a storm water conveyance system to serve all proposed lots within the development and determine adequacy as required by the City Development Department.

 

9.                  That the developer submit covenants, conditions and restrictions to the Law Department for approval for the maintenance of private open space and enter into a covenant agreement for the maintenance of any stormwater detention area tracts.

 

10.              That the developer submit a final plan including landscaping, grading, lighting, with a photometric study showing zero footcandles at the property line, fencing, signage and building elevations.

 

A copy of said amended preliminary plan is on file in the office of the City Clerk with this ordinance and is made a part hereof.

Section B. That the Council finds and declares that before taking any action on the proposed amendment hereinabove, all public notices and hearings required by the Zoning Ordinance have been given and had.
