COMMITTEE SUBSTITUTE FOR RESOLUTION NO. 940741
Amending the Westport Planning Area Plan by repealing the
Land Use Plan and approving a new Land Use Plan within an area generally
bounded by Valentine Road, Knickerbocker Place, Washington Street, Broadway
Boulevard, Central Street, and 38th Street.
WHEREAS, on August 11, 1972, Ordinance No. 41438
adopted the Westport Planning Area Plan as a plan for future development within
an area generally bounded on the north by 31st Street Trafficway, on the west
by State Line Road, on the south by Ward Parkway and on the east by Troost
Avenue; and
WHEREAS, the Westport Plan has been amended by
Ordinance No. 56687, Ordinance No. 57006, Ordinance No. 58324, Ordinance No.
57648, Ordinance No. 59731, Committee Substitute for Resolution No. 63219,
Resolution No. 64825, Resolution No. 921429, Resolution No. 931403; and
WHEREAS, due to certain changes over the years, it
is desirable to modify certain components of the Westport Plan by amendments to
the Land Use Plan; NOW, THEREFORE,
BE IT RESOLVED BY THE COUNCIL OF KANSAS CITY:
Section A. That the Westport Planning Area Plan is
hereby amended by repealing the Land Use Plan and approving a new Land Use Plan
within an area generally bounded by Knickerbocker Place, Washington Street,
Central Street, and 38th Street; and approving in lieu thereof a new Land Use
Plan for said area, a copy of which Land Use Plan is attached hereto and
incorporated herein by reference, as Exhibit "A", and that the
following guidelines be added to page 64 of the Plan:
1. Development on the east side of Washington
Street shall be designed to adequately screen the surrounding
residences from activity related to any
non-residential
use.
2. All access to the site shall be provided on
either Broadway Boulevard of Valentine Road.
3. The final design of landscaping, screening,
lighting, signage, and building facades shall be reviewed and
approved by the Director of City Development
through a
URD rezoning process.
4. Development shall conform to appropriate
guidelines for historic properties and historic preservation, as
administered by the City's Historic
Preservation
Management Division.
5. Development shall not create excessive noise
levels, as may be determined by the Health Department, beyond the
boundaries of the subject site.
6. Landscaping and screening plans along Broadway
Boulevard shall be reviewed and approved by the Parks and
Recreation Department.
Section B. That the Council hereby finds and
declares that before taking any action on the proposed amendment, all public
notices and hearings required by law have been given and had.
