Approving an amendment to a previously approved development plan in District CP-1 on approximately 5.6 acres generally located at the northwest corner of N. Cosby Avenue and N.W. 64th Terrace, for the purpose of deleting an approximately 4.22 acre tract of land from the development plan. (6576-CP-19)

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That an amendment to a previously approved development plan in District CP-1 (Neighborhood Planned Business Center) on approximately 5.6 acres generally located at the northwest corner of N. Cosby Avenue and N.W. 64th Terrace, and more specifically described as follows:

 

All that part of the Southeast Quarter of Section 19, Township 51, Range 33, in the City of Kansas City, Platte County, Missouri, more particularly described as follows: Beginning at the southeast corner of Wexford Place Second Plat, a subdivision of land located in said Southeast Quarter Section, in the City of Kansas City, Platte County, Missouri said corner also being the most southerly point of said Wexford Place Second Plat lying on the westerly right of way line of N. Cosby Avenue as now established; thence South 13 degrees 35 minutes 06 seconds West, along said westerly right of way line a distance of 267.77 feet, to a point of curvature; thence along a curve to the right having a radius of 15.00 feet and a central angle of 86 degrees 09 minutes 54 seconds, a distance of 22.56 feet, to a point of tangency, said point lying on the northerly right of way line of N.W. 64th Terrace, as now established; thence North 80 degrees 15 minutes 00 seconds West, along said northerly right of way line, a distance of 17.43 feet to a point of curvature; thence along a curve to the left having a radius of 825.00 feet and a central angle of 29 degrees 17 minutes 00 seconds along said northerly right of way line, a distance of 421.65 feet, to a point of tangency; thence South 70 degrees 28 minutes 00 seconds West, along said northerly right of way line, a distance of 97.65 feet, to a point of curvature; thence along a curve to the right having a radius of 575.00 feet and a central angle of 30 degrees 02 minutes 24 seconds along said northerly right of way line and its westerly extension thereof, a distance of 301.47 feet; thence North 19 degrees 54 minutes 00 seconds East, a distance of 259.62 feet; thence North 70 degrees 29 minutes 00 seconds East, along the south line of said Wexford Place Second Plat and its westerly extension thereof, as now established, a distance of 622.16 feet; thence South 58 degrees 56 minutes 00 seconds East, along said south line, a distance of 120.85 feet, thence South 76 degrees 24 minutes 54 seconds East, along said south line, a distance of 127.05 feet, to the point of beginning, containing 5.6403 acres more or less.

 

for the purpose of deleting therefrom an approximately 4.22 acre tract of land, more specifically described as follows:

 

All that part of the Southeast Quarter of Section 19, Township 51, Range 33, and all that part of Lot 2, Wexford Place Second Plat, a subdivision of land, all being located in the City of Kansas City, Platte County, Missouri, described as follows: Beginning at the most easterly corner of Lot 2 of said Wexford Place Second Plat; thence North 13 degrees 56 minutes 00 seconds West, along the northeasterly line of said Lot 2, a distance of 24.75 feet; thence North 58 degrees 56 minutes 00 seconds West, continuing along said northeasterly line, a distance of 450.45 feet, to the most northerly corner of said Lot 2; thence South 40 degrees 50 minutes 00 seconds West, along the westerly line of said Lot 2, a distance of 69.82 feet; thence South 19 degrees 54 minutes 00 seconds West, continuing along said westerly line and its southerly prolongation, a distance of 437.62 feet, to a point of intersection with the southwesterly prolongation of the southeasterly line of said Lot 2; thence North 70 degrees 29 minutes 00 seconds East, along said prolongation and along said southeasterly line, a distance of 622.16 feet, to the point of beginning, except that part in streets and roads. Containing 4.2212 acres, more or less.

 

so that the remaining tract of land of approximately 1.4191 acres, more specifically described as follows:

 

This is a survey and subdivision of part of the Southeast Quarter of Section 19, Township 51, Range 33, in the City of Kansas City, Platte County, Missouri, and more particularly described as follows: Commencing at the southwest corner of said Southeast Quarter; thence South 89 degrees 00 minutes 48 seconds East, along the south line of said Southeast Quarter, a distance of 688.78 feet; thence North 0 degrees 59 minutes 12 seconds East, perpendicular to said south line, a distance of 461.51 feet, to the northerly right-of-way line of N.W. 64th Terrace, as now established, and the point of beginning; thence North 7 degrees 22 minutes 05 seconds East, a distance of 342.58 feet, to the southerly line of Lot 1, Wexford Place, Second Plat, a subdivision of land in said city, county and state; thence South 58 degrees 56 minutes 00 seconds East, along the southerly line of said Lot 1, a distance of 103.85 feet; thence South 76 degrees 24 minutes 54 seconds East, continuing along said southerly line, a distance of 127.05 feet, to the intersection with the westerly right-of-way line of N. Cosby Avenue, as now established; thence South 13 degrees 35 minutes 06 seconds West, along said westerly right-of-way line, a distance of 267.17 feet, to a point of curvature; thence southwesterly and westerly, continuing along said westerly right-of-way line, along a curve to the right having a radius of 15.00 feet and a central angle of 86 degrees 09 minutes 54 seconds, a distance of 22.56 feet, to a point of tangency, said point also being on the northerly right-of-way line of said N.W. 64th Terrace; thence North 80 degrees 15 minutes 00 seconds West, along said northerly right-of-way line, a distance of 17.43 feet, to a point of curvature; thence westerly, continuing along said northerly right-of-way line, along a curve to the left having a radius of 825.00 feet and a central angle of 11 degrees 06 minutes 43 seconds, a distance of 160.00 feet, to the point of beginning, containing 1.4191 acres, more or less.

 

is hereby approved. A copy of said amendment is on file in the office of the City Clerk with this ordinance and is made a part hereof.

 

Section B. That the Council finds and declares that before taking any action on the proposed amendment hereinabove, all public notices and hearings required by the Zoning Ordinance have been given and had.
