ORDINANCE NO. 970953

 

Authorizing the Director of City Development to enter into a Real Estate Sales Contract with Mercantile Bank providing for the acquisition of approximately 5.6 acres of real estate generally located at 9901 Holmes Road for the sum of $590,000.00 for conversion and construction of a proposed Fire Station #36.

 

WHEREAS, the City now desires to acquire said property and provide for its use as a Fire Station; NOW, THEREFORE,

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. That the City Council does hereby approve and authorize the purchase of approximately 5.6 acres of property generally located at 9901 Holmes Road for the sum of $590,000.00 for the acquisition of the property in accordance with the Real Estates Sales Contract, a copy of which is attached hereto and made a part hereof at this place by reference and which is hereby accepted and approved.

 

Section 2. That the description of the real property approval for purchase hereunder is as follows:

 

Lots 2, 3, 4 and 5, Dynap-Jet Center, a subdivision of land in the City of Kansas City, Jackson County, Missouri, according to the plat filed on October 31, 1972, as Document K175200 in Plat Book 33 at page 19.

 

Section 3. That the Director of Public Works is hereby authorized to encumber and expend $590,000.00 for 9901 Holmes Road from funds heretofore appropriated from Public Safety Bond Program 1988 (96-376-089-7707-T) as and for consideration, provided that the Director shall delivery that sum to sellers only upon receipt of a Warranty Deed in due from conveying to Kansas City a good and merchantable title to the aforesaid lands.

 

Section 4. That the Director of City Development is hereby authorized to accept Warranty Deed conveying to Kansas City the property described in Section 1 above, and to execute written acceptances thereof and is directed to record the deeds, acceptances and a copy of this ordinance in the Office of the Recorder of Deeds for Jackson County, Missouri.
