ORDINANCE NO. 110862

 

Authorizing execution of the renewal of a lease agreement with Lidia's Freighthouse, LLC, for the use of City owned property located at 21st Street and Main Street under the Main Street Viaduct, for parking purposes only.

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. That the Director of General Services is hereby authorized to execute a lease agreement with Lidia’s Freighthouse, LLC, for the use of the property generally located at 21st Street and Main Street, Jackson County, Missouri, and more particularly described as follows:

 

Those portions of Lots 25, 26, 27 and 28 of “Union Station” Addition lying west of the east edge of the elevated span of the Main Street Bridge (sometimes known as the Main-Walnut Connector/Viaduct) and all that part of the Main street right-of-way lying below the Viaduct from the northerly 200 feet, more or less, to the abutment of said Main Street Viaduct and the “upward” vertical dimensions of the described property leased herein stops at and shall not extend above a horizontal plane eight feet below the underside of the Viaduct passing above the described premises.

 

The property is to be used for parking purposes only, for a term of five years with one option to renew for an additional five year term with the lease beginning November 1, 2011, and ending October 31, 2016, at a rate of $5,724.60 per year adjusted annually by the Consumer Price Index (CPI) plus one percent. A copy of the lease agreement is attached hereto and made a part hereof by reference.
