ORDINANCE NO. 090028

 

Approving an amendment to a previously approved preliminary plan in District M-P (Planned Industrial District) on approximately a 50.2 acre tract of land generally located at the southeast quadrant of N.W. Barry Road and N. Platte Purchase Drive. (6733-MP-7)

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That an amendment to a previously approved preliminary plan in District M-P (Planned Industrial District) on approximately a 50.2 acre tract of land generally located at the southeast quadrant of N.W. Barry Road and N. Platte Purchase Drive, and more specifically described as follows:

 

A resurvey and resubdivision of part of Lot 1, K C P L Northland Service Center, a subdivision of land in Kansas City, Clay and Platte Counties, Missouri, and a survey and subdivision of part of the SW 1/4 of Fractional Section 10, Township 51, Range 33, in Kansas City, Clay County, Missouri, all more particularly described as follows: Commencing at the intersection of the South line of the SW 1/4 of said Fractional Section 10 with the Clay-Platte County line; thence South 89 degrees 39 minutes 09 seconds East, along the South line of the SW 1/4 of said Fractional Section 10, a distance of 60 feet, to a point on the East line of the Tract described in Quit Claim Deed filed as Document No. L-25758 recorded in Book 2107 at Page 438 in the office of the Recorder of Deeds Clay County Courthouse, said point also being on the East right-of-way line of North Platte Purchase Drive, as now established, said point further being the true point of beginning of subject tract; thence North 0 degrees 09 minutes 17 seconds East (North 0 degrees 06 minutes 23 seconds East deed), along the East line of said Tract, and along the East right-of-way line of said North Platte Purchase Drive, a distance of 990.85 feet, to a point of curvature; thence Northerly and Northwesterly, along the East line of said Tract, and along the East right-of-way line of said North Platte Purchase Drive, said line being a curve to the left having a radius of 1175.92 feet, a central angle of 15 degrees 22 minutes 07 seconds, a distance 315.42 feet, to a point of tangency; thence North 15 degrees 12 minutes 50 seconds West (North 15 degrees 15 minutes 44 seconds West deed), along the East line of said Tract, and along the East right-of-way line of said North Platte Purchase Drive, a distance of 67.73 feet (70.65 feet deed), to a point on said Clay-Platte County line; thence North 0 degrees 09 minutes 17 seconds East, along said Clay-Platte County line, and along the East right-of-way line of said North Platte Purchase Drive, a distance of 3.03 feet; thence North 74 degrees 47 minutes 10 seconds East (North 74 degrees 44 minutes 08 seconds East plat), along the East right-of-way line of said North Platte Purchase Drive, a distance of 9.20 feet, to a point on the West line of said Lot 1; thence North 15 degrees 12 minutes 50 seconds West (North 15 degrees 15 minutes 52 seconds West deed), along the West line of said Lot 1, and along the East right-of-way line of said North Platte Purchase Drive, a distance of 273.28 feet, to a point of curvature; thence Northwesterly, Northerly and Northeasterly, along the West line of said Lot 1, and along the East right-of-way line of said North Platte Purchase Drive, said line being a curve to the right having a radius of 630 feet and a central angle of 33 degrees 19 minutes 25 seconds, a distance of 366.41 feet, to a point of tangency; thence North 18 degrees 06 minutes 35 seconds East (North 18 degrees 03 minutes 33 seconds East plat), along the West line of said Lot 1, and along the East right-of-way line of said North Platte Purchase Drive, a distance of 5.64 feet, to a point of curvature, said point also being on the East line of the New Right-of-way Tract described in Warranty Deed filed as Document No. 16301 recorded in Book 914 at Page 135 in the office of the Recorder of Deeds Platte County Courthouse; thence Northeasterly, along the East line of said Tract, and along the East right-of-way line of said North Platte Purchase Drive, said line being a curve to the right having a radius of 630 feet and a central angle of 6 degrees 49 minutes 35 seconds, a distance of 75.06 feet, to a point of reverse curvature; thence Northeasterly and Northerly, along the East line of said Tract, and along the East line of the New Right-of-way Tract described in Warranty Deed filed as Document No. P-68274 recorded in Book 3957 at Page 897 in the office of the Recorder of Deeds Clay County Courthouse, and along the East right-of-way line of said North Platte Purchase Drive, said line being a curve to the left having a radius of 700 feet, a central angle of 16 01' 40" and whose initial tangent bearing is North 25 degrees 26 minutes 27 seconds East, a distance of 195.82 feet, to a point on the Westerly extension of the South line of the Tract described in Warranty Deed filed as Document No. P-70289 recorded in Book 3063 at Page 468 in the office of the Recorder of Deeds Clay County Courthouse; thence South 86 degrees 04 minutes 55 seconds East (South 86 degrees 07 minutes 57 seconds East deed), along the South line and its extension of said Tract, a distance of 127.36 feet; thence North 21 degrees 16 minutes 51 seconds East (North 21 degrees 13 minutes 49 seconds East deed), along the South line of said Tract, a distance of 52.77 feet; thence North 0 degrees 35 minutes 55 seconds East (North 0 degrees 32 minutes 53 seconds East deed), along the South line of said Tract, a distance of 50.55 feet (50.82 feet deed); thence South 89 degrees 24 minutes 05 seconds East (South 89 degrees 27 minutes 06 seconds East deed), along the South line of said Tract, a distance of 85.77 feet, to the Southwest corner of a Tract described in Warranty Deed filed as Document No. N-35433 recorded in Book 2660 at Page 952 in the office of the Recorder of Deeds Clay County Courthouse; thence South 89 degrees 26 minutes 05 seconds East (South 89 degrees 29 minutes 07 seconds East deed), along the South line of said Tract, a distance of 282.11 feet (282.76 feet deed); thence South 11 degrees 35 minutes 19 seconds East (South 11 degrees 38 minutes 21 seconds East deed), along the South line of said Tract, a distance of 97.17 feet; thence South 89 degrees 30 minutes 11 seconds East (South 89 degrees 29 minutes 15 seconds East deed), along the South line of said Tract, a distance of 38.55 feet, to a point on the East line of said Lot 1, K C P L Northland Service Center, said point also being on the West line of Lot 1, Ethans Glen First Plat, a subdivision of land now in Kansas City, Clay County, Missouri; thence South 0 degrees 09 minutes 48 seconds West (South 0 degrees 06 minutes 47 seconds West plat), along the East line of said Lot 1, K C P L Northland Service Center and along the West line of said Lot 1, Ethans Glen First Plat, a distance of 848.00 feet, to the Southwest corner of said Lot 1, Ethans Glen First Plat; thence South 89 degrees 30 minutes 11 seconds East (South 89 degrees 33 minutes 13 seconds East plat), along the North line of said Lot 1, K C P L Northland Service Center, and along the South line of said Lot 1, Ethans Glen First Plat, a distance of 500.00 feet; is hereby approved, subject to the following conditions:

 

1. That the developer cause the entire plan area under their control to be platted and processed in accordance with Chapter 66, Code of Ordinances of the City of Kansas City, Missouri, commonly known as the Subdivision Regulations, prior to the issuance of a permanent certificate of occupancy for the building addition.

 

2. That the developer dedicate additional right of way for a secondary arterial with a bike lane as required by Development Services so as to provide a minimum of 46 feet of right of way as measured from the centerline of N. Platte Purchase Drive.

 

3. That the developer submit a detailed micro storm drainage study, consisting at a minimum of a letter from a Missouri licensed civil engineer stating that the proposed improvements will not alter or increase historical runoff conditions for the site, to Development Services prior to review and issuance of any building permits, and that the developer construct any improvements as required by Development Services prior to the issuance of any certificate of occupancy.

 

4. That the developer subordinate to the City all private interest in the area of any right-of-way dedication as required by Development Services, and that the developer be responsible for all costs associated with subordination activities now and in the future.

 

5. That the developer submit a letter from a licensed civil engineer, licensed architect, or licensed landscape architect, who is registered in the State of Missouri, stating the condition of the sidewalks, curbs, and gutters. The letter must identify state of repair as defined in Chapters 56 and 64, Code of Ordinances, for the sidewalks, curbs, and gutters. It shall identify the quantity and location of sidewalks, curbs, and gutters that need to be constructed, repaired, or reconstructed. The developer shall secure permits to repair or reconstruct the identified sidewalks, curbs, and gutters as necessary along all development street frontages, as required by Development Services, prior to recording the plat.

 

6. That the developer submit plans for grading, siltation, and erosion control to Development Services for review, acceptance, and permitting prior to beginning any construction activities.

 

7. That the developer install the previously approved white pine landscaping along the adjacent residential property prior to the issuance of a permanent certificate of occupancy for the building addition.

 

8. That the developer install the previously approved landscaping along N. Hickory Drive prior to the issuance of a permanent certificate of occupancy for the building addition.

 

9. That the developer obtain any necessary encroachment permit for the existing monument signs at the entrances on N. Platte Purchase Drive, or that the signs be relocated onto private property, prior to the issuance of a permanent certificate of occupancy for the building addition.

 

10. That the developer grant a BMP Easement to the City as required by Development Services.

 

11. That the developer receive the approval of the Board of Zoning Adjustment for any necessary variances.

 

12. That the developer submit a final plan to the City Plan Commission for approval, including detailed information on landscaping, signage (including elevations), lighting (including a photometric study showing zero footcandles at the property line and no direct illumination beyond the property line)and building elevations.

 

A copy of said amendment is on file in the office of the City Clerk with this ordinance and is made a part hereof.

 

Section B. That the Council finds and declares that before taking any action on the proposed amendment hereinabove, all public notices and hearings required by the Zoning Ordinance have been given and had.
