ORDINANCE NO. 160531

 

Rezoning a 0.86 acre tract of land generally located at southwest corner of E. Bannister Road and Marion Drive from District UR to District B2-2. (6552-P-24)

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That Chapter 88, Code of Ordinances of the City of Kansas City, Missouri, commonly known as the Zoning and Development Code, is hereby amended by enacting a new section to be known as Section 88-20A1060, rezoning an area of approximately .86 acres generally located at southwest corner of E. Bannister Road and Marion Drive from District UR (Urban Redevelopment) to District B2-2 (Neighborhood Business 2 dash 2), said section to read as follows:

 

Section 88-20A1060. That an area legally described as:

 

All that part of Tract "A", Bannister 435 Resurvey, a subdivision of land in the City of Kansas City, Jackson County, Missouri, described as follows: Beginning at the point of intersection of the West right-of-way line of Marion Park Drive, as now established with the Southerly right-of-way line of Bannister Road, as established by Document No. K-957717 recorded in Book K-2095 at Page 1879 and by Document No. K-959585 recorded in Book K-2099 at Page 542 and by Document No. K-959586 recorded in Book K-2099 at Page 544 and by Document No. K-966136 recorded in Book K-2112 at Page 2297; thence South 2 degrees 11 minutes 58 seconds West, along said West right-of-way line, a distance of 231.99 feet; thence North 87 degrees 48 minutes 02 seconds West a distance of 155.00 feet; thence North 2 degrees 12 minutes 46 seconds East, a distance of 242.74 feet to a point on said Southerly right-of-way line; thence South 89 degrees 22 minutes 23 seconds East, along said Southerly right-of-way line, a distance of 140.00 feet; thence South 43 degrees 34 minutes 15 seconds East, continuing along said South right-of-way line, a distance of 20.93 feet to the point of beginning, also described as Tract 1 as shown on Certificate of Survey in Document K1021572 in Book S4, page 16.

 

All that part of Tract "A" Bannister 435 Resurvey, a subdivision of land in the City of Kansas City, Jackson County, Missouri, described as follows: Commencing at the point of intersection of the West right-of-way line of Marion Park Drive, as now established, with the Southerly right-of-way line of Bannister Road, as established by Document No. K-957717 recorded in Book K-2095 at Page 1879 and by Document No. K-959585 recorded in Book K-2099 at Page 542 and by Document No. K-959586 recorded in Book K-2099 at Page 544 and by Document No. K-966136 recorded in Book K-2112 at Page 2297; thence South 2 degrees 11 minutes 58 seconds West, along said West right-of-way line, a distance of 231.99 feet, to the true point of beginning of the tract of land to be herein described, thence North 87 degrees 48 minutes 02 seconds West, a distance of 155.00 feet; thence North 2 degrees 12 minutes 46 seconds east, a distance of 242.74 feet, to a point on the aforesaid Southerly right-of-way line of Bannister Road; thence North 89 degrees 22 minutes 23 seconds West, along said Southerly right-of-way line, a distance of 50.02 feet; thence South 2 degrees 12 minutes 46 seconds West, a distance of 381.21 feet; thence South 87 degrees 48 minutes 02 seconds East, a distance of 205.03 feet, to a point on said West right-of-way line; thence North 2 degrees 11 minutes 58 seconds East, along said West right-of-way line, a distance of 139.84 feet, to the point of beginning.

 

is hereby rezoned from District UR (Urban Redevelopment) to District B2-2 (Neighborhood Business 2 dash 2), all as shown outlined on a map marked Section 88-20A1060, which is attached hereto and made a part hereof, and which is hereby adopted as a part of an amendment to the zoning maps constituting a part of said chapter and in accordance with Section 88-20 thereof.

 

Section B. That the Council finds and declares that before taking any action on the proposed amendment hereinabove, all public notices and hearings required by the Zoning Ordinance have been given and had.
