ORDINANCE NO. 981392

 

Approving an amendment to a previously approved development plan in District GP-5 (Medium Density Residential Uses) on approximately a 66.75 acre tract of land generally located at the northeast corner of N.W. Barry Road and N. Amity Road. (9916-GP-3)

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That an amendment to a previously approved development plan in District GP-5 (Medium Density Residential Uses) on approximately a 66.75 acre tract of land generally located at the northeast corner of N.W. Barry Road and N. Amity Road, and more specifically described as follows:

 

A tract of land in the Northeast Quarter of Section 11, Township 51, Range 34, Kansas City, Platte County, Missouri, being bounded and described as follows: Commencing at the southeast corner of said Northeast Quarter; thence North 8905'03" West, along the south line of said Northeast Quarter, 420.00 feet to the true point of beginning of the tract to be herein described; thence continuing North 8905'03" West, along said south line 896.29 feet; thence North 017'14" West, 525.00 feet; thence North 8905'03" West, 420.00 feet; thence South 6733'08" West, 184.37 feet; thence South 8402'00" West, 490.99 feet; thence North 030'01" West, 160.00 feet; thence North 8905'03" West, 238.19 feet to a point on the west line of said Northeast Quarter, said line being also the centerline of N. Containing 66.74 acres, more or less.

 

is hereby approved, subject to the following conditions:

 

1. That the developer cause the area to be platted and processed in accordance with Chapter 66, Code of Ordinances of the City of Kansas City, Missouri, as amended, commonly known as the Subdivision Regulations.

 

2. That the developer submit a storm drainage study to the City Engineers Office for approval and that the developer make any improvements as required by the City Engineers Office.

 

3. That the developer submit plans for grading and siltation and erosion control to the City Engineers Office for approval prior to beginning any construction activities.

 

4. That the developer extend water mains as required by the Water Services Department.

 

5. That the developer secure a land disturbance permit from the Missouri Department of Natural Resources.

 

6. That a variance to the minimum lot depth requirement for the six lots as shown on the development plan is hereby granted.

 

7. That the developer secure the approval of the Board of Zoning Adjustment for any subdivision identification signage.

 


8. That the developer secure a floodplain certificate if any grading is to occur within a floodplain.

 

9. That the developer design and install streetlights as required by the Department of Public Works for all streets.

 

10. That the developer submit a street name signage plan to the Street Naming Committee for approval prior to the submittal of the first final plat.

 

11. That the developer enter into a Fair Noise Disclosure Agreement to provide a disclosure for any real estate transaction as required by the Aviation Department.

 

12. That the developer grant an Aviation Noise Easement (for each phase) to the City and file the Easement with each final plat.

 

13. That the developer construct cul-de-sacs as required by the Department of Public Works.

14. That the developer extend sanitary sewers as required by the Department of Public Works.

 

15. That the developer construct all-weather roads and provide for fire protection as required by the Fire Department prior to construction beyond footings and foundations.

 

16. That the developer submit covenants, conditions and restrictions to the Law Department for approval with the final plats, including provisions for maintenance of the private open space and any detention facilities.

 

17. That the developer submit a street tree planting plan as part of the final plat and secure the approval of the City Forester for street trees planted on right of way in front of residential lots, with a copy to be submitted to the Department of City Development. The plan shall include size, type, species, and placement of trees.

 

18. That the developer submit a final plan to the City Plan Commission for approval, including plans for grading, landscaping, lighting and signage.

 

A copy of said development plan is on file in the office of the City Clerk under Document No. 981392, which is attached hereto and made a part hereof.

 

Section B. That the Council finds and declares that before taking any action on the proposed amendment hereinabove, all public notices and hearings required by the Zoning Ordinance have been given and had.
