ORDINANCE NO. 971134

 

Approving a Community Unit Project on approximately a 57 acre tract of land generally located on the north side of N.W. 56th Street approximately 700 feet west of N. Northwood Road. (10271-CUP-3)

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That a Community Unit Project on approximately a 57 acre tract of land generally located on the north side of N.W. 56th Street approximately 700 feet west of N. Northwood Road, and more specifically described as follows:

 

A tract of land in the South One-Half of the Southwest Quarter of Section 29, Township 51, Range 33, Kansas City, Platte County, Missouri, being more particularly described as follows: Commencing at the southeast corner of said Southwest Quarter; thence North 89 14'02" West, along the south line of said Southwest Quarter, 504.26 feet to the true point of beginning of the tract to be herein described; thence continuing North 89 14'02" West, along said south line, 2097.34 feet to the southwest corner of said Southwest Quarter; thence North 0 33'36" East, along the west line of said Southwest Quarter, 1309.29 feet to the northwest corner of said South One-Half; thence South 89 29'34" East, along the north line of said South One-Half, 345.24 feet; thence South 66 00'04" East, 326.13 feet; thence South 89 29'34" East, 183.00 feet; thence North 0 30'24" East, 130.01 feet to a point on the aforementioned north line of said South One-Half; thence South 89 29'36" East, along said north line, 1047.07 feet to the northwest corner of the Southeast Elementary School as recorded in Book 177 at page 629; thence South 0 30'47" West, along the west line of said school tract, 600.20 feet to the southwest corner of said school tract; thence South 89 29'35" East, along the south line of said school tract; 95.01 feet; thence South 52 18'59" West, 121.30 feet; thence South 0 46'04" West, 327.76 feet; thence South 39 34'01" East, 347.64 feet; thence South 0 45'58" West, 50.00 feet to the true point of beginning. Containing 56.54 acres, more or less.

 

is hereby approved, subject to the following conditions:

 

1. That the developer cause the area to be platted and processed in accordance with Chapter 66, Code of Ordinances of the City of Kansas City, Missouri, as amended,

commonly known as the Subdivision Regulations.

 

2. That the developer submit a storm drainage study for the entire development to the City Engineer's Office for approval and that the developer make any improvements

as required by the City Engineer's Office.

 

3. That the developer submit plans for grading and siltation and erosion control to the City Engineer's Office for approval prior to beginning any construction activities.

 

4. That the developer secure a land disturbance permit from the Missouri Department of Natural Resources.

 

5. That the developer dedicate additional right of way for N.W. 56th Street as required by the Department of Public Works so as to provide a total of 50 feet of right of way

as measured from the centerline of N.W. 56th Street.

 

6. That the developer improve one-half of N.W. 56th Street to secondary arterial street standards as required by the Department of Public Works, including curbs, gutters,

sidewalks and streetlights.

 

7. That the developer extend water mains as required by the Water Services Department.

 

8. That the developer construct hard-surface all-weather roads and provide for fire protection as required by the Fire Department prior to construction beyond

foundations.

 

9. That the developer submit a street tree planting plan with the final plat to the City Forester for approval. The plan shall include size, type, species and placement of

trees.

 

10. That the developer extend the covenants, conditions and restrictions as required by the Law Department.

 

11. That the developer secure the approval of the Street Naming Committee for all street names prior to the submittal of the final plat.

 

12. That the developer extend sanitary sewers as required by the Department of Public Works.

 

13. That the developer construct temporary on and off site cul-de-sacs as required by the Department of Public Works.

 

A copy of said Community Unit Project plan is on file in the office of the City Clerk under Document No. 971134, which is attached hereto and made a part hereof.

 

Section B. That the Council finds and declares that before taking any action on the proposed Community Unit Project hereinabove, all public notices and hearings required by the Zoning Ordinance have been given and had.
