ORDINANCE NO. 060829

 

Approving a development plan in District GP-7 on approximately an 828 acre tract of land generally bounded on the west by N. Winan Avenue and a line extending one-quarter mile west of N. Winan Avenue, by Missouri Route 92 and the corporate limits of Kansas City on the north, by the prolongation of a line located approximately one mile north of and parallel to N.W. 128th Street on the south, and on the east by a line generally located 2,000 feet east of N.W. Interurban Road. (12175-GP-2)

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That a development plan in District GP-7 (Agricultural and Low Density Residential Uses) on approximately an 828 acre tract of land generally bounded on the west by N. Winan Avenue and a line extending one-quarter mile west of N. Winan Avenue, by Missouri Route 92 and the corporate limits of Kansas City on the north, by the prolongation of a line located approximately one mile north of and parallel to N.W. 128th Street on the south, and on the east by a line generally located 2,000 feet east of N.W. Interurban Road, and more specifically described as follows:

 

All that part of the Northwest and Southwest Quarter of Section 1 and all that part of the Northeast, Northwest, Southeast and Southwest Quarter of Section 2, all that part of the Southeast Quarter of Section 3, all being in Township 52, Range 34 and all that part of the Southeast Quarter of Section 35 and all that part of the Southwest Quarter of Section 36, all in Township 53, Range 34, Kansas City, Platte County, Missouri, being described as follows: Beginning at the Southwest corner of the Southwest Quarter of said Section 2; thence North 0o3309 East, along the West line of said Southwest Quarter, 1439.33 feet; thence North 78o5415 West, 286.50 feet; thence South 04o5232 East, 233.23 feet; thence South 89o2331 West, 1044.18 feet; thence North 0o2950 East, 1385.86 feet to a point on the North line of said Southeast Quarter; thence North 89o3333 East along said North line, 1305.10 feet to the Southwest corner of the Northwest Quarter of said Section 2; thence North 89o5742 East along the South line of said Northwest Quarter, 35.00 feet to a point on the Easterly right-of-way line of Missouri State Route O, as now established; thence North 0o2129 East, along said Easterly right-of-way line, 1910.05 feet; thence North 0o4129 East, along said Easterly right-of-way line, 567.50 feet; thence North 50o1936 East, along said Easterly right-of-way line, 52.46 feet to a point on the Southerly right-of-way line of Missouri Highway 92, as now established; thence North 89o5636 East, along said Southerly right-of-way line, 1483.18 feet; thence Northeasterly, continuing along said Southerly right-of-way line, along a curve to the left, tangent to the last described course, having a radius of 1472.39 feet and a central angle of 30o4241, an arc distance of 789.22 feet to a point on the Kansas City City Limits Line; thence South 89o5039 East, along said City Limits Line, 367.30 feet; thence North 89o5931 East, along said City Limits Line, 2624.13 feet; thence South 89o4205 East, along said City Limits Line, 78.92 feet; thence North 01o2332 East, along said City Limits Line parallel with the West line of the Southwest Quarter of said Section 36, 550.00 feet; thence South 89o4205 East, along said City Limits Line parallel with the South line of said Southwest Quarter, 275.00 feet; thence South 01o2332 West, along said City Limits Line parallel with the West line of said Southwest Quarter, 550.00 feet; thence South 89o4205 East, along said City Limits Line, 933.79 feet; thence South 0o1446 East, along the East line of the West One-Half of the Northwest Quarter of said Section 1 and its Northerly prolongation, 2748.84 feet; thence South 0o3237 West, along the East line of the West One-Half of the Southwest Quarter of said Section 1, 2623.42 feet to the Southeast corner of said West One-Half; thence North 89o4616 West, along the South line of said Southwest Quarter, 1333.47 feet to the Southeast corner of the Southeast Quarter of said Section 2; thence North 89o4157 West, along the South line of said Southeast Quarter, 472.82 feet; thence North 0o1803 East, 718.50 feet; thence North 89o4157 West, 571.20 feet; thence North 06o5932 East, 539.76 feet; thence North 89o4618 West, 335.50 feet; thence South 0o3436 West, 1254.17 feet to a point on the South line of said Southeast Quarter; thence North 89o4157 West, along said South line, 1322.66 feet to the Southeast corner of the Southwest Quarter of said Section 2; thence South 89o5153 West, along the South line of said Southwest Quarter, 2641.94 feet to the Point of Beginning. Except that part of the Southeast Quarter of said Section 3, being described as follows: Commencing at the Northeast corner of said Southeast Quarter; thence South 0o3309 West, along the West line of said Southeast Quarter, 90.00 feet to the True Point of Beginning of the tract to be herein described; thence continuing South 0o3309 West, along said East line, 50.00 feet; thence South 89o3333 West, 90.19 feet; thence North 0o3309 East, 50.00 feet; thence North 89o3333 East, 90.19 feet to the True Point of Beginning. Containing 828.68 acres, more or less. Also, except any part lying in road right-of-way.

 

is hereby approved, subject to the following conditions:

 

1.      That the developer submit plans for grading and siltation and erosion control to the City Engineers Office for approval prior to beginning any construction activities.

 

2.      That the developer obtain a land disturbance permit from the Department of Public Works prior to beginning any construction, grading, clearing or grubbing activities, if the disturbed area exceeds one acre.

 

3.      That the developer extend and/or enlarge water mains and provide easements as required by the Water Services Department.

 

4.      That the developer install hard surface roads and provide for fire protection as required by the Fire Department prior to construction beyond foundations.

 

5.      That the developer enter into a Cooperative Agreement with the City whereby the developer will improve N. Winan Avenue from the access drive to the asphalt plant, south approximately one mile, to N.W. 128th Street, by widening N. Winan Avenue to a pavement width as required by the Department of Public Works and to a depth which will accommodate 50 ton trucks prior to the approval of a final plan by the City Plan Commission.

 

6.      That the developer comply with the Kansas City International Airport height zoning restrictions and that no structure in this area be constructed which exceeds these zoning restrictions.

 

7.      That the developer grant an Aviation Noise Easement to the City as required by the Aviation Department.

 

8.      That the developer submit a final plan to the City Plan Commission for approval, including plans for landscaping, grading and signage.

 

A copy of said development plan is on file in the office of the City Clerk with this ordinance and is made a part hereof.

 

Section B. That the Council finds and declares that before taking any action on the proposed amendment hereinabove, all public notices and hearings required by the Zoning Ordinance have been given and had.
