Approving an amendment to a
previously approved preliminary plan in District M-P (Planned Industrial
District) on approximately a 50.2 acre tract of land generally located at the
southeast quadrant of N.W. Barry Road and N. Platte Purchase Drive. (6733-MP-7)
BE IT ORDAINED
BY THE COUNCIL OF KANSAS CITY:
Section A. That
an amendment to a previously approved preliminary plan in District M-P (Planned
Industrial District) on approximately a 50.2 acre tract of land generally
located at the southeast quadrant of N.W. Barry Road and N. Platte Purchase
Drive, and more specifically described as follows:
A resurvey and
resubdivision of part of Lot 1, K C P L Northland Service Center, a subdivision
of land in Kansas City, Clay and Platte Counties, Missouri, and a survey and
subdivision of part of the SW 1/4 of Fractional Section 10, Township 51, Range
33, in Kansas City, Clay County, Missouri, all more particularly described as
follows: Commencing at the intersection of the South line of the SW 1/4 of said
Fractional Section 10 with the Clay-Platte County line; thence South 89 degrees
39 minutes 09 seconds East, along the South line of the SW 1/4 of said
Fractional Section 10, a distance of 60 feet, to a point on the East line of
the Tract described in Quit Claim Deed filed as Document No. L-25758 recorded
in Book 2107 at Page 438 in the office of the Recorder of Deeds Clay County
Courthouse, said point also being on the East right-of-way line of North Platte
Purchase Drive, as now established, said point further being the true point of
beginning of subject tract; thence North 0 degrees 09 minutes 17 seconds East

is hereby approved, subject to
the following conditions:
1. That the developer cause the entire plan area under their
control to be platted and processed in accordance with Chapter 66, Code of
Ordinances of the City of Kansas City, Missouri, commonly known as the
Subdivision Regulations, prior to the issuance of a permanent certificate of
occupancy for the building addition.
2. That the developer dedicate additional right of way for a
secondary arterial with a bike lane as required by Development Services so as
to provide a minimum of 46 feet of right of way as measured from the centerline
of N. Platte Purchase Drive.
3. That the developer submit a detailed micro storm drainage
study, consisting at a minimum of a letter from a Missouri licensed civil engineer
stating that the proposed improvements will not alter or increase historical
runoff conditions for the site, to Development Services prior to review and
issuance of any building permits, and that the developer construct any
improvements as required by Development Services prior to the issuance of any
certificate of occupancy.
4. That the developer subordinate to the City all private
interest in the area of any right-of-way dedication as required by Development
Services, and that the developer be responsible for all costs associated with
subordination activities now and in the future.
5. That the developer submit a letter from a licensed civil engineer,
licensed architect, or licensed landscape architect, who is registered in the
State of Missouri, stating the condition of the sidewalks, curbs, and gutters. The
letter must identify state of repair as defined in Chapters 56 and 64, Code of
Ordinances, for the sidewalks, curbs, and gutters. It shall identify the
quantity and location of sidewalks, curbs, and gutters that need to be
constructed, repaired, or reconstructed. The developer shall secure permits to
repair or reconstruct the identified sidewalks, curbs, and gutters as necessary
along all development street frontages, as required by Development Services,
prior to recording the plat.
6. That the developer submit plans for grading, siltation, and
erosion control to Development Services for review, acceptance, and permitting
prior to beginning any construction activities.
7. That the developer install the previously approved white pine
landscaping along the adjacent residential property prior to the issuance of a
permanent certificate of occupancy for the building addition.
8. That the developer install the previously approved
landscaping along N. Hickory Drive prior to the issuance of a permanent certificate
of occupancy for the building addition.
9. That the developer obtain any necessary encroachment permit
for the existing monument signs at the entrances on N. Platte Purchase Drive,
or that the signs be relocated onto private property, prior to the issuance of
a permanent certificate of occupancy for the building addition.
10. That the developer grant a BMP Easement to the City as
required by Development Services.
11. That the developer receive the approval of the Board of Zoning
Adjustment for any necessary variances.
12. That the developer submit a final plan to the City Plan
Commission for approval, including detailed information on landscaping, signage
(including elevations), lighting (including a photometric study showing zero
footcandles at the property line and no direct illumination beyond the property
line)and building elevations.
A copy of said amendment is on
file in the office of the City Clerk with this ordinance and is made a part
hereof.
Section B. That
the Council finds and declares that before taking any action on the proposed
amendment hereinabove, all public notices and hearings required by the Zoning
Ordinance have been given and had.
